Item No. 99-&7
Date December 28, 1998
Item/Subject: Ordinance, Amending City Parks ordinance, Section
231-11, Violations and Penalties
Responsible Department: Legal
The attached ordinance would amend the penalty provision of the
City's Parks Ordinance, to delete the phrase "shall be deemed
guilty of a misdemeanor." Under current Maine law, all municipal
ordinance violations are civil violations. Municipalities have no
authority to define criminal offenses, whether misdemeanors or
felonies. The reference to misdemeanors in the current ordinance
is archaic language adopted prior to 1960, and should be deleted.
