� AGENDA ITEM #1 - ORDINANCE - Amendi.ng Chapter II, Art. 6, Schedule
I af Laws and Ordinances of the City af Bangor -
: Parki.ng Proha.bited at A11 Times - Merrimac Street
This item was considered at the 2/23/94 C&ED meeting with a
recommendation by Gommittee that a survey af Merrimac Street
resi.dents be done in order to see how they felt about the progosed
parking ban fram November 1st to March 31st of each year. The
purpase far the ban is due to the di.fficulty during the wi.nter
months for emergency vehicles- to access the street because oE its
narrow width, snow accumulati.an and vehicles parked alang the
street.

Gary Jewell, Bangor Parking Supervisor, hand delivered
approximately 25 su�:veys ta all househalds on Merrimac Street and
spoke with approx�..mately 5 residents {who happened to be home} with
respect to thei.r feelings regarding prohibition of parki.ng from
Navember Ist to March 31st of eaeh year, Five af the surveys have
been returned ta Gary with 3 No's; 2 Yes. Also, when asked if
changing the direction that the traffic travels on this ane-wa�r
street would be desirable, the responses were unanimous to keep it
the way it currently is.
The City depts. o£ fire, public works and police are al1 in
agreement that the ban should be enforced dura.ng the months from
. �Tovember Ist to March 3lst of each year.

Aside from those surveys already received, several residents
of Merrimac Street were at the meeting to voice their opinions on
the proposed parking ban. Mary Robinson voted for the ban; Pauline
Connors voted for the ban; Fred Thibodeau voted against the ban;
Greg Stewart stated his concerns for where off-street parking would
' be otfered.
One alternative for off-street parking, as suggested by
Councilor Popper, would be to use the vacant lot at 55-57 Merrimac
Street. Councilor Baldacci recommended that Staff look at the
option of using this vacant lot for off-street parking during the
winter months.
A motion was made and unanimously seconded to recommend that
this proposed Ordinance Amendment, as presented, be forwarded to
the City Counci3. for approval. So voted.
AGENDA ITEM #2 - Ordinance - Amending Chapter III, Art. 6,
Schedule II of the Laws and Ordinances of the City
of Bangor - Parking Liunited to 30 Minutes -
Center Street
Gary Jewell, Parking Supervisar, presented this item to the
Committee. �
When paving on Center Street was done in 1993, the signs �
stating "Parki.ng Limited to 30 Minutes" were taken down. Recently,
the signs were to be put back up again but Gary noticed that there
was no Ordinance covering this area. At this time, it is requested
by Staff to recommend approval of the requested Ordinan�e Amendment
as referred above.
A motion was made and unanimously seconded to recommend that
this Ordinance Amendment, as presented, be forwarded to the City
Council for approval. So voted.
With no other business at hand, the meeting was ad�ourned at
5:45 pm.

Chairwoman Rerry Sack apened the meeting with a round-table
introduction af a11 present. .
Craig Boyd and Brent Falster from Fleet Bank and Peter Pi.tula of
Fleet Mortgage made a presentation concerning Fleet's recently
annaunced INCITY Program. A summary af this $8 billion program
i.s contained in the at�ached letter from Flee�t President,
Terrence Murray to City Manager, Ed Barrett. Additiona3ly, Craig
mentioned reduced paper�work requirements and 3-day loan approval
turn-around time.

Hill Burney, Maine State Housing Authority Busines� Development
Officer, made a presentation of MSHA's variaus housing pragrams
for first-time home buyers, financing of multi�amily projects and
housing rehabilitation. He also discussed the federal HOME
program, the CHA� citizen participation process, the SHARP
program and CHODO's.
Kerry Sack and Ken Bustund discussed the need for a "hame rescue"
program to refinance existing mortgages for families with
reversed fortunes. John Maore described the Windover Mortgage
reverse mortgage program operated by Shamut Bank. Judy Cuddy
indicated that in many cases a drop in property value resulted in
loss of equity which limited refinancing opportunities. Bill
Floyd suggested the need for the interven�ian af third party in
difficult cases. Jahn Moare described some o£ the housing grant
and loan programs offered by members of the Federal Ha�e Laan
Bank system.
Erik Stumpfel briefed the Alliance an eff�rts by the City of
Bangar and athers to legislate limitations on the property tax
�xemption far c�rtain hausing types in order to protect the
municipal tax base �rom conversion of housing complexes from
taxable to tax-exempt status by investors se�king tax credits.
• Legislation proposed to last year's iegislature was gassed but
vetoed by the governor. Efforts ta develop a bill which could be
widely supported in the current legislative se�sion have resulted
in a watered-�own compromise of li.mited impact. The committee-
amended version of this bill i� attached,
Stan reported that the City's 1994 CHAS has been approved by HUD
' and copies will be distributed shartly to those wanting them.

�j 7) In addition to the rectuirements of subuaraQraphs 1 throucrh 4 of__
this taaractraph, an exemption is not allowed under paraQraphs A or B _
of this subsection for real or personal propertv owned and occupied
or used to �rovide residential rental housincx which is transferred or _
placed in service on or after September 1 , 1993, unless the propertv__
is owned bv a nonprofit housinq corporation and the operation of the_
residential rental housinct is not an unrelated trade or business to
such nonprofit housing corporation.
For �urposes of this subparagraph, the followinQ terms have
the followinq meaninas: �
�i) "Nonprofit housincr cortporation" means a nonprofit
corporation orctanized in the State of Maine which is exempt
from tax under section 501�c L(31 of the United States Internal __
� Revenue Code which has amon its c orate ur oses the
,provision of services of �eonle o low_ 'ncome or the
construction, rehabilitation, owne p or operation of
housinct.
jii) "Residential rental housina" means one or more__
buildinqs, tocrether with anv facilities functionallv related
and subordinate thereto, containincr one or more similarlv
constructed residential units offered for rental to the
general public for use on other than a transient basis each of
which contains separate and complete facilities for livincr,
sleepina, eatinQ, cookinct and sanitation.
jiii) "Unrelated trade or business" means anv trade or
business the conduct of which is not substantiallv related to
the exercise or verformance by such oraanization of the
purposes or functions constitutincr the basis for exemption
under Section 501 �c) (3) of the United States Internal
Revenue Code.
S,meraencv clause. In view of the emergencv cited in the _
preamble, this Act takes effect when approved.
