CITY COUNCIL CHAMBERS, 3RD FLOOR CITY HALL ALSO; ATTENDANCE VIA ZOOM MEETING MINUTES Board Members Present: Ken Huhn, Chair Reese Perkins, Vice Chair Michael Bazinet Ted Brush Don Meagher Lisa Shaw City Staff Present: Anja Collette, Planning Analyst Anne Krieg, Planning Officer John Theriault, City Engineer Brittanie Thomas, Assistant City Solicitor Chair Huhn called the meeting to order at 7:00 P.M. LAND DEVELOPMENT PERMIT 1. Land Development Permit Application – Site Development Plan – 605 Stillwater Avenue – Map- Lot R61-009-G – Chick-Fil-A, Inc.– Land Development Permit Application for proposed construction of a larger meal delivery canopy at the pickup window, a free-standing canopy at the order boards and reconfiguration of the parking area and drive-thru lane. Improvements being proposed will improve the functionality of the drive-thru service at property located at 605 Stillwater Avenue, Map-Lot R61-009- G, in the Shopping & Personal Services (S&PS) District. Applicant: Chick-fil-A, Inc. Tony DiSanza, representing Chick-Fil-A, Inc. present in Council Chambers, Nick Dewhurst, Engineer with Bohler Engineering via Zoom, Todd Schultz, operator of franchise via Zoom. Mr. Dewhurst presented the following: Existing conditions and proposed conditions o Purpose is to help improve overall efficiency of drive-thru operations o Since the pandemic started, nationwide franchises have seen a drastic increase in drive- thru access o There are queuing problems at this specific site o This project will increase the number of cars able to stack and fit into drive-thru queue Main changes o Elongate drive-thru - 2 lanes in entirety, will merge into one lane prior to pick up window 73 HARLOW STREET, BANGOR, ME 04401 TELEPHONE: (207) 992-4280 FAX: (207) 945-4447 WWW.BANGORMAINE.GOV City of Bangor Planning Division Planning Board Meeting Minutes – July 19, 2022 o Installing meal ordering canopy, as well as additional order boardandpick up window canopy to keep team members/customers out of inclement weather o Realigning portion of parking areas with a loss of 8 parking spaces; still well in compliance with parking regulations o Relocating trash enclosure to central part of parking area o Proposing pull-off waiting area to accommodate up to two vehicles for customers placing larger orders o Adding deciduous trees on left side of the property o Changes are minor in nature- will increase drive-thru efficiency and avoid queuing problems that might be occurring today o Will maintain compliance with zoning regulations, adding 1500 SF of impervious area Stormwater basin designed during 2016 construction- slight increase of impervious area does not impact functional capacity No questions from Board Members or the public. No staff comment. Member Shaw moved to approve the Land Development Permit Application for proposed construction of a larger meal delivery canopy at the pickup window, a free-standing canopy at the order boards and reconfiguration of the parking area and drive-thru lane. Applicant: Chick-fil-A, Inc. Motion seconded by Member Vice Chair Perkins. All members in favor, none opposed. Motion carries. Vice Chair Perkins advised that it was a nice proposal, had questions, looked through information and it was all listed. No concerns at all. 2. Land Development Permit Application – Site Development Plan – 1365 Broadway – Map-Lot 062- 197 – Northeast Pain Management - Land Development Permit Application for approval of addition of 6,241 square foot parking lot at property located at 1365 Broadway, Map-Lot 062-197, in the Contract Shopping & Personal Services (S&PS) District. Applicant, Northeast Pain Management; Owner, Dunmurry, LLC. Dan Miller, TAC Architectural Group, present in Council Chambers, and Andy Johnston, Atlantic Resources via Zoom, presented the following: Existing conditions o Buffer yards created from previous approvals Adding more parking on the right side of the building There’s an existing deficit of parking on-site; some staff currently have to walk over from parking lot across the road due to the shortage of parking on-site 6,000 SF of new impervious area o Drainage areas to front and rear o Two new bio retention cells- one at rear, one at front Page 2 | 4 City of Bangor Planning Division Planning Board Meeting Minutes – July 19, 2022 Shallow, effective for stormwater treatment, best management practices Adding plantings to enhance buffer areas Additional plantings in rear area of bio retention cell to fill gap and meet buffer yard requirements Staff comments helpful through process o Added connection between lots in the rear Project aimed at mitigating current parking deficit, done in the most practical way possible, adding sufficient stormwater treatment Member Bazinet inquired about the boundary over a current water line and ensuring sufficient covering; wanted to be sure that had been noted. Mr. Johnston indicated that it was noted and they will slightly amend the outline of bio retention cell to be clear of that area. No additional questions from public, no staff comments. Vice Chair Perkins moved to approve the Land Development Permit Application for approval of addition of 6,241 square foot parking lot at property located at 1365 Broadway, Map-Lot 062-197, in the Contract Shopping & Personal Services (S&PS) District. Applicant, Northeast Pain Management; Owner, Dunmurry, LLC. The motion was seconded my Member Bazinet. Vice Chair Perkins said that this was a great application, thorough and well thought out. All members in favor, none opposed. Motion carries. 3. Land Development Permit Application – Site Development Plan – Longview Drive – Map-Lot R69-001-G – Fields of Green, LLC - Land Development Permit Application for proposed construction of a 1,500 square foot medical marijuana facility at property located on Longview Drive, Map-Lot R69- 001-G, in the General Commercial and Service (GC&S) District. Applicant, Fields of Green, LLC; Owner, Ryan Witmer. Sean Thies, Haley Ward, representing the applicant, provided the following: Property on Longview Drive o Decent sized lot; encumbered by two drainage easements 1500 SF building, 14 vehicle parking spaces, 1100 SF of new impervious surface Will be a medical marijuana dispensary All utilities off Longview Drive Proposed lighting on building, no site lighting on poles, back corner is proposed dumpster/enclosure, loading zone in rear of building Chair Huhn asked if there was another marijuana facility close by. Mr. Thies provided that there was one close by. Member Bazinet discussed item C, reminder to applicant for medicinal marijuana under General Code, regarding security, etc. Planning Officer Krieg stated that this would be administered and enforced at the Code Enforcement level. No additional questions from public, no staff comments. Member Shaw moved to approve the Land Development Permit Application for proposed construction of a 1,500 square foot medical marijuana facility at property located on Longview Drive, Map-Lot R69-001- Page 3 | 4 City of Bangor Planning Division Planning Board Meeting Minutes – July 19, 2022 G, in the General Commercial and Service (GC&S) District. Applicant, Fields of Green, LLC; Owner, Ryan Witmer, with conditions to adhere Article 1. Medical Marijuana as adopted CO#10-185, §177-3, items A- H. Motion was seconded by Vice Chair Perkins. All members in favor, none opposed. Motion carries. OTHER BUSINESS 4.Comprehensive Plan Check-in At the next Planning Board meeting, the draft Vision Statement and Goals will be presented for feedback from members and public City Council will be reviewing this draft at their pre-council workshop on July 25, 2022 5. Meeting Minutes – July 5, 2022 – Member Meagher moves approval of July 5, 2022 meeting minutes pending no changes or additions, seconded by Member Bazinet. All in favor, none opposed.
