Commentary:
This ordinance would amend the Land Development Code to allow up to four food vendors to
locate on a single lot in certain zoning districts including most industrial and commercial lots.
Several parties have expressed interest in serving food from food carts in the K -Mart parking lot.
Currently, the Code allows only one such vendor is allowed on a single lot, except in the
Waterfront Development District, where four vendors are allowed per lot. Five parking spaces
would be required per vendor. The Downtown Development District and Industry and Service
District would still be limited to one vendor per lot, and the Waterfront Development District
requirements would also remain unchanged.
This Ordinance was reviewed by the Business and Economic Development Committee on May 6,
2014.

ORDINANCE, Amending Chapter 165, Land Development Code, of the Code of the City of Bangor,
By Allowing Additional Itinerant Commercial Vendors
WHEREAS, several itinerant commercial vendors have expressed interest in locating on the same lot;
BE Ir ORDAINED BY THE CITY COUNCIL OF THE CITY OF BANGOR AS FOLLOWS, THAT
Chapter 165 of the Code of the City of Bangor be amended as follows:
§ 165-31. Temporary sales of food or merchandise.
C. Temporary sales of food or merchandise shall only be permitted in the following districts: Urban
Service District, Shopping and Personal Service District, General Commercial and Service District,
Downtown Development District, Waterfront Development District, Urban Industry District and
Industry and Service District.

D. Temporary sales of food or merchandise shall be further limited as follows:
U In the Downtown Development District and Industry and Service District no more than one
itinerant commercial vendor may be permitted per lot.
In the Shopping and Personal Service District General Commercial Service District Urban
Service District and Urban Industry District no more than four itinerant commercial vendors
may be permitted Rer lot. Each vendor must provide access to five parking spaces in excess of
those required -by any other use or uses on that lot.
In the Waterfront Development District no more than four itinerant commercial vendors may
be permitted per lot. No more than 10 commercial vendors total shall be permitted in the entire
Waterfront Development District.

SUBJECT: Amending Chapter 165, Land Development Code, of the
Code of the City .of Bangor, By Allowing Additional
Itinerant Commercial Vendors
Council Ordinance 14-170
Please be advised that the Planning Board at its meeting on May 20, 2014, held a
Public Hearing on the above zoning amendment.
Paul Nicklas, Assistant City Solicitor, indicated that this ordinance amendment
would allow up to four food vendors on a single -lot in certain zoning districts in most
industrial and commercial zoned lots. The only district where more than a single
vendor is allowed is the Waterfront Development District where four vendors are
allowed per lot. This amendment would allow four vendors per lot in the Urban Service

District, Shopping and Personal Service District, General Commercial and Service
District, and Urban Industry District provided that there are five extra parking spaces on
the lot per vendor.
Mr. Nicklas indicated there was expressed interest in having additional vendors in
Shopping and Personal Service District. The language would require 5 parking spaces
per vendor above what is required by the existing land uses at the site.
No one from the audience spoke in favor of or in opposition to the proposed
amendment.
Planning Officer David Gould noted that such permits for the food vendors is
issued through the Code Enforcement Office and does not need Planning Board
approval.
The Board voted unanimously to recommend the proposed text amendment to
the City Council - Land Development Code, as contained in Council Ordinance #14-170.
