HomeMy WebLinkAbout1999-02-22 99-100 RESOLVECOUNCIL ACTION Item No. 99-100 Date _February 22 1999 Item/Subject: Waiving 30 Day Notice Period for Cable Television Program Channel Designations Responsible Department: Legal Commentary: Frontiervision Operating Partners has proposed a change in channel designations for certain channels on the basic tier of cable service for Bangor cable subscribers, to help address reception problems on certain older "cable ready" television sets. The attached Resolve would approve the proposed changes effective March 1, 1999, thereby waiving a 30 -day notice period that may otherwise apply under section 13.7 of FrontierVision's cable franchise agreement with the City of Bangor. This issue was reviewed by the Municipal Operations Committee on February 16th, and the Committee recommends approval. Television Channel Designations By W City Coaveit of Ne City Of Bangor: BBSOLVBD, WHEREAS, FrontierVision operating Partners, L.P., Currently holds a cable television franchise agreement from the City of Bangor; and WHEREAS, Frontiervislon wishes to implement changes to its channel designations for the basic tier of cable service to Bangor subscribers, effective March 1, 1999; and WHEREAS, Section 13.7 of the City's Cable Television Ordinance requires 30 days notice to cable subscribers of any changes in Cable service and a question has arisen as to whether a change in channel designations may constitute a change in Cable service under section 13.7; and WHEREAS, in the City Council's judgment, it is In the interest of Bangor cable subscribers that the changes to Frontier - Vision's basic cable channel designations be implemented March 1, 1999 as proposed, By the City Council of the City of Bangor: RESOLVED, THAT (1) The 30 day notice period for changes in cable service s provided in section 13.7 of Bangor's Cable Television Ordinance is hereby waived with respect to the basic cable channel designation changes proposed by FrontlerVision to be implemented March 1, 1999. A copy of the proposed channel designation changes is attached to this Resolve and is incorporated herein by reference. (2) This Resolve does not waive the 30 day notice period with respect to any future changes in cable service for Bangor subscribers proposed for implementation after March 1, 1999. The reason this problem exists is due to the fact that certain television tuners on cable ready televisions will not pass those frequencies. We propose that by moving these thermals, this would enable us to place premium services, which require a converter, on these channels.
