Commentary: This Order would permit the Parks and Recreation Department to hire Jesse Tyler as a
seasonal employee at the Union street Athletic Complex. Mr. Tyler is the son -In-law of a current full-time
Parks and Recreation employee (Mike Lucas). Mr. Lucas is scheduled to be absent from work for an
extended period of time this spring due to a health matter. Mc Luras c urinates the various activities at
the Unlon Street Complex, and a replacement will be needed. Mr. Tyler, who recently became Mr. Lucas'
can -in-law, has previously worked at the facility, Is capable of handling the responsibilities, and Is willing
to accept this position. The City's nepotism policy requires approval of the City Council prior to hiring a
relative into the same department where there is a currently related full-time employee. Due to the short
time before the Complex opens and Mr. Tyler's past experience, the Parks and Recreation Department
and Human Resources Division recommend approval of this request.

(TITLE.) Order, Waiving the Qty's Nepotism Policy far a Seasonal Employee of the parts and
Recreation Department
WHEREAS, Michael Lucas, a full-time Parks and Recreation Department employee
whose responsibili ies include coordinating activities at the Union Street
Athletic Complex, will be absent from work for an extended period of time
due to a health situation; and
WHEREAS, Jesse Tyler, who recently became Mr. Lucas' son-in-law, has previously
worked at the facility in a seasonal capacity, is familiar with its operations,
and is willing to work for the upcoming season; and
WHEREAS, the Parks and Recreation Department has determined that due to Mr.
Lucas' incapacitation, it is critical to have an individual who is familiar with
the Complex operations to handle the day to day responsibilities in his
absence; and
WHEREAS, the City's Nepotism Policy permits the City Council to authorize a waiver in
cases where a full-time employee and another relative are working in the
same department, in this case a father-in-law and son-in-law;
NOW, THEREFORE, BE IT ORDERED BY THE CITY COUNCIL OF THE CITY OF BANGOR,
THAT a waiver of the City's Nepotism Policy is hereby approved which will permit the
hiring of Jesse Tyler as a seasonal employee at the Union Street Athletic Complex. This
waiver shall be in effect for the 2005 season only.

1 am requesting that the Nepotism Policy in the City Personnel Rules
and Regulations be waived for the 2005 season due to unique circum
stances.
As you can see in the attached memorandum from Tracy Willetie,
Mike Lucas, our only full-time staff person at the Union Street Athletic
Complex will be out an extended Period of time due to a medical procedure.
Jesse Tyler, Mike's son-in4aw,has applied for a seasonal position at the
facility, and it is our recommendation that he be hired. Because Mike is a
full-time employee, a waiver of the Nepotism Policy Is required. -
We feel itis Important In order to maintain the continuity and quality
of the facility and the programs that an exception be granted for this year
only.
As explained in Tracy's memo, Jesse Tyler has worked at the facility
for four years and has the knowledge and ability to make the transition
seamless. Tracy and l will be in attendance at your March 29th meeting to
answer your questions:.

Hiring of Jesse Tyler

This memo is to review the hiring this season of Jesse Tyler. Jesse has worked
at the Union Street Complex for the past 4 seasons. He serves a vital role for us
there, as he has been essentially the assistant to Mike Lucas who serves as the
complex manager.
After we closed the Union Street Complex in the fall of 2003, Jesse worked at
Sawyer Arena for the 20032084 winter sports season and then returned to
Union Street Complex in the spring of 2004. During the same span, he married
Mke s daughter. After we closed me Union Street Complex in the fall of 2004,
Jesse did not return to work M Sawyer Arena, which created a separation with
the City. That makes him a new hire forthis coming season, which means we
need to adhere to the Nepotism Regulations of the City Personnel Manual.
One of the concerns for starting our upcoming spring season is the fad that our
complex manager, Mike Lucas, will be out on sick leave for a heart procedure
during what is typically a busy opening portion of our season. We were counting
on Jesse's experience to get this busy complex open property for the upcoming
season.
Therefore, I would ask that we pursue the possibility of hiring Jesse for the 2005
season so that we can openly properly and as smoothly as possible. Given the
extenuating circumstances, I think it is a hire worth making for this season. The
understanding will be that this hire will be for the 2005 season only.
In conclusion, Jesse has been a valuable employee for us at the Union Street
Complex and an individual we were counting on retuming for this season. I
would ask that we pursue this matter consistent with the City Personnel Manual.
