Commentary:
Currently, our Ambulance Drug Boxes are restocked by the Pharmacy at Eastern Maine Medical
Center. Ambulance Drug Boxes contain those drugs/ medications which can be administered to
patients by Bangor Fire Emergency Medical Technicians (EMT's) prior to their arrival at a health
care facility. The purpose of Drug Box Agreements is to establish a system for monitoring and
restocking on -board medications which are utilized by our Rescue Service.
This Order will authorize an Agreement with St. Joseph Hospital to have the Ambulance Drug
Boxes restocked by the Pharmacy at St. Joseph Hospital. In the event medications from the
drug box have been used on a patient transported to St. Joseph Hospital, this Agreement will
enable Rescue crews to restock the Drug Box immediately while at St. Joseph's. This will help to
ensure that when Rescue Units respond to calls for service following a trip to St. Joseph
Hospital, they will have a fully stocked Drug Box.
This was reviewed by the Government Operations Committee, which recommended approval.

WHEREAS, the City of Bangor Fire Department transports patients to St. Joseph
Hospital; and
WHEREAS, patients often require treatment by Bation and gor Firepsupplies which need to be
epartment personnel
during transport thereby using medics

WHEREAS, St. Joseph Hospital has the ability to restock the supplies; and
WHEREAS,, it is in the best interest of the City of Bangor to have an agreement with
St. Joseph Hospital to establish a system for providing, monitoring and
restocking of medication for prehospital drug boxes utilized by the Bangor
Fire Department.
By the City Council of the City of Bangor:
ORDERED, that Jeffrey Cammack, Chief of the Fire Department, is hereby authorized on
behalf of the City of Bangor, to execute a Prehospital Drug Box Agreement with St.
Joseph Hospital. Said Agreement shall be substantially the same form as attached
hereto and in a final form as approved by the City Solicitor or Assistant City Solicitor.

PREHOSPITAL DRUG BOX AGREEMENT
This agreement made and effective this day of , 2009 by and
between St. Joseph Hospital (hereinafter referred to as "Primary Hospital") and the City of Bangor
(hereinafter referred to as "Rescue Service") shall be for the purpose of establishing a system for the
provision, monitoring and restocking of medications for prehospital drag; boxes which are utilized
by the Rescue Service to improve the quality of patient care and minimize duplication of services.
A. Now, therefore, in consideration of the mutual covenants contained herein, the parties hereto
agree as follows:
1. Provision of Emery Medical Treatment. Emergency medical treatment shall be rendered in
accordance with the Maine Emergency Medical Services Act of 1982, 32 M.R.S.A. §81 et..sey.,
The Maine Emergency Medical Services System Rules promulgated pursuant thereto, and IIIA
Maine EMS treatment protocols.
2. Drug, Box Provision, Monitoring and Maintenance The provision, monitoring and
maintenance of drug boxes placed in the Rescue Service's units shall be carried out in
accordance with Maine EMS Rules, applicable Regional policies, and any attached specific
pharmacy or service requirements. It is understood and agreed upon by between the parties
hereto that the Primary Hospital shall maintain medications in drug boxes as necessary and
such maintenance shall not constitute a transfer of ownership of such medications to the
Rescue Service.
3. Drug_Box use. It :is understood by all parties that the drug box will be accessed by the Rescue
Service's personnel who are permitted by Maine HMS licensure to administer the medications
contained within the Drug Box.
4. Limits of Participation. The Primary Hospital agrees to participate with other hospitals receiving
patients from the Rescue Service, in the maintenance of drug box medications used by EMS
personnel in transit to the receiving hospital pursuant to the above referenced
protocols and medical control directives.
S. Narcotic Inventory: The receiving hospital shall be responsible for maintaining; a perpetual
inventory of all narcotics dispensed to the Rescue Service.
C. Consideration: There shall be no monetary consideration paid by the Rescue Service to the
receiving hospital or the Primary Hospital for the provision, monitoring and maintenance of
such drug; boxes.
7. Mutual Indemnity:_ The Primary Hospital, its successors and assigns, agree to hold harmless and
indemnify the Rescue Service, its successors and assigns, from any claim, costs,
liabilities, and expenses arising, from or attributable to any acts or omissions of the agents,
servants or employees of the Primary Hospital in performing; its obligations under this
agreement. The Rescue Service, its successors and assigns, agree to hold harmless and
indemnify the Primary Hospital, its successors and assigns, from any claim, costs, liabilities,

and expenses arising from or attributable to any acts or omissions of the agents, servants or
employees of the Rescue Service in performing its obligations tinder this agreement.
8. Independent Contractor: It is understood and agreed between the parties hereto that the
Primary Hospital's participation in this agreement and maintenance of medications in the
Rescue Service's drug; boxes, shall not constitute a partnership or joint venture. Each party
shall be responsible for providing its own services as described herein and according the
aforementioned protocols.
9. Amendment: This agreement may be modified or amended by mutual assent of the. parties
hereto; any such modification or amendment shall be attached to and become part of this
agreement.
10. Applicable Laws: The terms of this agreement and the actions of the parties pursuant
thereto, shall comply with all federal and state laws and regulations.
11. Periodic Review:, Representatives of the Rescue Service and the Primary Hospital shall
periodically review this program at mutually agreed upon dates and times.
12. Term: The term of this agreement shall extend for a period of one year, commencing on
01 January 2010, and shall be automatically renewed in successive one year terms upon the
same terms and conditions provided herein, unless either party requests a change in the term
and conditions or terminates this agreement as provided herein. A request to change the terms
and conditions of this agreement must, be submitted, in writing, at least thirty (30) days prior to
the expiration of the current agreement. Either party may terminate this agreement upon sixty
(60) days written. notice to the other.
In witness whereof; the parties heretic have executed this agreement on this date, in
this year 2009.

B. All medications will be secured in a storage box, in accordance with MEMS Rules and
Protocols, with a label attached indicating the name of the earliest expiring item and its
expiration date. "The box will be secured with a one-time, pharmacy -type, numbered seal.
This seal will be applied and recorded by an authorized representative of the hospital, or will
become the responsibility of the Rescue Service's paramedic. By signing this section of the pre
hospital drug box agreement, the parties hereto are authorizing the on duty EMT -Paramedics of
the Bangor Fire Department's rescue service to act as authorized representatives of
Hospital for the sole purpose of applying the one-time, pharmacy -type, numbered seal. (Luck
