ORDERED, THAT
The City Manager is hereby authorized W execute a month-to-month lease of eight units at
Park Woods to Acadia Healthcare for use as Program Based Shelter Plus Care. Said lease
shall be in a form to be approved by the City Solicitor or Assistant City Solicitor.

This Indenture of Lease, executed in duplicate, is made and entered into this 10 day of March,
2002, by and between:
CITY OF BANGOR a municipal corporation organittd and existing under the laws of the Sate of
Maine, and having its principal offices at A Harlow Shcef, Burger, Maine (heminmker"Lessor"),
and
ACADIA HEALTHCARE, a nonprofit corporation, organized and existing under the laws of the
Store of Maine, and having a place ofbusinces in Burger, County of Penobscot, Sate of Maine (hereinafter
••Lased').
WITNESSETH;
WHEREAS, the Lessor is the owner of land and buildings known as "Park Woods," heats! at the
nortlmdy comer of the intavetion of Union Sued and Griffin Road in the City of Burger, County of
Penobscot, and Stam of Maine
WHEREAS, Acadia Hospital Corporation entered into an Indenture of Lease with Lesseverdmed May
3, 2000 for the lease of eight units in Park Woods;
WHEREAS, Acadia Hospital Cooperation assigned its leasehold interest to Acadia Healthcare on
April 29,201;
WHEREAS the May 3, 2100 Indenture of Lease expired on January 31, 2002; and
WHEREAS, the parties hereto desire m continue the lege on a mouth -to -month basis;
NOW, THEREFORE, in consideration of the rents herein reserved and covenants contained herein,
the CITY OF BANGOR and ACADIA HEALTHCARE agree that the Indenture of Lege dated May 3,
2000 shell continue in full force ander t exceptas modified herein.
I. Article ll- Tern of Lease shall be deleted and replaced with the following:
Unless sooner terminated in accordance with Article XN, Lessee shall have and bold Ne within
demised premises on a month-to-month Ends, beginning February 1, 2002..
2. Article 111- Rent shall Ire delmed and replaced with the following;
Lessce shall pay rent to Lessor in the amount of $1,600.00 ($200.00 per unit) for the use and
occupancy of me demised premises.
Lessee shall pay all rents herein required by the first 0v) day of each month, without print demand
therefor, at the Banger Housing Authority, 161 Davis Read, Bangor, Maine, , 09401. A late charge of 4%
will be assessed on all rants not paid by the 15° of the renal month. Failure 0 pay such charges and late
fees when due shall cmisdtute u default under the terms of this lease. L r by assessing or receiving late

The City leases 8 residential units a Park Woods to Acadia for our Program Based
Shelter Plus Care. The two-year lease expired ort February 1, but Acadia would like to
continue the lease on a month-to-month basis. The terms of the lease would othervriss
remain the same, with the exception that the rent would unease fart $170 per unit to

Staff recommends that the Committee recommend the lease to the Council
