The property located at 273-277 Hammond Street has a matured 1996
and a non -matured 1999 tax lien recorded against it. Machias
Savings Rank, which holds a mortgage against the property, was not
notified of the City's tax lien. The bank has agreed to loan the
property owner money to pay all outstanding taxes and sewer fees so
that the property can be sold. The property is currently placarded
and has many code issues. This Order would authorize the City to
release its interest back to Albion Smith, the property's former
owner, provided such payment is received by December 15th.
Normally, the City would not allow a late redemption of this
Property without requiring correction of existing code violations.
However, due to the lack of notice to Machias Savings Bank, the
Bank has a separate statutory redemption right under 36 MRSA
S 943. In effect, the attached Order would allow Albion Smith to
redeem title to the property, not in his own right, but as assignee
of Machias Savings Bank.
The Finance Committee recommended approval at its November 16, 1998
meeting.

TEAT Ronald I. Heller, Finance Director, is hereby
authorized, on behalf of the City of Bangor, to execute a Municipal
Quitclaim Deed releasing any interest the City may have in real
estate located at 273-277 Hammond Street in said Bangor by virtue
of an undischarged municipal real estate tax lien filed for tax
year 1996 and recorded in Book 6140, Page 298 in the Penobscot
Registry of Deeds; provided, however, that payment of said lien
shall be received by the City of Bangor on or before December 15,
1998. Said deed shall be directed to Albion K. Smith.

MUNICIPAL OOITCLAIM DEED
The CITY OF BANGOR, a municipal Corporation located in
Bangor, Penobscot County, Maine, as Grantor, for consideration
paid, releases to ALBION K. SMITH of Levant, Penbscot County,
Maine, as Grantee, the property located in Bangor, Penobscot
County, Maine, more particularly bounded and described as follows:
Real estate located at 273-277 Hammond Street in
said Bangor, and described in deeds recorded in
Volume 3440, Page 133 and Volume 5628, Page 139,
Penobscot Registry of Deeds. This property is
further designated as Assessor's Map 33, Lot 44,
real estate account number 71291.
Any and all other rights, easements, privileges
and appurtenances belonging to the granted
estate are hereby conveyed.
The purpose of this deed is to release to the Grantee any
interest the Grantor may have in the above-described property by
virtue of an undischarged real estate tax lien assessed against
Albion K. Smith and recorded in Book 6140, Page 298, Penobscot
Registry of Deeds.
All public easements or other public interests in the
described premises for roads, sewers, or other purposes are
expressly reserved.
The said CITY OF BANGOR has caused this instrument to be
sealed with its corporate seal, and signed in its corporate name by
RONALD I. HELLER, Finance Director, thereunto duly authorized, this
day of November, 1998.
