— That Chapter XI, Article 1 through Article 11 of the laws and ordinances of the
City of Bangor be deleted and replaced by the following:
ARTICLE 1 - SCOPE
$ec. 1 Short Title. This Ordinance shall he known and may be cited as the
"Mobile Nome Ordinance of the City of Tangen"
Sec. 2 Incorporated Provisions. There is hereby incorporated in this Ordinance,
and adopted by reference, the follopin9 Standards of the National Pine
Protection Association (hereinafter referred to as N.F.P.A.): N.F.P.A.
591A-1964 Standard for Fire Protection in Trailer Courts and
N.F.P.A. No. 501B-1968 Standard for Mobile Homes.
Sec. 3 Interpretation, Purpose and Construction. In their interpretation and
application, the provisions of this Ordiriance and the provisions incorporated
herein shall be held to be the minimum requirements adopted for the protection
of the public health, safety and welfare. To protect the publi0, aamag
other purposes, such provisions are intended to provide for permanently
wholesome community environment, adequate municipal and private Seervices,
and safe streets.
Sec. 4 Application.
4.1 Application. Glare this Ordinance imposes a Steffen

the regoirevents of this Ordinance, except the requirements of
Article 5, Sec. 1 and Article 6, Sections 3.2 and 5.2.

Sec. 4 Application.

land use than is imToSAd or required by existing provisions of law,
ordinance, contract or deed, the provisions of this Ordinance shall
control.
4.2 Mobile Ncwe Parks and Mobile gooses in Zxistence Prix[ to this Ordinance.
All mobile home parka so mobile homes in existence at the effective
date of this Ordinance shall within 90 days thereafter cceply with all
the requirements of this Ordinance, except the requirements of
Article 5, Sec. 1 and Apticle 6, Sections 3.2 and 5.2.
ARTICLE 2 - DEFINITIONS
Set. 1 Defirltions.
1.1 Mobile Home. A vehicular portable structure built on ochasis of
which wheels a n intrinsic part and are designed tot ,
and said structure is used without a permanent foundationmas a
dwelling for one or more persona, and provided with a toilet and
a bathtub or shower.
'.2 Mobile Home Park. A parcel of land under single ownership which
has been planned and inproved for the placement of mobile hoes
for non -transient use.
1.3 Mobile Home Lot. That Area within a mobile home park that provides
facilities for long to or occupancy of a mobile home and is designed
for the exclusive use cf its occupants.
..4 Mobile Home Stand. That part of an individual mobile hon lot which
has been constructed and reserved for the placement of a mobile home.
'..5 Travel Trailer. A vehicle designed to be moved on wheels and intended
as e temporary dwelling for travel, recreati on and vacation use. This
term shall also include camper, camper-trafier and all other similar
short-term shelter devices.
1.6 The words "a lliicaant", 'licensee", or event", of a mobile have pack
are interchangeable unless the context clearly indicates otherwise.

1.1 No mobile home shall be permitted to locate in a duly licensed mobile
home park which does not meet the minimum standards set forth t
publication N.F.P.A. No. 5OIA-1064 Standard for Fire protection In
Trailer Courts and N.F.P.A. No. 501E-1068 Standard for Mobile
Homes.
1.2 For purpose of this Ordinance, travel trailers are not considered as
mobile Fames, and. therefore, are not regulated by the provlsions of
this Ordinance.

dR'I'ICl.E 4 - PERMITS AND LICENSEE

1.1 Application shall be made to the City Clerk for a 'Mobile Home Perk
Construction Permit".
1.3 The applicant shall file with the application proof of ownership of
the premises or of a lease or written permission from the owner.
1.3 The applicant shall file with the application three copies of plane
of the proposed mobile home park, drawn toe scale of not more than
1W feet to the inch, showing the following information:
1.3.1 Names) and address(es) of caner and applicant.
1.3,3 The area and dimensions of the tract of lend, including
contours at an interval of no more than 5 feet. This
information shell be derived or approved by a registered
land surveyor.

