Item/Subject Order, Authorizing the City Manager to Execute a Deed to the Maine
Governmental Facilities Authority- Washington and Exchange Streets

On September 29, 2006, the City of Bangor and the Maine Governmental Facilities Authority
entered Into an Option Agreement for the development of a parcel of land on Exchange Street
for the construction of a new courthouse. The land was subsequently conveyed. The Maine
Governmental Facilities Authority Is now requesting that the City newsy an abutting parcel of
land for possible future expansion of the new courthouse.
There are utilities on the land requested and part of the land may also be needed for an
expansion of Washington Street. This order will authorize execution of the deed with language
retaining easements for current and future utilities and streat widening.

WHEREAS, on September 29, 2006, the City of Bangor and the Maine Governmental Facilities
Authority entered into an Option Agreement for the development of a parcel of land
on Exchange Street for the construction of a new courthouse; and
WHEREAS, the Oty has conveyed said parcel to the Maine Governmental Facilities Authority,
and construction of the courthouse has begun; and
WHEREAS, the Maine Governmental Facilities Authority is requesting that one City convey an
abutting parcel of land for possible future expansion of the new courthouse;
NOW, THEREFORE, BE IT ORDERED BY THE CITY COUNCIL OF THE CDY OF BANGOR TNAT
the City Manager, Edward A. Barrett, is authorized, on behalf of Me Clty of Bangor, W execute
a deed W the Maine Governmental Facilities Authority, a descdpbon of said land attached
hereto as Exhibit A, at no dust M the Maine Governmental Facilities Authority. Said deed shall
provide Mat the land shall remain as open space and that the City may have future easements
for utilities or for the expansion of the Washington Street if either Is needed at no cost to the
City. The final form of one deed shall be as approved by the City Solicitor or Assistant City
Solicitor.

NOW, THEREFORE, BE rr ORDERED BY THE Q COUNCIL OF THE CITY OF BANGOR THAT
the Qty Manager, Edward A. Barrett, is authorized, on behalf of the City of Bangor, to execute
a deed to the Maine Governmental facilities Authority, a description of said land attached
hereto as Exhibit A. Said deed shalFretam easements for the expansion of the Washington
Street right of way and utilities, as the same may now exist and later become necessary, the
exact location of which Is to be determined by the City Engineer of the Qty of Bangor, The
final form of the deed shall be as approved by the Qry Solicitor or Assistant city Solicitor.

BANGOR, MAINE
A certain lot or parcel of land located on the northerly side of Washington Street in the City a
Bangor, County of Penobsm[, State of Maine and being more particularly describeL as follows:
Beginning at the southwesterly corner of a parcel of land described in a deed from the qty of
Bangor to the Maine Governmental Facilities Authority, dated May 24, 2007 and recorded at the
Penobscot County Registry of Deeds in Volume 10961, Page 344',
Thence N 720 W 31" E by and along the southerly line of the aforementioned parcel, a
distance of 128 feet more or las, to a point defined by the intersection of said line with the
northwesterly line of land now of the State of Maine as described in a Notice of Layout and
Taking, dated August 21, 1995 and recorded at the Penobscot County Registry of Deeds in
Volume 5943, Page 2;
Thence running in a southwesterly direction by and along the northwesterly line of the parcel
described in the aforementioned deed, said line Is also shown on a plan entitled "State of Maine
Department of Transportation Right of Way Map of State Highway "43" in Bangor, Penobscot
County, Maine - D.O.T. File No. 10-354, Sheet 1 of 10", a distance of 26 fee4 more or less, to
angle point in the northwesterly sideline of said Washington Street as shown on the
aforementioned plan;
Theme running In southwesterly direction by and along the northwesterly sideline of said
Washington street as shown on the aforementioned plan, a distance of 115 feet, more or less,
to a point defined by the intersection of Bald sideline with a line that bears 5190 05' 54" E from
the point of beginning;
Thence N 190 05'54" W, a distance of 35 feet, more or less, W the point of beginning.
The above described lot or parcel of land contains 3,450 square feet, more or less.
Bearings referenced herein are oriented to Gid Nath of the Maine State Coordinate System
(East Zone), said coordinate system is based on the North Amencan Datum of 1927 (NAD 27).
