Ordinance, Amending Land Development Code-Cormact Zone Change - 251 Union Sheet and 7, 8, 12, 14 and 16 Union Mace from Urban Residence Two District to Contract Multi -family and SeMce District THAT the zoning boundary lines as established by the Zoning Map of the City of Bangor dated October 28, 1991, as amended, be hereby further amended as follows: By changing six parcels of land located at 251 Union Street, and 7, 81 120 14, and 16 Union Place (Tax Map No. 33, Parcel Nos. 38, 39, 40, 41, 42, and 40A) from Urban Residence Two District to Contract Mule-Famlly and Service District. Said parcels containing approximately .832 acres and being more particularly indicated on the map attached hereto and made a part hereof. PROVIDED, HOWEVER THAT, in addition to the mandatary conditions imposed by Chapter 165-7 of the Ordinances of the City of Bangor, said change of zone is granted subject to the following conditions: 1. The use and/or operation of the subject premises shall be subject to the following limitations and/ar resthcdons: A. The properly shall only be used for permitted uses in the Multi -family and Service District. B. The development density shall not exceed 6 units per building. C. The development density shall not exceed 16 units per acre. 2. Execution by those parties with an Interest in the affected property of an agreement providing for the Implementation and enforcement of all the terns and conditions set forth above and the recording of mid exea[ed agreement In the Penobscot County Registry of Deeds by the property owner, a copy of sold agreement being on file In the office of the Qty Clerk and incorporated herein by reference. In the event that mid agreement Is not so execuKN within ninety (90) days from the date of passage hereof, this Ordinance shall become null and void. The property shall only be used for permitted uses in the Multi -family and service District. 2. The development density shall not exceed 6 units per building. 3. Gould, Planning Officer SUBJECT: Amending Zoning Ordinance Union Place Council Ordinance 06-246 Please be advised that the Planning Board at Its regularly scheduled meeting on July 5, 2006, held a public hearing on the above contract zone request. The Planning Office provided the Planning Board with a brief history of the City's involvement with these properties and the current redevelopment proposal. No one spoke in support of, or in opposition to, the proposed rezoning request. Given the rezoning request's consistency with the proposed land use in the Comprehensive Plan and its compatibility with adjacent residential properties the Planning Board voted unanimously to recommend approval of the proposed contract zone change to the City Council
