MEETING OF MAY 11, 2023 7:00 P.M.

Chair Riordan called the meeting to order at 7:00 P.M.
New Business:
1. Certificate of Appropriateness — 28 West Broadwav — Map-Lot 022-065 —Whitnev
Park Historic District —Applicant/Owner: Stephen Freese -Approval requested for
Certificate of Appropriateness to install a generator and heat pump. The property is
located at Map-Lot 022-065, in the Whitney Park Historic District.
Applicant Stephen Freese presented to the podium. Informed Commission that application is to install a
generator for back-up power and a heat pump for energy efficiency. Reported there will be three units
on the exterior of the house, all entirely obscured by brush as far as he can tell. There will be a chase to
accommodate the heat pump going to the second floor, but this will be modest and painted.
Chair Riordan went through the points from consultant Mike Pullen's memo and reported on applicant's
written responses. Applicant's responses confirm that some plants will be removed to accommodate the
equipment, but that some plants will remain and additional shrubs will be added in the currently
unplanted area between the equipment and the road.
Commissioners had no questions. No public comment.
Vice Chair King moved to approve the Certificate of Appropriateness for 28 West Broadway —
Map-Lot 022-065, in the Whitney Park Historic District, Applicant/Owner Stephen Freese.
Commissioner Chernesky seconded. All in favor upon roll-call vote, none opposed.

2. LD 2003 Discussion
Planning Analyst Collette presented to the podium. Reported that staff currently working on drafting
compliance language for LD 2003, with deadline presently set as 7/1/2023. There is pending legislation
to delay this deadline. Noted that the City is already mostly compliant with bill's guidelines, but the
primary changes being discussed are: (1) In zones URD-1, LDR, and RR&A, which are mainly single-
family zones, there would be an increase in the number of units allowed depending on lot size. Current
minimum lot size for a single-family in URD1 is 5000sqft, and this change would allow for up to 4 units to
be added, with each unit requiring 5000sqft in lot size. In the LDR district, the minimum lot size is
currently 12,OOOsqft and each additional unit would require 6000sqft of lot size. In RR&A district, most of
this zone is located outside the growth boundary defined in the Comprehensive Plan, which the state is
using in its legislation (allowing for less additional units outside of the growth boundary and more
additional units within the boundary). For properties outside of the boundary, allowance of additional
units would depend on access to public water/sewer vs. private, as well as there being any existing
dwellings on the property. These properties could potentially add up to 2 units depending on the
situation. Inside the boundary, the City will have to allow for an affordable housing density bonus. Any
development with at least 51% of its units designated for affordable housing could have 2.5x the base
density allowed. This would be dependent on access to adequate public water/sewer. (2) ADUs will now
have to be allowed in the front of a primary structure instead of only in the rear or on the side. The City
will not be allowed to require additional parking for these units. Collette noted that there are still many
other permitting requirements that the City is allowed to have that will place limitations on development.
Vice Chair King asked how affordable housing is defined. Collette stated that it is defined by HUD
guidelines.

Vice Chair King moved to approve the April 13th meeting minutes. Commissioner Chernesky seconded.
All in favor, none opposed.
Chair Riordan asked member of the public for comments. Joe Pickering came to report that he is in
favor of the City doubling fees on vacant properties, as he read in a BDN article. Pickering also stated
that he felt the City should try to acquire the Bangor Theological Seminary property. Felt disappointed
that building is currently in a state of disrepair and feared there would be neighborhood devaluation
without its restoration. Felt that HPC should generally take a more "holistic" approach to the City's
historic districts, rather than focus on the planning aspects.
