HomeMy WebLinkAbout1998-12-28 99-47 ORDINANCECOUNCIL ACTION Item No. 99-&7 Date December 28, 1998 Item/Subject: Ordinance, Amending City Parks ordinance, Section 231-11, Violations and Penalties Responsible Department: Legal The attached ordinance would amend the penalty provision of the City's Parks Ordinance, to delete the phrase "shall be deemed guilty of a misdemeanor." Under current Maine law, all municipal ordinance violations are civil violations. Municipalities have no authority to define criminal offenses, whether misdemeanors or felonies. The reference to misdemeanors in the current ordinance is archaic language adopted prior to 1960, and should be deleted. THAT Section 231-11 of the Code of the City of Bangor is hereby amended to read as follows: S 231-11. Violations and penalties. Any person, firm or corporation violating any provisions of this chapter shall-be-deemed-guilty-a€-a-miseemeaaer-and; upon conviction thereof, shall be fined in an amount not exceeding $100. Each day such violation Is committed or Permitted to continue shall constitute a separate offense and shall be punishable as such hereunder.
