Be d ordaixdby the City ofBangor, as fd/oxs: THAT the mining boundary lines as established by the Zoning Map of the City of Bar(Jor dated October 28, 1991, as amended, be hereby further amended as follows: By changing parcels of land located at 125 Ferri Street and 166 Pearl Street (Tax Map Mo. 53, Parcel No. 161, Parcel No. I61A, and Parcel No. 153) from Urban Residence One District to Contract Multi -Family, and Service District, said parcels containing approximately 50,105 square feet and being more particularly indicated on the map attached hereto and made a part hereof. PROVIDED, HOWEVER, THAT in addition to the mandatory conditions imposed by Chapter 165-7 of the Ordinances of the City of Bangor, old change of zone is granted subject to the following conditions: 1. The use and/or operation of the subject premises shall be subject to the following limitations and/or restrictions: A. The current brick structure will be converted Into 14 apartments; and there will be one additional new unit Total residential units will therefore not exceed fifteen. B. Project lot coverage will not exceed 30%. C. Open space per unit will exceed 500 square feet with space for a community garden 2. Execution by those parties with an interest in the affected property of an agreement providing for the implementation and enforcement of all the terms and conditions set forth above and the recording of said executed agreement In the Penobscot County Registry of Deeds by the property owner, a copy of old agreement being on file in the office of the City Clerk and incorporated herein by reference. In the event that said agreement is not so executed within ninety (90) days from the date of passage hereof, this Ordinance shall became null and void. Gould, Planning Officer SUBJECT: Amending Zoning Ordinance Fern and Pearl Streets Council Ordinance 07-267 Please be advised that the Planning Board at its meeting on August 28, 2007, held a Public Hearing on the above contract zone change request. Robert Kelly, of Bangor Steam Laundry, provided the Board with the history of the laundry building built on Fern Street after the fire of 1911. At the time, the Fern Street location was beyond the developed urban portion of the City. Mr. Kelly noted that it was the plan to renovate the building to create 15 condominium units. The intent is to utilize "green building" standards and provide garage space for each of the units. The two story building would include an elevator to the second floor. One older three unit building will be demolished. Chris Olean of 126 Fern Street Indicated this was a good reuse of the building. While he had concerns about parking and traffic related to the number of units, in talking with the applicant he was encouraged they had a good plan. Brian Nadeau, 153 Pearl Street, pointed out Peal Street is a narrow one-way street that can not accommodate a lot more traffic. Most of the traffic should be directed to Fern Street. Mr. Nadeau indicated he did not want to see an affordable housing project at this location, but was comfortable with the plans for the condominium proposal as presented. Planning Officer David Gould indicated that the proposed rezoning was intended to help facilitate the redevelopment of the old laundry building. Mr. Gould noted that the Cys Comprehensive Plan, land Use and Zoning Policy called for this neighborhood to be low density residential. Since 1991, the City has made a concerted effort to maintain single-family dwellings and discontinue the conversion of single-family dwellings into multi -unit apartment buildings in the core of the City. The issue before the Planning Board and the City Is the appropriate reuse of the old laundry building. The contract zoning provisions allow us to set density standards that will not overwhelm the neighborhood, but will make economic sense for redevelopment to take place. With a maximum of 15 units on the property the density is equivalent to that of URD -2. Similar projects In the past done through the "Step- down" process, while were contentious in the review process, have proven to be non - detrimental to the single-family neighborhoods where they are located. Mr. Gould did note that the rezoning is bound by the contract conditions in place and the zoning would remain with the property. There may be a different owner or developer and some of the original concepts may change, but the approved restrictions will remain in place. The Board voted four in favor and none opposed to recommend the adoption of the proposed contract zone change request to the Council as indicated in Council Ordinance 07-267.
