Item/Subject: Ordinance Amending Chapter 165, Land Development, of the Code of the City of Bangor —
Section 165-135, Developing Area Development Standards
Commentary:
The proposed text amendment is intended to make the typical buffer yard requirements for permitted uses in
the General Commercial and Service District as indicated in 165-102 C (1) the same as for those same
permitted uses in the Shopping and Personal Service District. In 2007, the City eliminated the typical (default)
side and rear buffer yards for permitted uses in the Industry & Service District and Shopping and Personal
Service District. This amendment will make General Commercial and Service District equivalent as noted.
This amendment will make the buffer yard requirements equivalent in the Industry & Service District,
Shopping and Personal Service District and the General Commercial and Service District.

SUBJECT: Amending Land Development Code Chapter 165-135
Schedule B Buffer Yard Type
Council Ordinance 13-140
Please be advised that the Planning Board at its meeting on May 7, 2013, held a
Public Hearing on the above zoning amendment.
Planning Officer David Gould reviewed the history of bufferyards in the Land
Development Code starting with the 1991 version.
Bufferyards were intended as minimal landscaping standards for development in
the developing portions of the City. The Districts would include LDR, HDR, S&PS, GC&S
and I&S. The same range of buffers were used for parking lots and transition area
between residential and commercial districts.
Around 2005 there was concern that the buffers for parking areas were
insufficient and the plant numbers were dramatically increased. After a short while Staff
revised the buffer requirements and proposed to eliminate bufferyard plantings for
permitted uses within the Developing Areas Districts. That process started with
Shopping and Personal Service (S&PS) Districts and Industry & Service (I&S) Districts.
It was noted that the General Commercial and Service District (GC&S) still had
bufferyard requirements for permitted uses, even those that were duplicated from the
S&PS District.
The proposed amend would eliminate buffer yard requirements for permitted use
in GC&S for those uses identified in 165-101 C (permitted uses in S&PS). The standards
for parking lots, outdoor storage, and transition yards would not change.
There were no proponents or opponents speaking to the above zoning
amendment.
The Board voted unanimously to recommend approval to the City Council of the
proposed amendment to the Land Development Code - Chapter 165-135 Schedule B
Buffer Yard Type, as contained in Council Ordinance 13-140.
