Connnentary:
Hanover Associates owns a development Pascal on Bangor Mall Boulevard between Wendy's
and TOys'R' Us. This parcel is bisected by a City severer line. Hanover Associates has rerouted
a portion of the sewer line per City specifications to facilitate development of the site. The
attached Order authorizes execution of a release deed for the potion of sewer easement no
longer needed. A copy of the deed and a sketch showing location of the sewer easement
involved is attached.

The City Manager is hereby authorized and directed to execute a deed releasing
O7 interest in a sewer easement for a porton of discontinued sewer crossing a
parcel of land owned by Hamover Associates on Bangor Mall Boulevard. Acopy
of the release deed is attached.

RELEASE
City of Bangor, a municipal corporation, located in Bangor, Penobscot County,
Sante ofMainq as gmator, for consideration paid, releases end conveys to the Hanover
Associates, a corporation duly and existing ander the laws of the State of Maine and
located in Bangor, County of Penobscot State of Maine, any interest the it may have in a
portion of twenty foot wide sanitary sewer inserted over and across aportion of the
parcel of land described in the deed from the City of Bangor to Boom& associates, dated
September 18,1978 and recordN in the Penobscot County Registry of Deeds in Volume
2914, Page 169 and bounded and described as follows:
Beginning at an angle point in the northwesterly sidefine of a20 fool wide sanitary sewer
easement. that was reserved by the City of Bangor in a dead from the City of Bangor to
Bounds Associates deed September 19, 1979 and reeerdal a the Penobscot Registry of
Deeds is Volume 2914, Page 169, said point of beginning is further described as being 10
feet more or less, northwesterly of a manhole located at STATION 2W3.8 as shown on a
plan filed in Plan Book 5, Page 129 of the records of the City of Bangor Engineering
Department, said Point is also described as being 111.75 feet as measured on a course of
S 70021'44" E from the northwesterly comer of Lot 16A as shown an a Subdivision Pian
eeitled "Lot 19 & 16A, Bangor Mall for Bar nak Associates", which is recorded at the
Penobscot R4stry of Deeds in Map File IW91;

reserved in said Volume 2914, Page 169, a distance of70.25 per to a point on the
westerly sideline of an eassma d described in a sanitary sewer easement deal of even dde
granted by Hanover Associates to City of Bangor.

said sam ary sewer consonant dad of even date granted by Hanover Associates N the
City of Bangor, adistance of 30.36 fat to a point de6rred by the intersection of said
easement with the southeasterly sideline of the original statement: reserved in said Volume
2914, Page 169;
Therac S 340 19'-43" W by and along the southwealerly line of said 20 foot wide
easement reserved in said Volume 2914, Page 169, a distance of 44.89 fact N an angle
point in said 20 foot wide sanitary sewedine easement said angle point is further
described as being 10 feet, more or less, southeasterly of a manhole located m STATION
2W3.8 as shown on a plan filed in plan Book 5, page 129 of the records ofthe City of
Bangor Engineering Department;
Thence S 20000' 50" W by and along the southeasterly line of said 20 foot wide command
reserved in said Volume 2914, Page 169, a distance of 55.65 fat to a point defined by the
intersection of said soudreasterly line with the northwesterly sideline of an easement
described in a sanitary sewer easement dad of even dote granted by Hanover Associates
to the City of Bangor;
Thence S 650 16' 08" W by and along the northwesterly sideline of said easement
described in a sanitary sewer easement deed of even date granted by Hanover Associates
to the City of Bangor, a distance of 28.16 feet to a point defined by the intersection of
said northwesterly sideline with the northwesterly sideline of the said 20 foot wide
easement reserved in said Volume 2914, Page 169;
Thence N 200 00'50" E by and along the northwesterly line of said 20 foot wide easement
reserved in said Volume 2914, Page 169, a distance of 77.99 feet to Wa point of
beginning.
Bearings referenced herein are oriented to Grid North of the Maim Stale Coordinate
System East gone.

Meaning and emending to release to the Grenlee herein that portion of the original
20 foot wide easement that was reserved by the City of Bangor in a deed Even the City of
Bangor to Banmak Associates, dazed September 18, 1998 and recorded in the Penobscot
County Registry of Deeds in Volume 2914, Page 169.
