Commentary:
Staff has been working with MDOT to implement the change in traffic pattern on Oak Street to
two-way travel. To expedite this, the City will be doing the actual work and MDOT will
reimbutse the expenses.
The attached Resolve would appropriate up to $15,000 to accomplish this work m a capital
account to be established by the Finance Director. Reimbursement by MDOT will be an
offsetting revenue for the expense incurred.Dppg'nJ

RESOLVED,
WHEREAS, by Crowd Resolve 97441 approved on October 27, 1997 the City Commit
approved a change in the existing tmtEc pattern on lower Oak Street to allow two-way
traffic, and;
WHEREAS, Commil Order No. 97441 directed the City Engineer to work with MDOT
and BACTS to implement this change as soon as possible and;
WHEREAS, MOOT has indicated a preference for the City of Bangor to undertake
necessary traffic control improvement to expedite implementation, the costs of which
MOOT will ecimbame to the City of Bangor,
NOW THEREFORE, BE IT RESOLVED,
By the City Coned of the City of Bangor that a sum not to exceed $25,000.00 is hereby
appropriated to a capital account to be established by the Finance Director for
mplementing traffic control improvements on lower Oak Street, said sum to be
reimbursed by MDOT.

MEMORANDUM OF AGREEMENT
This MEMORANDUM OF AGREENhmor is entered into on this FOURTH day of DECEMBER,
1997 by and betweenthe STATE OF MAWBDEPARTME[-T OFTRANSPORTATION(hereafler
DEPARTMENT) and the CTTY OF BANGOR, a body corporate and politic located in the County of
Penobscot (hereafter CITY) regarding certain traffic operational improvements and traffic signal
modifications in Bangor necessary to allow one bane of traffic coming off the Dew Pambscol River
Bridge to proceed northerly on Oak Street between Washington and Hancock Streets, as fllows:
A. The CITY ogees to make all ofthe necessary improvements ant modifications a outlined in
proposal beremfore agreed upon between the parties hereto, generally described as £Rows:
1. Traffic signal modifications, new signing and pavement madtings at the intersection of
Washington and Oak Streets.
2. Traffic signal modifications, new signs and pavement markings m the intersection ofDancock and
Oak Strats.
3. Pavement markings; m the intersection of Oak ant York Streets,
4. Nev, traffic signal controller at the intersection of Broadway and Some Street, re the extent that
the existing controller shill be resumed to the DEPARTMENT as hereinafter provided under
Paragraph B below.
B. The CTTY agrees to return the exisfing controller at Ne location hereinbefore described under
Paragraph A4 above to the DEPARTMENT upon installation of the new controller as therein
provided.
C. The CITY agrees to mum all of the additional operational and maintenance responsibilities forthe
improvements and modifications made hereunder.
D. The DEPARTMENT agrees to pay to the CITY upon receipt of an invoice or claim for
reimbureanent following the satisfactory completion of the improvements and modifications
hereinbefore described, the sum ofTwemy-Four Thousand Nme Hundred Fifty -Four and 651100
($24,954.65) Delius as outlined in the detailed cost estimate heretofore submitted by the CITY and
accepted by the DEPARTMENT.
1. No changes shall be made in the scope ofwork or the cost thamfas hereinbefore described
unless specifically agreed to in writing by the parties hereto.
2. All such improvements and modifications, shall be subject to a final inspection and acceptance by
the DBPARTMENT prior to the payment of any such claim for reimbursement. Payment shall be
made under the DEPARTMENT's Federal Aid Project No. BR-BRP-03SP(35)/PW 2672.00.

3. Any such chin for reimbursement shill besubject to audit by State and Federal authorities.
Copies of records and documemation supporting such claim shall be fumishd to the
DEPARTMENT upon request All such retools and documentation not furnished to the
DEPARTMENT shall be retained and preserved by the =for a period of Inst four (4)
yeate from the date of payment of such claim
IN WETNESS WHEREOF, the parties bereto have executed this Memorandum of Agreement in
duplicate effective on the day and data fust above written.
