Introduced and filed by Councilman STATE OF MAINE DEPARTMENT OF ECONOMIC DEVELOPMENT TAIWAN PIANNIHG AGREEMENT THIS AGREENEMT, dated for convenlence of reference as of the _ day of I9_, Ay and between the State of Maine by and through its Department of Economic Davelepnent 6areinafter sometimes called the Department), e Department of the State of Maine, treated and established by Title 10 of the Maine Revised Statutes Annotated, 1964, as amended, and the EaWN= City of Bangor (hereinafter sometimes called the Town or City), a body corporate and politic in the County of Penobscot and State of Maine, WITNESSETH THAT: WHEREAS, by virtue of Title 10 of the Maine Revised Statutes Annotated, 196:0, as amended, the Department Is euthor zed and empowered: (e) to accept for the State day Federal funds apportioned under the provl- slore of Federal law relating to urban planning and planned public works, and to do such acts as are necessary for the purpose of carrying out the provisions of such Federal law; (b) to accept from any other agency of government, Individual, group or Corporation such funds as may be available to carry out the provislons Contained In Title TO of the Maine Revised Statutes Annotated, 1964, as amended; TO to assist In planning any public or private project involving Federal grant$ or loans; and (d) to advise, confer and otherwise cooperate with municipal planning boards, agencies, officials, civic and 3ther groups and citizens In matters relating t0 zoning, and planning relating to schools, housing, health, land use control, assess- ment and taxation and other objectives; WHEREAS the officials of the Town or City of Banour have presented to the Department an outline of a proposed planning project; WHEREAS the Tann or City of ea000r has appropriated and made available to the Department certain ams of money which the Department may use for the purpose of contracting with any person, firm or corporation to carry out the proposed planning project along with Federal funis that may became available to match said funds from time to t'me; WHEREAS the Town or City of Bangor estimates that the proposed Planning project will cost approximately $ 203.188.00 WHEREAS It appNro that the Town or City of _Bangor had a population of less than 50,000 according to the latest United States Census, to wit a popula- tion of 18.912 in the year 1960; HW, THEREFORE, the parties hereto do mutually agree as follows: I. The Town or City agrees to allocate and provide to the Department the sun of $ 52.263.0 , or Its egcivalent in services, as its contribution to the planning project. Such contribution Is to be made up as follows; (a) $ None . to be deposited with the Department, said amount to be expended by the Department as the said Department and the Federal Government may recuirs. This sum shall be deposited with the Depart- ment within seven days after a written request therefore is presented to the Town or City; (b) $ 52.283.00. In technical and travel services to be provided by the Town or City as a contrl burned service in the performance of the plan- ning project; 2. The State of Maine, by and through the Department agrees to allocate tFe sun of $ i5.446.00 or Its equivalent In services, as Its contribution to the planning project, as detailed In Exhibit A. 3. The Department further agrees to allocate a sum not to exceed $ 135.459.00 from Federal grant$ received from the Housing and Hone Finance Agency, to be used as the Department may direct. If and when such funds became available. If the Federal grant deme cot equal the amount that the Town or City Is to contribute under 1, above In money or services, the Department shall, upon an equitable bests, determine the amount to be allocated to the Town or Cty planning project. 4. All funds received from the Housing and Hone Finance Agency and deposited with the Department shall be held by the State Treasurer and disbursed by the State In accordance with rules and regulations which shall be established by the Maine State Bureew of Accounts and Control. of Accounts and Control. -2- S. The Town or City agrees to furnish monthly accountings of all expenditures In aecordeence with the rules and regulations established by the Maine State Bureau of Accounts and Control. -2- 6. The Town or City agrees that an amount not to exceed five percent of the total pi anning project budget, as shown by Exhibit b, attached hereto and made a part hereof, rosy be expended by the Department for certain administrative services In correction with the planning project as the Department In Its discretion may free time to time determine. 7. The plane;" project shall follow the outline contained In Exhibit A, Attached hereto and made a part hereof. 8. The piaoD;ng project mentioned In Section 7 hereof and set forth In Exhibit A shell be completed within twelve months of the date of authorization of the project by the Federal Housing and More Finance Agency. 9. The Tam or City may from time to time request changes in the scope of the planning project as outlined In Exhibit A of this Agreement. This Agreement and the planning project may be amended according to the following mode of procedure. The Tom or City shell submit the proposed change In writing to the Department, and the Department may approve or disapprove the proposed change in Its discretion, provided, however, that no change shall be made in the planning project until the Department obtains the approval of any person, firm, association or corporation which has contracted with the Department to carry out the planning project herein mentioned, and provided further that the proposed change shall have the approval of the Federal Housing and Moans Finance Agency. If the Department approves, it shall endorse Its Approval thereon and the change with appropriate endorsement shall immediately be affl and and attached to all copies of this Agreement a,M shall became a part hereof. 10. Any funds contributed to the Department by the Town or City for the purpose of matching Federal funds to carry out the pl Seeing project referred to In Exhibit A of this Agreement which remain In the hands of the Department or Its agent after final accounting, settl event and payment to the Feddral agency disburs ico the Federal funds shall be returned to the Torn or City. 11. In the event that the Town or City fails or refuses to supply any of the sarvt cos, reports, moimys or In any other manner fails to discharge any of its 011 gat Ions under th la Agremmot, the State may withdraw frim and term l nate this Agreement by notice In the following manner. The Department shill give notion In writing to the Tam or City of Its reasons for terminating the Firmament and shall forward the sane so that It shell he received by the Town or City fifteen days prior to the date of termination, which shall be set forth therein. 9- 12. The Dapartsent east the Town or City, in contracting with third parties for smart ms arising out of this Agreement or In hiring employees to carry on functions under this Agreement shall shoe an discrimination against any applicant for such employment because of race, religion, color or national origin. This provision shall includes but net he limited by, the following: employment, upgrading, demotion or tram for; racrultment or recrul went advertising; layroff or termination; rates of P" or other forms of compensation; and selection for training, including apprentice- ship. Any person, firm, association or corporation contracting with the Department or the Tam or City to carry out my study or planning project In any manner whatso- ever shall Include the foregoing provision in any and all of its contracts and sub- contracts. 17. No public official, number or employee of the State of Maine, and no public official, member or employee of the Tan or City who exercises any functions or responsibilities In the revlaw, or approval of the undertaking of the carrying out of this planning project shall participate In any decision relating to this contract MIG, affects his personal Interest or the interest of any corporation, partnership Or aesocletion In Mich he Is directly or indirectly interested; nor shall any public official, member Or employee of the Department or public official or employee of the Tam or City have any Interest, direct or Indirect, In any corporation, partnership Or association Mich may contract with the Department or the Tarn or City to carry out any of the provisions of this Agreement. 14. No member of or delegate to the Congress of the United States of America and no resident Comm fastener shall be eAnitted to any share or any part of airy contract Mich may arise out of this Agreement.
