Commentary:
The amendment adds building and construction contractors to the list of Permitted Uses in the Industry and
Service District. It also deletes clinic, medical or dental as a permitted use in the Industry and Service
District. Medical clinics were added to I&S to meet the specific needs of the Maine Business Enterprise Park,
subsequently the entire business park was rezoned to Technology and Service District (T&SD) and medical
clinics, as a use, could be eliminated from the Industry & Service District.
This is for First Reading and Referral to the Planning Board for their review and recommendation.

(TITLE.) Ordinance, Amending the Land Development Code, Chapter 165: § 165-103 C (11) Industry
and Service District — Permitted Uses - To Substitute Building and Construction Contractors for Clinic,
Medical or Dental.
Be it ordained by the City of Bangor, as follows:
That Chapter 165, Section 165-103. Industry and Service District (I&S) be amended as follows:
A. Statement of purpose. The Industry and Service District is established to accommodate certain
manufacturing, research, information processing and communications uses requiring uncongested, spacious and
attractive surroundings as well as traditional manufacturing, warehousing, distribution centers, transportation
terminals and certain commercial and repair service uses which require locations which ensure sufficient space on
expansive sites for building expansion, parking and loading facilities and landscaping.
B. Basic requirements. Buildings or land used or occupied and buildings or structures erected, constructed,
reconstructed, moved or structurally altered, whether permitted uses or conditional uses, shall comply with the
requirements of this section, Articles II through XII and the specific development standards of Article XIX of this
chapter.
C. Permitted uses. The following uses are permitted in this district:
(1) Manufacturing, compounding, assembling, packing, treatment, warehousing or wholesaling of goods and
products.
(2) Truck terminals and distribution centers.
(3) Radio and television broadcast towers, provided that:
(a) They do not exceed 400 feet in height, or the minimum height required under federal law,
whichever is greater.
(b) They are set back a minimum of 50% of the tower height from all property lines.
(c) They conform to the requirements of § 165-80.1.
(4) Information processing and communications facilities.
(5) Research and testing facilities of a laboratory nature.
(6) Administrative offices of manufacturing, retail, banking, public utility, service or research corporations.
(7) Service business limited to office use.
(8) Retail sales which are incidental to any permitted use in Subsection CO) through u above of this section.
(9) Group day-care or nursery school.
(10) Day-care center.
(11) QiRiG, mediGal oF dental. Building and construction contractors: contractor facilities where materials and
equipment storage may require extensive outdoor storage areas. Such operations may contain office, shop,
processing, warehousing and other support functions.
(12) When accessory to any of the above uses, warehouses, vehicle storage, garages and employee
restaurants.
(13) Public utility and public service uses.
(14) Chemical dependency treatment facility, provided the property line is at least 300 feet from any residential
district.
(15) Accessory uses on the same lot and customarily incidental to and subordinate to the above uses and any
use approved under Subsection D below.

SUBJECT: Amending Land Development Code — Chapter 165-
103C Industry and Service District - C.O. 10-60
Please be advised that on February 16, 2010 the Planning Board held a public
hearing on the above Land Development Code Amendment.
Planning Officer David Gould explained that the amendment sought to
substitute the use construction contractors for medical or dental clinics in the
Industry and Service (I&S) District. Mr. Gould explained the history of how
medical clinics came to exist as a permitted use in the industrial district and the
new district for the Maine Business Enterprise Park that would allow them to be
deleted from the I&S District without any adverse repercussions.
Member Theeman inquired if there were any medical or dental clinics in
industrial districts. Mr. Gould noted the only ones he was aware of were in the
Maine Business Enterprise Park and that is now zoned Technology and Service
District.
Mr. Chip Laite of Sargent Corporation indicated that they are seeking to buy the
former Ansewn Shoe property to relocate their construction business from
Hampden. The proposed amendment would allow them to reuse that existing
site.
The Board voted unanimously to recommend that the City Council adopt the
proposed change to the Industry and Service District to substitute construction
contractors for clinics, medical and dental, as contained in C.O. 10-60