1.3.4 The location, size and use of any existing or proposed buildings:
1.3.5 The resume of abutting property owners.
1.3.6 The location end width of rights-of-way, street pavements,
and walkways.

and the location and type of sewage and refuse disposal
facilities.
1.3.8 The results of soil percolation testa made in a representative
manner by a registered engineer. Mere public sewer Is available
this requirement shell be weaved.
1.3.4 Location and types of landscaping, as required under
Article 5, Sec. 1.11 of this Ordinance.
1.3.10 Location and types of recreation a:eea.
1.4 The plan o ompanying the application for such permit shell be
reviewed by the Zoning and Code Enforcement Officer, the Health
Officer, and the City Engineer. These officials shell review the
proposal for compllence with the requirements of this Ordinance
and other applicable City ordinances and shell report their findings
in a recommendation, through the Planning Board, to the City Council.
1.5 with due consideration to the recommendations; of the Zoning and
Cade Pn£oroement Officer, the Health Officer, and the City Engineer,
the Planning BoerB shall review the proposal in order to determine

will be taken on the application.

ARTICLE 5 - DEVELOPMENT REQUIREMENTS
Sec. I New or Expanded Mobile Home Parks. New mobile home parka and expansions
of existing mobile home parka shall conform it the following minimum
requirements, unless otherwise modified int
ordan with the special
provisions set forth in Section 3 of this Article:
1.1 Mobile Home Parks may be authorised for development only in Agricultural
Zones.
1.3 Mobile Home Parks shall be located on a well drained site
properly graded to insure rapid drainage and freedom Erse
stagnant pools of water. The site shall not be exposed to
objectionable smoke, noise odors or any other adverse influences,
and no portion subject to unpredictable sudden flooding, subsidence
or erosion shall be used for any purpose which would expose pets=a
or property to hazards.
1.3 A Mobile Home Park shall be located on a single parcel of land'
having a minimum area of 15 acres.
1.4 All mobile homes shall be located at least 50 feet from all mobile
been park boundary lines and shall be screened from adjacent
Properties and public streets in. accordance with $sell= 1.11 of
this Article.
1.5 A minimum of 25 mobile home lots shell be completed and provided
with all utilities. streets, and sidewalks as required by this
Ordinance before occupancy of the mobile home park shell be permitted.
1.6 All mobile Fames shall contain hot leas than 450 square feet of
floor area.
1.1 Lot si,e and Set Back Requirements:
1.7.1 Each Individual mobile home lot stall be not lees than
6.000 square feet in area,
and shell not be lees than 50
feet vide and 100 feet deep.
1.7.2 No mobile home shall be located less than 10 feet from the
aide and 20 feet from the rear lines of s individual mobile
Fame lot. and there shall be a mirlmum distance of 20 feet
between adjacent mobile Fames.
1.1.3 No mobile home shall be located less than 20 feet from the
right of way line pf any street, or lees than 40 feet from
a service building: within the Park.
1.8 Streets, Walks and Parkin$
1.8.1 All mobile home Walks shall be provided with safe and
convenient vehicular access from abutting public streets or
roads to each mobile bass l Pt. All Park streets shall be

well drained, paved, maintained in good condition, and
at night adequately lighted. Ali streets within the perk
aba ll have a minimum right of way width of 50 feet.
Pavement width shall be no less than 56 feet where parking
is permitted on both sides of the street. Where perking is
permitted on only me side of a street the minimum pavement
width shall be 28 feet and where all on -street parking is
prohibited the minimum pavement width shall be 20 feet.
1.8.2 All streets within a mobile have park shall be cow tructed
to standards specified in the Subdivision Ordinance of the
City of Bangor, Article 12, Section 1, Subsections 1.1
through 1.5.
1.8.3 A11 streets within a mobile home park shall be furnished
with lighting units to provide the following average
maintained levels of illumination:
(1) All parts of street system 0.6 font candle, with a
minimum of 0.1 foot candle.
(2) Street intersections, steps orramps: individually
illuminated witb a minimum of 0.3 foot candle.
1.8.4 Dead and streets shall be limited in length to 1,000 feet
and at the closed and shall be provided with a turn -around
baying a minimum radius of 50 feet.
1.8.5 Paved walkways not leas than three feet in width she It

