HomeMy WebLinkAbout2011-12-28 12-049 ORDERCOUNCIL ACTION Item No. 12 049 Date: December 28, 2011 Item/Subject: Order, Authorizing Extension of Tentative Developer Status with Bond Properties, LLC for Front Street Development Parcel 3 Responsible Department: Community and Economic Development Commentary: On September 26, 2011 by Council Order 11-297 Bond Properties, LLC was granted tentative developer status for the development of a parcel of land on Front Street at the downriver end of the bulkhead (Lot #3 on attached map). They have proposed a restaurant and banquet facility, possibly as large as 10,000 square feet, which would be a second location for the Fish House Grill of Bar Harbor, specializing in fish and shellfish. The restaurant would include a large bar, oyster bar, and could have an ice cream and take-out window. City staff has been working with the developers but because of the time required of them in their business finishing the peak season, they need more time to finalize their plans and address the site development issues, as this is a challenging site to build on. Therefore, they are seeking an extension of tentative developer status for 90 days, until March 30, 2012. This was approved by the Business and Economic Development Committee on December 21, 2011. Staff recommends that tentative developer status be extended for Bond Properties, LLC for Front Street Development Parcel 3, until March 30, 2012. If approved, City staff will continue to negotiate exclusively with Bond Properties, LLC for development of the site. The development agreement will include specific terms and conditions for the Council's consideration. The development agreement, if approved by the City Council, would ensure that the development would conform to building plans and uses approved by the Business & Economic Development Committee and that Bond Properties, LLC has the financial capacity and ability to carry out the development. Order, Authorizing Extension of Tentative Developer Status with Bond Properties, LLC for Front Street Development Parcel 3 WHEREAS, Bond Properties, LLC has proposed to develop a commercial building on the City owned development parcel located on Front Street at the downriver end of the bulkhead designated as Parcel 3; and WHEREAS, Bond Properties, LLC has been awarded "tentative developer" status on September 26, 2011 by Council Order 11-297; and WHEREAS, the City has been working with Bond Properties, LLC on the plans for their development project; and WHEREAS, the developers have requested an extension of time to finalize their plans and address the site development issues; BE IT ORDERED BY THE CITY COUNCIL OF THE CITY OF BANGOR THAT Bond Properties, LLC is hereby designated the tentative developer of the City owned development site on Front Street at the downriver end of the bulkhead designated as Parcel 3, and that such designation is in effect until March 30, 2012. Bond Properties, LLC shall have until that time to prepare and submit in writing to the City's Director of Community and Economic Development a definitive proposal for development of the site. During the period of designation, the City agrees to deal exclusively with Bond Properties, LLC for the purpose for which tentative developer status was granted, and City staff is authorized to negotiate a development agreement with Bond Properties, LLC for the City Council's consideration setting forth the proposed terms and conditions under which the proposed development would be allowed to move forward. The development agreement, if approved by the City Council, would ensure that the development would conform to building plans and uses approved by the Business and Economic Development Committee and that Bond Properties, LLC demonstrates that they have the financial capacity and ability to carry out the development proposed before receiving the approvals needed from the City to proceed. The proposal submitted for the City's consideration shall be sufficient in detail to outline the scope and quality of development and convey sufficient information for the City to determine the level of investment proposed and character of the work to be performed. The proposal is to include a preliminary site plan showing the footprint of the proposed building and site improvements in relationship to the site and surrounding improvements; suitable cross-sections and elevations of the proposed building and improvements showing the relationship of floors to surrounding grades and indicating the 12 049 number of stories and exterior building materials proposed to be used to enable the City to determine the compatibility of the proposed building and improvements to the development site and Waterfront Development Plan; and preliminary floor plans showing proposed general room layouts and proposed use, including entrances and exits and overall floor area for each floor. The proposal should also provide information on the "tentative developer's" past development experience and provide separately such financial information as may be requested to provide assurance to the City that the "tentative developer" has the ability and financial capacity to carry out the development. The City will treat any information provided relating to the tentative developer's personal or business financial assets confidentially as allowed by State Statute.
