Authorizing an Indenture of Lease between the Oty of Bangor and Stillwater Enterprises, Inc Responsible Department: Community St Economic Development This Order would authorize the lease of Building # 269 at 66 Florida Avenue to Stillwater En[erpdses, Inc. lo operate a custom metal fabrication business. Stillwater Enterprises, Inc. is currently a tenant In the Bangor International Enterprise Center and has outgrown its space. Building #269 has many features that readily accommodate the use proposed by Stillwater Enterprises which include manufacturing special orders for general contractors and archRects from sheet, solid, or tubular stack metal. Stillwater currently employs 6 people and pays sidletl labor rates. Moving to Building #269 would allow them to hire additional employees and Increase their production. Building #269 provides approximately 7,188 M. ft. of building space. The initial term of the lease would be three (3) years with two (2) options to mend the agreement for additional three (3) year teems. Stillwater Enterprises, Inc. will pay the cost of all utilities. The lease rate will be $1,500.00 par month during the initial three year term. Stillwater Enterprises, Inc. will receive a credit to be applied against lease payments for the mat of installation of the electrical system to the building, including the installa on of a new 3 phase, 400 amp main decide service entrance panel, an electric subpanel In the production area and equipment wiring. ORDER, Authorizing an Indenture of Lease between the City of Bangor and Stillwater Enterprises, Inc. WHEREAS, the City Of Bangor is the owner of Building #269, fib Florida Avenue In the Bangor International Airport Complex; and WHEREAS, Stillwater Enterpnses, Inc, has been a tenant in the Bangor International Enterprise Center; and WHEREAS, Stillwater Enterprises, Inc. wishes to lease Building #269, 66 Honda Avenue to operate and maintain a custom metal fabrication business; and WHEREAS, Stillwater Enterprises, Inc.'s lease of Building #269, IS Florida Avenue will assist in the growth of the business and provide new employment opportunities for area residents; BE IT ORDERED BY THE CM COUNCIL OF THE CITY OF BANGOR THAT The City Manager is hereby authorized to execute, on behalf of the City of Bangor, an Indenture of Lease between the City of Bangor and Stillwater Enterprises, Inc., under substantially the following terms and conditions, and in a form approved by the City Solicdor or Assistant City Solicitor. PremNes: Building #269, approximately 7,188 sq. R., located at 66 Florida Ave., and approximately 1.5 acres of land suraunding the building Tetm: Three years, from 2007 to 2010. Stillwater Enterprtses, Inc. will have two (2) options to ndend the agreement for an additional three year term. Rate: $1,500.00 per month during the Initial three year term. Stillwater Enterprlse i, Inc. will receive a credit to be applied against lease payments for the cost of installation of the electrical system to the building. Utilities: Stillwater Enterprises, Inc. Will pay the cost Of all utilities furnished to or consumed on the premises, including electricity, fund oil, gas, and water and sewer user fees. Itaintenanos: The City of Banger will be responsible for ordinary and routine maintenance of the building's major structural components: foundation, roof, structural walls, operating 07 236 systems, Including heading, plumbing, and electrical systems Including electrical, plumbing and heating fixtures. The City of Bangor will also provide grounds landscaping and maintenance of the parking area. Stillwater Enterprises, Inc. will be responsible for foor and floor coverings, doors, windows, ceilings, interior walls, and other Interior paint surfaces in the demised premises. Stillwater Enterprises, Inc, will also provide rubbish removal and snowplowing. Taxes: Any taxes Imposed upon the real estate and building are the responsibility of the City of Bangor. Any taxes on personal property are the responsibility of Stillwater Enterprises, Ix. Insurance: Stillwater Enterprises, Inc. will provide comprehensive public liability and property damage insurance to limits of $400,000 per each ammonite and Bre damage Insurance to the limit of $200,000. Insurance coverage far Stillwater Enterprises, Inc.'s equipment and personal property are the responsibility of Stillwater Enterprises, Inc. Improvements By Tenant: Stillwater Enterprises, Inc. will make the following repairs and Improvements to the premises: 1. Paint three (3) office 2. Replace the suspended ceiling in three (3) offices 3. Remove miscellaneous furniture from offices 4. Install exterior security lights if an exterior storage area is constructed! 5. Install a new 3 phase, 400 amp main electric service entrance panel 6. Install an electric sub -panel in the production area 7. Install wiring to the columns in the main production area. Improvements By larval The City of Bangor will make the following repairs and improvements m the premises: 1. Repair roof, particularly the south and that has been tom off 2. Replace several broken window panes 3. Service and repair the overhead doors to an operating condition 4. Repair and test the overthad aares doors to an operating condition and have their lift: opacity certified S. Repair ovethotl ceiling fans to an operating condition 6. Test the plumbing system and plumb the hot water heater 7. Use its best efforts to install a gravel drive and a 7,500 sq.