1.8.6 Pan off-street parking spaces shall be provided an each
mobile home lot.
1.9 Mobile home lots shall provide an adequate stand, approved by the
Zoning and Code Enforcement Officer, for the placement of a mobile

shifting, or settling as a result of front action, poor drainage
or other such forces.
1.10 All individual mobile homes shall be cr.nlpped with skirting or other
type of enclosure.
1.11 landscaping.
1.11.1 where possible, existing trees shall be preserved, and mobile
home stands shall be oriented with respect to scenic vistas,
natural landscape features, topography. and natural drainage

1.11.3 Screen planting, providing a dense visual barrier at all
times, shall be provided around the boundaries of the park
and around laundry drying yards, garbage and trash collection
stations, non-residential uses, and along rear lot lines of
all mobile home iota. Screens shall consist of shrubs o
trees at least five feet wide and, at the time of planting,
t least four feet in height, and eventually reaching a
mature height of at least six feet. The screen planting
zone extending along boundary linea shall have a minimum
width of 15 feet.
1.11.4 Other planting shell be provided and shall be adequate in
ales, quantity and character to provide an attractive
setting for the mobile homes and other improvements, to
provide adequate privacy and pleasant outlooks for living
units, to minimize reflected glare and to afford Sumer shade.
1.12 Recreation areas
shall be provided for the a of mobile home park

600 square feet for each mobile home let in the development, with n
single c eatlon area being lees than 15,000 sq. ft. Such a shall

1.13 All transformer boxes, substations, pumping Stations and meters shall
be located and designated as not to be unsightly or hazardous to the
public.
1.14 Any construction of, or in, a mobile home park shall he done according
to the approved plan and shall be completed no later than the expiration
date of the Mobile Home Perk Construction Permit.
Sec. 2 exiatine Mobile Nome Perks. Mobile M1eme parka in existence prior to the
effective date of this Ordinance atoll conform to the following regulations:
2.1 Nt thin 90 days after said effective date the owner or operator of such
park shell be required to submit to the Zoning and Code Enforcement
Officer a &metal site plan of the park, shoving the following in-
formation as it existed on the effective date of this Ordinance,
2.1.1 Name(s) and address(es) of the ower and operator.
2.1.2 Area and dimensions of the park.
2.1.3 Number, location, size and shape of all mobile home lots.
2.1.6 Number, location and size of all mobile homes and buildings.
2.1.5 Location and width of all streets and watkways.
2.1.6 Approximate Location and size of enter, sewer, gas and other
utility and sewage disposal facilities.
2.2 The coverage of any lot shell not be increased over that existing
m the effective date of this Ordinance, or in the case of tots
umoccupied by mobile homes on such date. lot coverage shall not be
increased wewhat it was when last occupied prior to the effective
date of this Ordinance.
Sec. 3 Special Provisions. Notwithstanding other provisions of this Ordinance
relating to apace, bulk, and use, the Planning Board in reviewing plans
for proposed mobile home parks may modify said provisions to facilitate
Innovative approaches to environmental design, provided that all of the
following standards are maintafneds
3.1 The purpose and intent of this Ordinance shall be upheld.
3.2 There shall be compliance with all state and Local codes and
ordinance..
3.3 Net residential density of the development shall not exceed p mobile
homes per acre.
For purposes of this Ordinance, net residential
density shalt be computed by dividing the total number of mobile have
lots by the total mobile have lot area (En acres).
3.6 In cases of Lots fronting on culs-de-sac or irregular shaped lets
resulting from a curvilinear street pattern, minimum lot size may
be modified by reducing frontage and depth requirements by no more
than 25%.
3.5 Besides open apace accumulated by reduc'_ng lot size requirements
within the allowable density limits shell be added to the required
recreational space and shell be designated as such on the site pian
of the development.
3.6 Front yard setback requirements may be modified by a reduction of up
to 5".
3.7 Side yard requirements may be modifted by a reduction of up to 50%.
3.8 Back yard requirements may be modified by a reduction of up to 50L.

