SUBJECT: Amending Zoning Ordinance
Washington and Exchange Street
Council Ordinance 07-269
Please be advised that the Planning Board at its meeting on August 28, 2007,
held a Public Hearing on the above zone change request.
Planning Officer David Gould indicated the proposed rezoning was intended to
help facilitate the development of"B-13" for the State's court project. The land
Development Cade requires a transition yard between a Downtown Development
District (DDD) and a Government and Institutional Service District (G&LSD). The present
arrangement of the site, the plaza area (Permit Parking) is G&SSD and the development
site B-13, also used as parking is DDD. The court's proposed parking area at the rear of
the site, as zoned, requires a transitional buffer yard and would result in a significant
lass of useable parking space to create a buffer between the two zoning districts.
Changing the existing plan parking to DDD will no longer require a transitional buffer.
Mr. Gould noted that the City's Comprehensive Plan, Land Use and Zoning Policy
called for a narrow green ship along the Kenduskeag Stream followed by commercial
zoning (Downtown Development District). The change to DDD for the plaza parking
area would not have any significant implications of the site as it is not anticipated to
change from its current use.
The Board discussed the Comprehensive Plan for the area the other properties
that abut the plaza area and voted four in favor and none opposed to recommend the
adoption of the proposed zone change request to the Council as indicated in Council
Ordinance 07-269.
