HomeMy WebLinkAbout1997-11-24 98-17 ORDERCOUNCIL ACTION Date: November 24, 1997 hem NO.: 98-17 luedSubjecC Authorizing City Manager to Execute Release Deed -Easements for Abandoned Sewer Line at Bangor Mall Responsible Department: Engineering Commentary: The owner of the Bangor Mall is in the process of refinancing the property, and representatives for their title insurance company, have raised a question relative to cousin easements for a sewer line which was abandoned in 1987, when the Penjajawoc Interceptor was constructed to serve the area The abandoned sewer lirw was a former force main extending from a pump station behind K -Mart, extending through the Mail property to Stillwater Avenue, and is not needed for future service. A previous document abandoning this particular line is not worded correctly; therefore Bangor Mall has requested that a new release deed be exerted by the City to clarify this issue. The attached Order would authorize the City Manager to execute the necessary document Approval is recommended. Wolstein to the City of Bangor recorded in Book 2223, Page 309 and the deed from Pauline Rudnicki to ME Cay of Bangor recorde! in Book 2234, Page 714, end more particularly depicted on the survey of the Bangor Mall recorded in Map File F99-77. That survey depicts the Wolstein and Rudnicki easements as being located, in part, under structures at the Bangor Mall. Then survey also notes that portions of these sewer easements were to be abandoned. This letter will confirm that those porton; of the Wolstein and Rudnicki sewer asemants noted as on be abandoned were abandoned by the City of Bangor on October 14,1987 and were replaced by the easement to Ne City of Bangor uncoated in Book 2826, Page 356. The existing sewer line location is as depicted on Ne survey prepared by Sheppard & Counter dated November, 1992 and is not contained under Ne footprint of any existing building at Ne Bangor Mall. The release deed given by the City of Bangor to Banmak Associates recorded in Book 4123, Page 320 was intended to release those abandoned portions of the Wolstein and Rudnicki easements. It is our mulMstanding thin you would like the Ciry of Bangor to execute a wnfimlatory release to this effect and, provided Nat the release is in a form acceptable to Me Ciry Solicitor, l will prepare a Council Order authorizing Ne City Manger to execute said release, with a stuff recommendation for approval ?S,incemly, ames D.