ARTICLE 6 - UTILITIES
lar. 1 Water Supply.
1.1
An accessible, adequate, safe, and potable supply of water shall be
provided in each mobile home park. Where a public water supply
is available, counrection to such system shell be required and its
supply used exclusively. When a public water supply to not available,
a private water supply may be developed and used subject to approval
by the Health Officer, City Engineer and the State Department of
Health and Welfare.

The water supply shall be capable of delivering a minimum of 150
gallons per day per mobile base.
1.3
Every well o suction line of the water supply System shall be located
and constructein such er that neither underground nor surface
contamination will reach the water Supply from any source.
1.4
The water supply system Shall be connected by pipes to all mobile
homes, buildings, and other facilities requiring weber.
1.5
All water piping, fixtures, and other equipment shall be constructed
and maintained in accordance with the State of he ine Law. the State
Plumbing Cede, and local regulations and shall be of a type and in
locations approved by the Zoning and Code Enforcement Officer and the
City Engineer.

2.1

Any mobile home park located within 1000 feet of an axis [fog public
sewer shall be required to provide a sewage system for the park
designed by a registered engineer to connect to de existing public

for the entire mobile home park, designed by a registered engineer,
shall be required.
2.5
Design of all sewer facilities shall require approval of the Health
Officer and the City Engineer.

Distribution System.
3.1
Every mobile boat Park shall contain an electrical wiring system
consisting of wiring, fixtures, equipment end appurtenances whigh
shall be installed and Ws intained inaccordance with all applicable
State of Maine Law and �Ocal codes and reguleti ens governing such
systems. All facilities shall be approved by the Zoning and Code
Enforcement officer.

3.l All electrical distribution facilitiee shell be located underground.
Set. 4 Refuse Disposal.
4.1 The storage, collection and disposal of refuse in the mobile bane
perk shall be so
conducted as to create no health hazards, radent
harborage, insectbreeding areas, accident or fire hazards or air
pollution.
4.3 Each mobile home shall be provided with sufficient flytigM1q watertight,
rodentproof containers to adequately store all refuse. The licensee
shall he responsible for the regular removal of such refuse at least
equivalentto the frequency of the City's collection of such refuse.
Removal wilt be to such places as may be approved by the City.
sec. 5 Fuel Supply and Storage.
5.1 Natural gas and liquified petroleum gas systems shall comply with
all applicable codes and regulations. Installation of systems shall
be subject to inspection and approval by the Zoning and Code Enforcement
Officer.
5.1 All fuel oil supply systems shall be constructed and installed
underground in each mobile lime Sot in accordance with all applicable
c Ades and regulations. Installation of the system shell be subject
to inspection and approval of the zoning and Cade Enforcement Officer.
So,. 6 .Service Buildings. The fallowing requirements shell apply is any service
buildings located in a mobile home park, _ncluding management offices, repair
shops, storage buildings, laundry buildings and sanitary facilities.
6.1 Buildings shall meet all requirements of the Building Code of the
City of Bangor.
6.2 All r l containing sanitary facities shell have sound resistant
walls extending to the underside of the roof deck between male and

ary facilities. Wells and partitions around lavatories
and other
plumbing fixtures shall be constructed of dense, nonabsorbent,
waterproof material or covered with apermanent-type moisture
resistant materiel.
6.3 Plumbing in any service building shell meet all requirements of the
State Plumbing Came.
ARTICLE ] - NISCRLLANROUS REQUIRRItENTS
Sec. L Responsibilities of the Licensee[
1.1 The licensee shell operate the park in compliance with this
Ordinance and shall provide adequate supervision to maintain
the park, its facilities and equipment in good repair and in
clean and psaltery condition.
1.2 The Licensee shell notify park occupants of all applicable
provisions of this Ordinance and inform them of their duties
and responsibilities thereunder.

connected to water, sewerage, and electrical utilities. The
licensee she 11 be responsible for the proper placement of
each mobile home stand and for the proper installation of all
utility connections. The licensee shell also be responsible
for the disconnection of all utilities prier to the departure
of a mobile home.
1.4 The licensee shall maintain a register containing the names
of all park occupants. Such register will be available to
any civil authority inspecting the park.
1.5 The license certificate shall be conspicuously posted in the
office of or on the premises of the mobile home park at all
times.

