Commentary:
John H. Sites, CEO and Founder of Somerset Development Company, Bel Alton, Maryland, is seeding
tentative developer status on the City owned development parcel at the corner of Railroad and Summer
Streets for the purpose of developlrg residential condominiums. Mr. Sites is originally from Somerset
County, Maine. Mr. Sites and Somerset Homes have over 30 years experience in housing construction
and development and have bulk over 1,000 homes In Maryland, Virginia, and West Virginia. This Order
would grant Mr. Sites exclusive stabs as developer of the Rellmad/Summer Street site until May 30,
2007. Until than, the City would deal exclusively with Mr. Sites for development of the site. During this
period, Mr. Sites would have the opportunity to submit for Council cormderadon a more specific proposal
far his development sufficient in detail to outline the general scope of development and moves, to the City
adequate Information to determine the level of imesonem proposed and character of the work to be
performed. Staff would aim be authorized to ne icAlate a Development Agreement with Mr. She; for the
City Council's consideration on or before May 30, 2007 setting forth the proposed terms and conditions
under which the proposed development would be allowed to move forward.

WHEREAS, John H. Sites, CEO and Founder of Somerset Homes Development Compaiy of Bel
Alton, Maryland, is Interested in developing residential wndominiums on a City
owned development parcel located attire comer of Railroad and Summer Streets
design rted for residential use In the Bangor Waterfront Master Plan; and
WHEREAS, John Ates has requested that he be designated as Rasta me developee of this dies
in order to allow time to prepare a definitive development proposal and for City
MIT to negotiate a proposed Development Agreement for consideration by the Ctry
Coundl; and
WHEREAS, the City has granted "tentative developer" status to potential developers on various
City owned development sites in Me past, thereby providing the developer time to
prepare a specific development proposal for the City CoundlS consideration and
during which time the Ory agrees to deal exclustiely with the designated tentative
developer for the purpose for which tentative developer status was granted;
NOW, THEREFORE, BE IT ORDERED By THE C1W COUNCIL OF THE CIT/ OF BANWR THAT
Jahn Sites is hereby designated Me tentative developer of the City owned approximate one
acre development site on the comer of Railroad Street antl Summer Street in Bangor and that
such designation is in affect until May 30, 2007.
BE IT H)RTHER ORDERED THAT:
1. During the period of designation, the City agrees M deal exclusively with Mr. Sates for
the purpose for which tentative developer status was granted.
2. Mr. Sties shall have until May 16, 2007 M prepare and submit In writing to the City's
Director of Community and Economic Development a definitive proposal for
developrirent of residential condominiums on the site for review by the Business and
Economic Development Committee of the City Coundl no later than May 23, 2007. The
Proposal submitted for the Chys consideration shall be sufficient: in detail M outline the
scope and quality of development and convey sufficient Information for the City to
calamine the level of imiestment proposed and character of the work W be performed.
The proposal is to include a preliminary site plan shoving:
(a) the footprint of the propoud building and she Improvements in relationship to
boundaries and topography of the site and sunountling Improvements, and
showing parking layout and proposed entrances and eats to the site;
(b) suitable crosrsections and elevations of the proposed building and
improvements showing the relationship of floors to surrounding grades and

Indicating the number of states of the building proposed and exterior building
materials proposed W be used W enable the City to determine the compatibility
of proposed building and improvements to the development site and Waterfront
Development Plan; and
(c) prelimiiwry floor plans showing the number of proposed residentlal
m dominium units and general unit layouts, Including proposed building
entrances and exits and overall floor area for each floor.
3. City staff Is authorized W negotiate a Development Agreement with Mr. Sites for the
Business and Economic DevelopmaH Committee's mrWderation on or before May 23,
2007 and for the CN Couricil3 consideration on or before May 30, 2007 sending forth
the proposed [arms and conditions under which the proposed development would be
allmved to move forward. The Development Agreement, 0 approved by the City
C ndl, would ensure that the development would conform to building plans, site plans
and uses approved by the Business and Economic Developmont Committee, and that
Mr. Sites demonstrates that he has the ffnanOal capacity and ability W carry out the
development as approved.
