At Its last meeting, the City Council amended the Personnel Rules and Regulations to provide for an
earned time -off benefit for non-union regular part-time employees. ThN policy establishes the various
rules and regulations necessary to Implement the new program. The concept of providing this benefit
was reviewed and approved by the Government Operators Commitee in January 2002 and necessary
funding was Included in the approved FY03 municipal budget. Approximately 60 employees will be
eligible to pardapate.
Manager's Comments:
The Govemmerlt Operations Committee reviewed the Policy at their July 10, 2002 meeting and
recommends approval to the City Council.

Earned Time -Off Polity
1.0 Pur�o�e. The purpose of this policy is to establish rules and regulations
for implementing and administering Earned Time -Off (ETO)
for non-unlon regular part-time employees.
2.0 Definition and Use.
2.1 Earned Time -Off is paid straight time off accumulated
by the employee based upon the actual number of straight
time hours worked in each calendar year quarter.
2.2 Earned Time -Off may be used for purposes such as,
but not limited to, vacation, sick time, holiday time or other
similar and acceptable paid time off uses.
3.0 ElialbIIIN. Employees eligible for Earned Time -Off shall he those who are
classified under Section 3.2.2 of the Personnel Rules and
Regulations, Regular Part -Time Employees (Non -Union)
4.0 Accumulation Schedule.
Eligible employees shall accumulate Earned Time -Off based
upon the following formula:

Hours worked shall mean all straight time hours (non -
overtime) actually performing work for the City, including any
ETO hours. Hours worked shall not include: any leave of
absence without pay, suspension without pay, time not
worked while receiving Workers Compensation benefits after
the first ten (10) weeks on such status, or when on any non-

pay status. Depending upon the actual number of hours
worked each calendar quarter, employees may accumulate
ETO at different rates throughout the year.
5.0 Accrual Schedule.
Earned Time -Off hours will be accrued and credited to eligible
employees at the end of each quarter based upon hours
worked through the last full pay period of the previous
calendar quarter. Accrued time will be credited to the
employee and will appear on the employee's paycheck stub on
or before the W of the month following the end of the
calendar quarter; i.e. October 15, January 15, April 15, July
15, as defined In the following chart:

6.1 Employees who wish to take Earned Tme-Off must
recelve approval from their Division Head/Department
Director. Employees may request advance EM pay at least
one week before the scheduled time off. The Department
Director's determination regarding the scheduling of ET) shall
be final.
6.2 Earned Time -Off not used during the quarter in which
it is earned may accumulate up to a maximum of six (6) work
weeks (240 or 225 hours).
6.3 After the maximum ETD accumulation limit has been
reached the employee shall forfeit any right to accumulate
additional leave until he/she has been charged for at least
part of the time so accumulated. it is the responsibility of
every employee to be aware of his/her accumulated leave. No

employee shall recelve payment In lieu of ETO other than at
separation from the City.
6.4 No employee will be allowed to take Earned Tlme-Off
which has not been earned as provided herein. No negative
ETO balances will be allowed.
6.5 Employees will be eligible to accrue and take Earned
Mme -Off as follows:
6.5.1 For employees hired and employed prior to July 1,
2002: after the completion of the first quarter ending
September 30, 2002.
6.5.2 For employees hired and employed on or after July 1,
2002: at the end of the next quarter following the
first ninety (90) days of employment.
Upon separation from service from the City, employees shall be paid for
any accumulated Eamad Time -Off as well as a pro -rated accumulated
amount based upon the hours worked in the quarter separation occurs, up
to a maximum of six (6) work weeks. All EM pay shall be at the
employee's current straight time hourly rate.
8.0 Department Director and Division Head Authority.
Department Directors and Division Heads are authorized to develop
internal selection and/or scheduling procedures, if necessary, to assist
with the implementation of this policy.
9.0 Responsible CIN Department.
The Human Resources Division shall be responsible for any interpretation
of or assistance with the implementation and administration of this policy.

The Earned Time -Off Policy shall become effective July 1, 2002 subject to
the Bangor City Council adopting a corresponding amendment to the Personnel
Rules and Regulations approving Earned Time -Off for regular non-union part-
time employees.