ARTICLE B - ENFORCEMENT, APPEAL, PENALTY, SEPARABILITY
See. 1 Ruforcement
1.1 Inspections. The Zoning and Code Enforcement Officer and Health
Officer, or their duly authorized representatives, are hereby
authorized and directed to make inspections to determine the conditions
of a mobile home pack located within tfe City of Bangor in order that
he may perform his duty of safeguarding the health and safety of
occupants of mobile home parka and of the general public. Said officers,
r their duly authorized representatives, shall have the power to enter
at reasonable times upon any private or public property for the purpose
of inspecting or investigating conditions relating to the enforcement
of this Ordinance
1.2 Violation Procedure. If, after any inspection, the Zan Ing and Code
Enforcement Officer or the Health Officer has knowledge or has team=
to believe that a violation of any provision of this Ordinance or any
provision incorporated herein exists, :be said Officer shall issue a
written order requiring a showing of compliance within SO days of
issuance. Such order shall c ontain a description of the violation
or aspected violation and shall be directed to and served on the
alleged offender and the owns of the mobile home park. Service
shall be by mail or personals if compliance is not shown within the
30 days, the Zoning and Code Enforcement Officer shall notify the
municipal officers for the purpose of taking curt action.
1.3 Violations. Any condition existing in violation of any prevision of
this or of any provision incorporated herein is a nuisance.
Sec. 2 Appeal
2.1 Any person aggrieved by an order or decision of any officer or board
under this Ordinance may file a written request for a hearing before
the municipal officers within 30 days after issuance of such order or
decision. The municipal
cipal officers shall publish notice of a public hearing
on this request to be held not less than > days after publication.
Publication shall be by printing in a newspaper of general circulation
In the municipality and by personal service or by mail on the person
requesting the hearing. At such hearing the municipal officers shall
determine whether the order or decision appealed from was in accordance
with the provisions of this Ordinance and the provisions incorporated
therein. Themicipal office shall issue written findings of fact,
conclusions of law, and its order to carry out the findings and
conclusions. These findings, conclusions and order shall be filed with
the municipal clerk and served by the municipal officers upon all
parties appearing or represented at the hearing. Failure so issue such
written findings, conclusions and order within Jo days of the appeal
shall constitute a denial.
2.2 An appeal may be taken to Superior Corrt within JO days of the order
of the municipal officers.

to the revision of the City's Mobile Henry Ordinance.

ARTICLE 2 - DEFINITIONS
See. 1Definitions
1.1 Mobile Home. A vehicular portable structure built on
achests of

dwelling forone or mere persons, and provided with a toilet and
a bathtub or shower.
1.2 Mobile Home Park. A parcel of land under single ownership which
has been planned and improved for the placement of mobile homes
for non -transient use.
1,3 Mobile Home Lot. net a within a mobile home park that provides
facilities for long term occupancy of a mobile home and is designed
for the exclusive use of its occupants.
1.4 Mobile Home Stand. Met part of an individual mobile home lot which
has been constructed and reserved for the placement of a mobile home.
1.5 Travel Trailer. A vehicle designed to be moved o wheels and intended
as a temporary dwelling for travel, c eation and vacation u This

ARTICLE 3 - GENERAL PROHIBITIONS
Sec. 1 General Prohibitions.
1.1 No mobile home shall be permitted to locate in a duly licensed mobile
home park which does not meet the minimum standards set forth in
publicoH con N.F.P.A. No. 501A-1964 Standard for Fire Protection in
Trailer Courts and N.F.P.A. No. 50IB-1968 Standard for Mobile
Homes.
1.2 For purpose of this Ordinance, travel trailers are not considered a
mobile honses. and, therefore, are not regulated by the provisions of
this Ordinance.

