Responsible Department: Frame Commenbry: The City's Tax Collector, David little, In conjunction with Dan Wellington, the Code Enforcement ORcer, have recommended that the City take possession of 183 Center Street by means of matured tax liens. The property s being assessed to Inch Inc., a suspended corporation with the State of Maine. The We officer of Me corporation Is Mr. Herbert Reed. Mr. Reed has consistently expressed his desire m retain the property but has been unable to pay the taxes. There are eight years of outstanding real estate taxes totaling $12,710.64. There are also eight years of outstanding personal property taxes, assessed directly M Mr. Reed, totaling $268.80 for a total tax due of $12,979.49. There is also a balance of $508.61 in outstanding sewer charges. The building has numerous code oblations that were identified by the Code Enforcement Office and presented M Mr. Reed and his attorney, Edward Russell, in September of 2004. At Mat time, Mr. Reed was advised that the Qty needed some proposal that would address bath the code violations and the taxes. Since It appears Mat no repair work has been done m the building since then, Me Tax Collector faxed a letter to Mr. Russell stating Mat the City needed a proposal from Mr. Reed. lacking such a proposal, he noted out intention to present a recommendation to Me Council M take possession of the building. To date, no proposal has been me&; therefore, we would ask that the Councll take possession of the property and direct City staff dispose of We property in the beg interest of the City. Department Head Manager's Comments: This was discussed at the last Finance Committee meeting. Mr. Reed and Mr. Russell were ambdi to that meeting but did not attend. Per Article EI, Nonconforruifid, of the Land Development Code, which regulates these nonconforming uses, the commercial use of this property was lost in 1998 (12 months following the closing of the bar.) Additionally, an efficiency apartment located on the second Floor appears to continue to be occupied. The use of "a property as a residential unit continues and would be allowed to continue as long as the use of the unit does not lapse for 12 consecutive months.
