Item/Subject Order, Amending 5 Ions 2.3 and 4.1 of the City's personnel Rules and
Regulations, Non -Discrimination and Affirmable Action, to include Sexual Orientation.
Responsible Department: Human Resources
This Order would amend Me sections of the City's personnel Rules and Regulations to prohibit
discrimination based upon sexual orientation. Effective lune 29, 2005, Maine's Human Rights Act
will prohibit discrimination against any person in employment Musing, public accommodations,
credit, and education on account of sexual orientation. The new State law defines sexual
orientation as a person's actual or perceived heterosexuality, bisexuality, homosexuality or
gentler identity or expression. As the Olys Personnel Rules and Regulations manual covers
employment matters, it is recommended that sexual orientation be added to the current list of
prohibited discriminatory areas which include race, color, religion, sex, national origin, marital
status or disability. This action will make the City's personnel Manual consistent with State taw.