ARTi CLF 4 - PERMITS AND ciCENSES
Sec. 1 Construction Permit. No person, firm or corporation shall construct a

1.1 Application shall be made to the City Clerk for a "Mobile Rome Park
Construction Permit".
1.2 The applicant shall file with the application proof of Ownership of
the premises or of a lease or written permission from the owner.
1.3 Tye applicant shall file with the application three copies of plans
of the proposed mobile home park, drawn to a scale of not more than
100 feet to the inch, showing the following information:
1.3.1 Name(a) and address(es) of owner and applicant.
1.3.2 The area and dimensions of the tract of land. including
contours at an interval of no more than 5 feet. This
information shall be derived or approved by a registered
land surveyor.
1.3.3 The number, location, sloe and shape of all mobile borne lots
and the locations of mobile home stands on each lot.
1.3.4 The locati on, 'size and use of any existing or proposed buildings.
1.3.5 The comes of abutting property owners.
1.3.6 The location and width of rights-of-way, street pavements,
and walkways.
1.3.7 The location of water, sewer, gas and other utility lines
and the location and type of sewage and refuse disposal
facilities.
1.3.8 The reachA of soil percolation tests made in
arepresentative
scatter by a registered engineer. Where public sewer is available
this requirement shall be waived.

Article 5, Sec. 1.11 of this Ordinance.
1.3.10 Location and types of recreation areas.
1.4 The plan a ompanying the application for such permit shall be
reviewed by the Zoning and Code Enforcement Officer, the Health
Officer, and the City Engineer. These officials shall review the
proposal for compliance with the requi of this Ordim

and other applicable City Ordinance$ and shall report their findings
in a recommendation, through the Planning Board, to the City Council.

1.5 with due consideration t the recommendations of the toning and
Code Enforcement Officer, the Health Officer. and the City Engineer,
the Planning Board shall r the proposal i order to determine
the suitability of the site and the adequacy of the design and
arrangement of lots, streets, walkways, street lighting, recreation
and off-street parking facilities, landscaping and the utilities
as required under Article 6 of this Ordinance. The Board shall
hold a Public Hearing on the proposal not lees than 10 days after
notice of such hearing has been published in awspaper of general
circulation in the City of Bangor. The Board shall then report
s findings (together with copies of the recommendations of the
Zoning and Code Enforcement Officer, the Health Officer, and the
City Engineer) in a
recommendation to the City Council. where final
action will be taken on the application.
1.6 The fee for a Mobile Home Park Construction Permit shall be

Sec. 2 Operator's License. No person, firm or corporation shall operate o

ARTICLE 5 - DEVELOPMENT REOOIREMENTS
Sec. 1 New or Expanded Mobile Hone Parks. New mobile bome parks and expansions
of existing mobile home parka shall conform to the following minimum
requi e
requirements. unless otherwise modified i accordance with the specal
provisions set forth in Section 3 of this Article:
1.1 Mobile Home Parks may be authorized for development only in Agricultural
Zones,
1.2 Mobile Home Parks shall be located on a well drained site
properly graded to i rapid drainage and freedom from
mgnant pools of water. The site shall not be exposed to
objectionable smoke, noise, odor any other adverse influences,
and no portion subject tounpredictable sudden flooding, subsidence
or steel on shall be used for any purpose which would expose persons
r property t0 hazards.
1.3 A Mobile Home Park shall be located on a single parcel of land
having a minimum area of 15 acres.
1.4 All mobile homes shall be located at least 50 feet from all mobile
home park boundary lines and shall be screened from adjacent
properties and public streets in accordance with Section 1.11 of
this Article.
1.5 A m of 25 mobile home lots shall be completed and provided
withallutilities, streets, and sidewalks as required by this
Ordinance before occupancy of the mobile home park shall be permitted.
1.6 All mobile homes shall contain not leas than 450 square feet of
floor area.
1.7 Lot site and Set Back Requirements:
1.7,1 Each individual mobile home lot shall be not less than
6,000 square feet in area,
and shall not be less than 50
feet wide and 120 feet deep.
1.7.2 No mobile home shall be located leas than 10 feet from the
side and 20 feet from the rear lines of an individual mobile
home lot, and there shall beinimum distance of 20 feet
between adjacent mobile homes. m
1.7.3 No mobile home shall be located leas than 20 feet from the
right of way line of any street, r less than 40 feet ft=
a service building, within the park.
1.8 Streets. Walks and Parking
1.8.1 All mobile home parks shall be provided with safe and
convenfent vehiculars m
s from abutting public streets o
roads to each mobile honelot, All park streets shall be

well drained, paved, maintained in good condition, and
at night adequately lighted. All streets within the park
shall have ti right of way width of 50 feet.
Pavement width shall be no leas than 36 feet where parking
is permitted on both sides of the street. where parking i

