This 3,000 a0. ft. area wasoriginally part of Enfleld Street which was discontinued and subsepuentlycanveyed to the abuttirciproperty. However, the zoning designation remained Park and Open Space District. The current owners property Is zoned Urban Residence One District and this zone charge would allow for nradelmal use of this area. Gould, Planning Officer SUBJECT: Amending Zoning Ordinance 146 Howard Street Council Ordinance 08-029 Please be advised that the Planning Board at its regularly scheduled meeting on December 4, 2007, held a Public Hearing on the above zone change request. David Gould, Planning Officer, indicated the proposed rezoning was the result of the Cdys abandonment at Enfield Street, a paper street that was parallel to Howard Street. When a street is discontinued the right-of-way is spilt in half and each abutting property owner gets half of the vacated land. The zoning lines on each side of the street are extended to the middle of the former right -of -Way. In this instance the property owner at 146 Howard Street requested that they obtain the entire land vacated adjacent to their property not just half the right-of-way. The property was conveyed but the 25 -foot pordw of the property carried with it the Park and Open Space Zoning District. Changing the entire properly to Urban Residence 1 District (URD - 1) would allow the owners full use of their property and would provide uniform zoning of the entire parcel. The Planning Officer indicated this was a very small 3,000 square foot area and viewed it as little more than a zoning boundary adjustment, Mr. Michael Alley of 146 Howard Street indicated that this Issue was discovered when they sought a permit W relocate a garden shed in the rear portion of their lot and were unaware of the Park & Open Space zoning. There were no other proponents or opponents.
