Land Development Permit Application for Site Location Permit Modification, Conditional Use and Site Development Plan – Stillwater Avenue – Map-Lot R61-009-G – Shammy’s - Land Development Permit Application for Conditional Use and a Site Location Permit Modification for development of an undeveloped parcel of land on Stillwater Avenue, at the corner of Bangor Mall Boulevard, Map-Lot R61- 009-G; for construction of an approximate 5,200 sq. ft. single-story tunnel style car wash. Proposed project will develop 1.30 acres with 0.744 acres of impervious cover, and the remainder as grass areas and shallow underdrain soil filters, in the Shopping & Personal Services (S&PS) District. Applicant; Shammy's Unlimited, LLC. Agent; Carpenter Associates. Jon Young, of Dallas, TX; representing Shammy’s Unlimited, LLC; provided the following in part and in substance: Proposing tunnel-style car wash at Bangor Mall outparcel, across from Joanne Fabrics 135’ tunnel, stay in vehicle 3 queuing lanes with 3 pay stations Self-serve vacuum canopies Subscription membership-based business model o 4 packages, unlimited use for monthly fee Board Members discussed conditions of approval for Buffer Yards A and C o Planning Officer Krieg advised that it would be along the lot facing Pizzeria Uno 73 HARLOW STREET, BANGOR, ME 04401 TELEPHONE: (207) 992-4280 FAX: (207) 945-4447 WWW.BANGORMAINE.GOV City of Bangor Planning Division Meeting Minutes February 1, 2022 Additional buffer between Shammy’s and Uno’s, open to whichever buffering is requested, believe it’s Type C Conditions discussed o Shorten the one-way exit driveway from 30’ to 20’ o Applicant to provide gate at Stillwater Avenue entrance to eliminate traffic from backing up onto Stillwater Avenue o Applicant to work with mall owner and City to remove channelization islands interior road o Reduce width of intersection for confusion, applicant to bear responsibility for cost o Landscape buffer along Pizzeria Uno’s parcel Planning Officer Krieg reviewed the application permitting requirements o Subdivision; creating a lot in subdivision that was created for the original Bangor Mall o Land Development Permit Application, Site Development Plan o Conditional Use Permit for both drive thru business and use itself (retail auto service) o Modification to Site Location Permit (SLODA) – any changes to parcel require this permitting Documents that came in today are required for Site Location, sign off by State agencies Planning Board had the following questions: Sewer Discharge, pg. 30 o Will be going underground Owners of Joanne Fabric across street, abutter concern – driveways align up – rationale behind this? o City Engineer advised that driveways are pretty much aligned Joanne 25’ wide, this entrance 15’; generally, in the same vicinity, based on traffic work, this should be fine Same neighbor suggested Japanese Lilac trees o Documentation received that we prioritize native trees – these are not native, but they’re not invasive o Planning Officer Krieg advised that this tree isn’t that hardy, would be good if the board allowed to staff to work with applicant to meet requirements for buffering/plant lists native to this area Private access road to get out of the car wash and what happens if the increased traffic from car wash creates potholes – roads don’t seem well maintained as they’re private – applicant prepared to make improvements on road. o City Engineer advised that the private roads are owned by the mall entity. City is not responsible for fixing potholes on private ways. Mall is responsible, would be a discussion between applicant and mall to provide sufficient roadway for customers to utilize. Applicant agreed to make intersection improvements at Bangor Mall Boulevard and Stillwater Avenue, as well as off-site improvements by applicant. Page 2 | 3 City of Bangor Planning Division Meeting Minutes February 1, 2022 Member Shaw made a motion to approve theLand Development Permit Application for Conditional Use and a Site Location Permit Modification for development of an undeveloped parcel of land on Stillwater Avenue, at the corner of Bangor Mall Boulevard, Map-Lot R61-009-G; for construction of an approximate 5,200 sq. ft. single-story tunnel style car wash. Proposed project will develop 1.30 acres with 0.744 acres of impervious cover, and the remainder as grass areas and shallow underdrain soil filters, in the Shopping & Personal Services (S&PS) District. Applicant; Shammy's Unlimited, LLC. Agent; Carpenter Associates, with the conditions that the applicant ensure that vegetated Buffer Yard Types A & C are maintained; reduction of one-way exit driveway from 30’ to 20’; applicant provide gate at Stillwater Avenue entrance to be determined by the City in future if necessary to eliminate entering traffic from backing up on Stillwater Avenue; removal channelization islands at mall interior road, working with mall owner(s) and the city; reduce intersection width to reduce confusion, at the expense of the applicant. The motion was seconded by Member Bazinet. No further discussion. All members in agreement. Roll call vote not taken. OTHER BUSINESS 2. Comprehensive Plan Check-in - Consultants working on data chapters, should be completed by end of March. More outreach this Spring. Lecture series ends at the end of March, Parking Reform lecture (South Bend, Indiana) added. A. Lecture Series – February 2, 2022 at 7pm via Zoom, on Affordable Housing Discussion 3. Meeting Minutes – January 18, 2022 meeting minutes were approved pending no changes; Member Brush moved approval, seconded by Member Meagher. All members in agreement. Roll call vote note taken. 4.
