Responsible Department: Human Resources This Order would amend Me sections of the City's personnel Rules and Regulations to prohibit discrimination based upon sexual orientation. Effective lune 29, 2005, Maine's Human Rights Act will prohibit discrimination against any person in employment Musing, public accommodations, credit, and education on account of sexual orientation. The new State law defines sexual orientation as a person's actual or perceived heterosexuality, bisexuality, homosexuality or gentler identity or expression. As the Olys Personnel Rules and Regulations manual covers employment matters, it is recommended that sexual orientation be added to the current list of prohibited discriminatory areas which include race, color, religion, sex, national origin, marital status or disability. This action will make the City's personnel Manual consistent with State taw. ORDER, Amending Sections 2.3 and 4.1 of the City of Bangor Personnel Rules and Regulations, Non -Discrimination and Affirmal Action to Include Sexual Orientation BE R ORDERED BY THE CRY COUNCIL OF THE CRY OF BANGOR, THAT Section 2.3 and Section 4.1 of the.Personnel Rules and Regulations are hereby amended by adding sexual orientation as follows: 2.0 General Provisions 2.3 Non -Discrimination The City shall administer and implement these Rules and Regulations in a manner that shall not discriminate unlawfully against any person because of race, color, religion, sex, national origin, age, physical or mental disability or sexual orientat on. Furthermore, the City shall take affirmative action to enhance the opportunities for minority group members, where they may be underutilized. 4.0 Recruitment, Applications, and Selectlon 4.1 Non -Discrimination and Affirmative Action In the recruitment, appointment, training, promotion, retention, compensation, or any other personnel action, there shall be no discrimination against any person due to that person's race, religion, color, creed, sex, age, marital status, disability, sexual orientationor other discrimination in any manner prohibited by applicable laws, or in violation of the Citys Affirmative Action Program.
