HomeMy WebLinkAbout1998-01-26 98-93 ORDERCOUNCIL ACTION Item No. 90-93 Date January 26. 1998 Item/Subject: Authorizing Execution of Municipal Quitclaim Deed -- Real Estate Located at 137 Warren Street Responsible Department: Legal Comsentary: The wastewater Treatment Plant received full payment of outstanding sewer charges in the amount of $1,232.97 against property located at 137 Warren Street, formerly owned by Michael P. McMahon. Mr. McMahon died in 1988. The lien was recorded in March, 1996. Because the lien has matured, a municipal quitclaim deed is necessary to release the City's interest. Bangor Savings Bank, mortgagor, has requested that the deed be directed to the Michael P. McMahan Heirs. The real estate tax account is current, and there are no existing code violations. The Finance Committee recommended approval at its meeting held on January 20th. Heller, Finance Director, is hereby authorized, on behalf of the City of Bangor, to execute a Municipal Quitclaim Deed releasing any interest the City may have in the real estate located at 137 Warren Street in said Bangor by virtue of a matured municipal sewer charge lien recorded in Book 6065, Page 239, Penobscot Registry of Deeds. Said deed shall be directed to Irene McMahon and John McMahon as tenants in common, not as joint tenants. IN CITY COUNCIL January 26, 1998 Passed 98-93 ORDER F .EPR Title, Authorizing Execution of Municipal Quitclaim Deed Real Estate Located at 137 Warren Street ...................................... ...................................... m Assigned to 98-93 MUNICIPAL QUITCLAIM DEED The CITY OF BANGOR, a municipal corporation located i Bangor, Penobscot County, Maine, as Grantor, for consideration paid, releases t0 IRONE MCMAHON and JOHN MONARCH, as tenants in common, not as joint tenants, as Grantees, a certain lot or parcel of land together with the buildings thereon, situated in Bangor, Penobscot County, Maine, more particularly described as follows, viz: Commencing at an iron bolt set in the ground at point where the division line between land now or formerly of Nellie Wright and the land hereby conveyed intersects the southwesterly line of Warren Street; thence in a generally south- easterly direction by and along said Warren Street forty-five (45) feet to an iron bolt set in the ground; thence in a generally south- westerly direction in a course which is parallel to said division line between this land and land, now or formerly of Nellie Wright one hundred two (102) feet, more or less, to an iron bolt set in the ground; thence in a generally northwesterly direction forty-five (45) feet to an iron bolt set in the ground on the division line first mentioned; thence in a generally northeasterly direction one hundred two (102) feet, more or less, to the place of beginning. Being the same premises as described in a Quit -Claim Deed With Covenant from Mary E. McMahon to Michael P. McMahon, dated April 10, 1979, and recorded in Book 2965, Page 172, Penobscot Registry of Deeds. Any and all other rights, easements, privileges and appurtenances belonging to the granted estate are hereby conveyed. The purpose of this deed is to release to the Grantees any interest the Grantor may have in the above described property by virtue of a sewer lien assessed against Michael P. McMahon Heirs and recorded in Book 6065, Page 239, Penobscot Registry of Deeds. All public easements or other public interests in the described premises for roads, sewers, or other purposes are expressly reserved. The said CITY OF BANGOR has caused this instrument to be Baled with its corporate seal, and signed in its corporate name by RONALD 1.
