The proposed amendment makes changes to the existing Bass Park District (BPD) that will facilitate
the proposed arena and convention center with design guidelines that mimic the Flexibility of the
Waterfront and Downtown Districts. Specific standards that are proposed for the Bass Park District
include changing the height restrictions from 80 to 100 ft. and establishing a zero setback. These
provisions are similar to that of the Downtown and Waterfront districts, Including the neighboring
Hollywood Sims property Additionally, The amendment provides a two part parking change, one
which leaves the provision of specific number of spaces in the hands if the Bass Park Management
and two includes the design standards for parking lots applied elsewhere in the Land Development

CITY OF BANGOR
(TITLE.) Ordinance, Amending Chapter 165, Land Development Code, of the Code of the City of
Bangor, By Revising provisions Regarding the Bass Parc District
WHEREAS, the Bass Park District was originally intended to serve the land associated with the Bass
Park Complex and the various uses thereon; and
WHEREAS, as the site of the City's auditorium and potential future site of an arena, and given its
location within the City, the Bass Park District should resemble the Downtown Development District in
some respects and larger service districts in other respects;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BANGOR THAT,
The Code of the City of Bangor be amended as follows:
§ 165-8. Districts established) Zoning Map.
A. Districts.
(1) For the purposes of thus chapter, the City of Bangor is hereby divided into B 21 districts W be
designated as follows:
(h) Bass Park DlstriRPD .
§ 165-62. Visual clearance on comer lots
On a comer lot in any district, accept the Downtown Development District, WaterfrontDevelooment
Ulgrri and Bass Park Dlstrlctin order to provide adequate vehicular visual clearance, no building or
structure may be erected and no vegetation other than shade trees may be placed, grown or
maintained between the heights of 21/2 feet and 10 feet above the curb level, or its equivalent. within
the triangular space formed by two intersecting street lines or their projections and a line joining points
on such sheet lines located a minimum of 20 feet from the point of inta niction of street lot lines.
§ 165-66. Zoning district boundaries.
Where the side or rear lot line of a lot in Neighborhood Service DisMct (NSD), Urban Service D'cstrct
(USD), Airport Development District (ADD), Urban Industry District (UID), Government and
Institutional Service DishiM (G & ISD), Shopping and Personal Service District (S & PS), General
Commercial and Service District (GC Is 5)), Oran Industry and Service Distinct (I & S), Technology &
Service District (T & S) or Bass Park District fBPDI abuts any residential district, a -Resource Protection
District (RP) or a-Padc and Open Space District (P & O), a transitional yard will be established in
accordance with the tlaorld de elopment standards, and any applicable side of rear yard building
setback shall be increased by 20 feet, and at least a Buffer Yard B (as defined in Article XIX, § 165-
135D) will be established. Any applicable side or rear parking setback shall be governed by §§ 165-
]31)(1).
§ 165-72. Required number of spaces.
A minimum number of off-street parking spaces shall be provided! and mainowmax! by the owner of
every building or property hereafter erected, altered or changed in use, in accordance win the
following requirements:

requirements of this section except Subsection S.

§ 165-73. Parking area location and screening.
The location of off-street parking shall comply with the following requirements

D. Screening of parking. All parking lots containing five or more parking spaces, outdoor display areas,
outdoor storage areas and all outdoor off -sleet loading areas shall be screened in accordance with
the following requirements:

have a B Buffer Yard along the street right-of-way boundary, except parking and loo In
areas in DDD, WDD, URD -2, M & SD, USD, BPD and NSD with less than 50 spaces shall have

a railroad.
g 165-135. Application and explanation of standards.

Please be advised that the Planning Board at its meeting on April 5, 2011, held a
Public Hearing on the above zone change request.
James Ring, PE former City Engineer indicated to the Board the proposal was to
rezone the land surrounding Bass Park into a Bass Park Zoning District that was created
in 2004, but not put into place until this proposal. Mr. Ring noted that the district
would facilitate the development of a new arena and civic center should the voters
approve them.
There were no other proponents or opponents.
Planning Officer David Gould indicated in order to provide for the anticipated
redevelopment of the Bangor Auditorium and Civic Center the 67 acres that presently
are occupied by the Auditorium, race back grandstands and agricultural buildings are
proposed to be rezoned into a single zone Bass Park District. Presently, the Auditorium
is in a Government and Institutional Zone and race track, grandstands parking lot are in
a Park & Open space District. A small portion of the site including the northerly
driveway exiting to Buck Street near Bond Road is presently zoned Urban Residence 1
District This presumably was done to attempt to create a land use buffer between the
homes on Bond Road and the racincing activity and horse hams at the adjacent track.
The rezoning would leave a portion of the land adjacent to Bond Road in URD -1 but
would include the northern drive in the Bass Park District,
Julie Williams asked if the Municipal Golf Course would remain in Park and Open
space. Mr. Gould indicated R would.
The Board voted six in favor and none Opposed to recommend the City Council
adopt rezoning 67 acres from Government and Institutional Service District, Park and
Open Space District and Urban Residence 1 District to Bass Park District as contained in
C. 0. u 11-099.
