Accepting City Engineer's Report to Discontinue a Portion of Haskell Road Right-Of-Way
Summary
On July 10, 2017, Council Order 17-240 the City Engineer was directed to begin the process of discontinuing a
portion of Haskell Road.
Under 23 M.R.S.A. § 3026-A, before discontinuing a road, the City Council must provide notice to abutting
property owners. Notice was provided and the City Engineer held a public hearing on July 18, 2017 at 1:00
p.m., second floor Engineering Conference Room, City Hall, 73 Harlow Street, Bangor.
This Order would accept the City Engineer's Report for the discontinuance of a portion of Haskell Road. The
portion of road to be discontinued is not used as a Right-Of-Way, nor needed for public purposes.
This item was recommended for passage at the June 27, 2017 Infrastructure Committee

Be it Ordered by the City Council of the City of Bangor that,
Said portion of Haskell Road Right-Of-Way be discontinued as a public way, and removed from the Official
City Map in accordance with 23 M.R.S.A. § 3026-A, no easement shall be retained for public utilities.

DISCONTINUANCE OF A PORTION OF HASKELL ROAD
July 17, 2017
City of Bangor
To the City Council:
Pursuant to Council Order 17-240, passed on July 10, 2017 directing the City Engineer, John M.
Therlault to begin the process to discontinue a portion of Haskell Road in its entirety and in
accordance with 23 M.R.S.A. §3026-A, the City Engineer reports:
That of his intention to discontinue said portion of Haskell Road, the City Engineer gave written
notice to abutters:

Said notice with a detailed plan was also posted on the public bulletin board at City Hall and on
two utility poles in the vicinity of the proposed discontinuance.
In accordance with the notification given, the City Engineer conducted a public hearing on July
18, 2017 at 1:00p.m. relative to the intention of the Municipal Officers of the City of Bangor to
discontinue a portion of Haskell Road.
Interested attendees to the public hearing totaled zero.
The City Engineer concluded and made the following determinations:
1. The portion of Haskell Road, previously named Haskell Road Extension, was
accepted by the City on January 26, 2009 under Haskell Road Subdivision, Amended
Final Plan, recorded in the Penobscot Registry of Deeds Map File 2007-96 on July 3,
2007.

2. There is no longer any public Interest or need to retain the portion of Haskell Road
as a public Right-Of-Way.
3. The portion of Haskell Road to be discontinued is a twelve foot wide strip at a length
of approximately 512 feet long, located along the westerly side of the Right-Of-Way.
4. In accordance with 23 M.R.S.A. § 3026-A, abutting property owners are entitled to
$0.00 damages.
It is recommended that the portion of Haskell Road be discontinued and vacated in its entirety,
as depicted in "Exhibit A" and removed from the Official City Map, with the no retention of a
public easement for public utilities.