28 feet and where all on -street parking is
prohibited the minimum pavement width shall be 20 feet.
1.8.2 All streets within a mobile home park shell be constructed
to standards specified in the Subdivision Ordinance of the
Cityof Bangor, Article 12, Section 1, Subsections 1.1
through 1.5.
1.8.3 All streets within a mobile home park shall be furnished
with lighting units to provide the following average
maintained levels or illumination:
(1) All parts of street system 0.6 foot candle, with
a minimum of 0.1 foot candle.
(2) Street intersections, stepsramps: individually
illuminated with a minimum of 0.r3 foot candle.
1_8,4 Dead end streets shall be limited in length to 1.000 feet
and at the closed end shall be provided with a tum -around
having a minimum radius of 50 feet.
1.8.5 Paved sidewalks not less than four feet to width shall be
provided on at least one side of every street within the
mobile home park,
1.8.6 Paved walkways not less than three feet inwidth shell
connect each mobile home stand to a paved sidewalk, to
epaved street or to a paved driveway connecting to a paved
street.
1.8.7 Two off-street parking spaces shall be provided on each mobile
home lot.
1.0 Mobile home lots shall provide an adequate stand, approved by the
Zoning and Code Enforcement Officer, for the placement of a mobile

shifting, or settling as a result of frost action, poor drainage or

1, 10 All individual mobile homes shall be equipped with skirting or other
type of enclosure.
1.11 Landscaping.
1.11.1 Where possible, existing trees shall be preserved, and mobile
home stands shall be oriented with respectto scenic vistas,
natural landscape features, topography, and natural drainage
1,11.2 Lawn and other ground cover shall be installed on all areas
rept those covered by structures, paved or
surfaced areas

and planting beds, and undisturbed a such as oods and
ravines which are to be preserved in their natural state.
1.11.3 Screen planting, providing a dense visual barrier at all
times, shall be provided around the boundaries of the park
and around laundry drying yards., garbage and trash collection
stations, non-residential uses, and along rear lot lines of
all mobile home lots. Screens shall consist of shrubs o
trees at least five feet vide and, at the time of planting,
at least four feet in height, and eventually reaching a
mature height of at least six feet.Thesn planting
wiextending along boundary lines shall have a minimum
dth of 15 feet.
1.11.4 Other planting shall be provided and shall be adequate in
size, quantity and character to provide an attractive
setting for the mobile banes and other improvements, to
provide adequate privacy and pleasant outlooks for living
units, to minimize reflected glare and to afford Sumer shade.
1.12 Recreation areas
shall be provided for the u of mobile home park

be sily accessible to all park residents, located so as to be free
of traffic hazards and, where topography permits, centrally located.
Any buildings provided for recreation

toilet facilities. The number and location of such facilities shall be
determined by the Planning Board and the Health Officer.
1.13 All transformer boxes, substations, pumping stations and meters shall
be located and designated as not to be unsightly or hazardous to the
public.
1.1.4 Any construction of, or in, a mobile home park shall be done according
to the approved plan and shall be completed no later than the expiratt on
date of the Mobile Home Park Construction Permit.
Sec. 2 Existing Mobile Home Parks. Mobile Fame parks in existence prior to the
effective date of this Ordinance shall conform to the following regulations:
8.1 Within 90 days after said effective date the owner or operator of such
park shall be required to submit to the Zoning and Code Enforcement

2.1.1 Name(s) and address(es) at the owner and operator.
2.1.2 Area and dimensions of the park.
2.1.3 Number, location, size and shape of all mobile home lots.
2.(.4 Number, location and size of all mobile homes and buildings.
2.1.5 Location and width of all streets and walkways.
2.1.6 Approximate location and size of water, sewer, gas and other
utility and sewage disposal facilities.

