Use Regulations Governing Medical Facilities.

Commentary: The Government Operations Committee recently discussed a proposal to establish an
advisory committee to work W address the potential concerns and issues that might arise should a
proposed methadone clinic open in the Maine Square Mall. Doing the discussion, the Committee halt that
taking such a step was premature. Hovrever, the Committee did discuss the need for a comprehensive
review of the City's land use ordinances and regulators addressing medical facilities.
The City Is the home to numerous m s ical facilities that provide a wide range of services to our
community and region. Over the years, the nature of the services provided at these facilities has
changed due to market and regulatory forces. As a result, a different mix of services and uses is now
provided in a variety of medical settings.
The proposed committee would undertake a systematic review of the changing nature of medical facilities
and evaluate whether our existing regulations remaln appropriate. As proposed, the Committee would
consist of up M two members of the City Council, two representatives of businesses locatetl in close
proximity to an existing or planned medical facility, two representatives of the medical community, and
up to three ribbons with knowledge of or interest in comprehensive planning and land use regulation.
The members of the committee would be appointed by Me Council Chair after consultation with the
Government Operations Committee. The Committee would be In existence for approximately 3 months
and would be chargetl with repoNng Its recommendations back th Me Council on or before Me and of
March.

A draft of the proposed order has been provided to those members of the pry Council who were present
at the Government Operations Committee meeting where this Issue was discussed, and they were
requested to provide comments and suggestions. As a result, there is Me posslNliry, Mat some changes

(Tale.): Order, Establishing a Special Committee for the Purpose of Reviewing the
City's Land Use Regulations Governing Medical Facilities
WHEREAS, the City of Bangor Is home to numerous medal facilities that provide a
wide -range of services to our community; and
WHEREAS, the nature of the services provided at these facilities has been charging due
W market and regulatory forces, m Idrg in a new mix of services and uses
in traditional medial settings; and
WHEREAS, while the City modifies its land use ordinances in 2002 to recognIm the
growth In medial dims, this change was not based on a systematic review
of the changes which are occurring in all forms of medial dinics; and
WHEREAS, a systematic review of the charging nature of medial facilities and their
appropriate regulation is now in order.
NOW, THEREFORE, BE IT ORDERED BY THE CRY COUNCIL OF THE CRY OF BANGOR,
THAT:
In aanrda ce with the Code of the City of Bangor, Chapter 9, Section 9-9, a Special
Committee on Late Use Policy Governing Medial Facilites is hereby established as a
Special Committee of the City Council.
PURPOSE. The purpose of the Committee is to review the City's existing zoning and
land use regulations governing medial facilities in order th determine what changes, M
any, may be required due to the changing nature of such facilities and the nature of the
services that they provide. Based on this review, the Committee shall develop
recommendations for review by the City Council.
COMPOSMON. The Committee shall be composed of the following members:
• Up to two members of the Bangor City Council to be designated by the Council
Chair, one of whom to be designated by the Council Chair to Chair the Committee
• Two representatives of businesses located in close proximity to an existing or
planned medical facility
• Two representatives of the medical community
• Up to three dtizens with knowledge of or interest in comprehershie planning, land
use regulation
The remaining members of the Committee shall be appointed by the Council Chair after
consultation with the members of the Government Operations Committee.
In addition, the Committee may, with the concurrence of the Council Chair, designate
other individuals to become members of the Committee as the Committee may feel
necessary or appropriate. While recognizing that the best Informed and most
expedwced individuals should serve of this Committee, where possible and appropriate
the Council Chair shall give preference to residents of the City of Bangor when making
appointments.
TERM OF EXISTENCE. The committee shall remain in existiance for an inial term of
three months, ending March 31, 2005. At that time, the Committee shall determine
whether a need remains for Its conned eAstence and shall make a recommendation
as to Its continued existence to the Bangor City Council.
STAFF SUPPORT. Staff support for this Committee shall be provided by the Planning
Department with assistance, as necessary, from Engineering and Community and
Economic Development.
REPORTS. The Committee shall submit a final report and recommendations to the City
Council on or before March 31, 2005. The Committee is authorized to make such
interim reports and recommendations as R shall see fit.
