In order to do so, they have requested that they receive copies of those plans at the time they are submitted. This amendment to the Land Development Code would increase the number of plans required for submission for a Land Development Permit from five to six to accommodate this request. /s/ James D. Ordinance, Amending Land Development' Code, Chapter 165, Section 165-126 — Minor Subdivision; Chapter 165, Section 165-128 — Major Subdivision; and Chapter 165, Section 165-112 - Table B — Submission Requirements for Land Development Permit Be it ordained by the 0ty of Bangor, as follow: THAT the Land Development Code Sections 165-126, 165-128 and Section 112 — Table B be amended as follows: 165-126 Minor Subdivision A. Application. The subdivider seeking approval of a minor subdivision shall file an application for minor subdivision plat approval with the Planning Officer. The application shall include the submission of thFee blue line OF blaCk prints consistent with the requirements of Section 165-112 Table B and at least two reproducible copies of a stable base material of the final lotting plan and the submission of a topographic map of the subdivision having contours of not greater than two -foot intervals. 165-128 Major Subdivision The approval of a major subdivision by the Planning Board shall require the approval by said Board of both a preliminary plat and a final plat. A. Procedures for filing for approval of the preliminary plat of a major subdivision. (1) Application. The subdivider seeking approval of a major subdivision shall, at least 14 days prior to the Planning Board meeting at which consideration is desired, file an application for major subdivision preliminary plat approval with the Planning Officer. This application shall include the submission of three Mue lineeF "'a"'' prints consistent with the requirements of Section 165-112 Table B, of the preliminary plat and the following engineering data: preliminary cross sections and plans and profiles of proposed streets and underground utilities E. Procedures for filing for final approval of a major subdivision, Procedures for filing for final approval of a major subdivision, (1) Application. The subdivider seeking approval of a final plat of a major subdivision shall, at least 20 days prior to the Planning Board meeting at which consideration is desired and within 12 months of preliminary plan approval by the Planning Board, file an application for major subdivision final plat approval with the Planning Officer. Such final plans should conform substantially to the plans which received preliminary plan approval by the Planning Board. MEMORANDUM DATE: January7, 2009 TO: The Honorable City Council FROM: David G. Gould, Planning Officer SUBJECT: Amending Land Development Code Sections 165-126, 128 and 112 - Table B Council Ordinance 09-029 Please be advised that the Planning Board at its regularly scheduled meeting on January 6, 2009 held a Public Hearing on the above Land Development Code Amendment. Planning Officer Gould provided an overview of the proposed Land Development Code Amendment that was developed to require that one additional plan set be provided to the City in Development Plan Applications. Mr. Gould noted that the additional plan set was being requested such that the Fire Prevention Bureau could have a more active role in the plan review process. Presently, the Fire Prevention Staff reviews plans with Code Enforcement and on request when a particular issue arises. Several Board Members asked if additional copies should be requested to allow Board Members to have individual copies. Mr. Gould noted that while that is the practice in some communities it did not appear to be warranted. The plans are available in the Planning Office and Staff will provide the Members all the information they desire (stormwater studies, traffic analyses etc) to review the plans before them. Should there be a need to have more copies submitted the required submittal items could be revisited again. The Board discussed the cost of making additional copies and the final disposition of approved plan sets. The Board voted 5 in favor and none opposed to recommend the proposed language to the City Council.