Sec. 3 Special Provision Notwithstanding other provisions of this Ordinance
relating to apace, bulk, and use, the Planning Board i reviewing plans
for proposed mobile home parks may modify said provisions to facilitate
innovative approaches to environmental design, provided that all of the
following standards are maintained:
3.1 The purpose and intent of this Ordinance shall be upheld.
3.2 There shall be compliance with all state and local codes and
ordinances.
3.3 Net re sidential density of the development shall not exceed ] mobile

of this Ordinance, n residential
density shell be computed by dividing the total number of mobile home
lots by the total mobile home lot area (in acres).
3.4 In bases of lots fronting on culs-de-sac or
zregular shaped lots
resulting from curvilinear street pattern, minimum lot size may
be modified by reducing frontage and depth requirements by no more
than 25%.
3.5 Residual open space accumulated by reducing lot size requirements
within the allowable density limits shall be added to the required
recreational space and shall be designated as such on the site plan
of the development.
3.6 Front yard setback requirements may be modified by a reduction of
up to 50%.
3.7 Side yard requirements may be modified by a reduction of up to 501.
ARTICLE 6 - UTILITIES
Sec, 1water Supply.
1.1
An accessible, adequate, safe, and potable supply of water shall be
provided in each mobile home park. Where a public water supply
is available, c connection to such system shall be requited and its
supply used exclusively. Hien a public water supply is notavailable,
privatewater
eslmay be developed and used subject to approval
by Health
h Officer, City Engine and the State Department f
Healthand Welfare.
1.2
The water supply shall be capable of delivering a minimum of 150
gallons per day per mobile home.
1.3
Every well or suction line of the water supply system shall be located
and constructed in such anr that neither underground nor surface
contamination will reach the water supply from any source.
1.4
The water supply system shall be c ounnected by pipes to all mobile
bmmes, buildings, and other facilities requiring water.
1.5
All water piping, fixtures, and other equipment shall bec nstructed
and maintained i accordance with the State of Maine law, the State
Plumbing Cade, andlocal regulations and shall be of a type and in
locations approved by the Zoning and Code Enforcement Officer andthe
City Engineer.
Sec. 2 Sewage
Disposal.
2.1
Sewage disposal systems shell comply with all State of Maine Laws,
the State Plumbing Code and local codes and ordinances.
2.2
Any mobile home perk located within 1000 feet of an existing public
[ shell be required to provide a sewage system for the park
designed by a registered engineer to connect to die existing public

Septic sewage disposal systems for individual mobile homes in
a
mobile home park shell be prohibited.
2.4
If public sewer is unavailable, a sewer system and treatment facility
far the a mobile hase park, designed by a registered engineer,
shall be required.
2.5
Design of all sewer facilities shall require approval of the Health
Officer and the City Engineer.
Set. 3 glectricel Distribution System.
3.1
Every mobile Lure park shall contain aa electrical wiring system
consisting of wiring, fixtures, equipment and appurtenances which
shall be installed and maintained in accordance with all applicable
State of Maine Law and local codes and regulations governing such
Systems. All facilities shall be approved by the Zoning and Code
Enforcement Officer.

3.2 All electrical distribution facilities shall be located underground.
Sec. 4 Refuse Disposal.
4.1 The storage, collection and disposal of refuse in the mobile hone
park shall beso onducted as to create no health hazards, rodent
i
harborage, nsect breeding areas, accident or fire hazards or air
pollution,
4.2 Each mobile have shall be provided with sufficient flytigbt, watertight,
rodentproof containers to adequately store all refuse. Its licensee
shall be responsible for the regular removal of such refuse at least
equivalent to the frequency of the City's collection of such refuse.

Sec. 5 Fuel Battle and Staining
5.1 Natural gas and liquified petroleum gas systems shall empty with
all applicable codes and regulations. Installation of systems shall
be subject to lnspecti on and approval by the Zoning and Cade Enforcement
Officer.
5.2 All fuel oil supply systems shall be constructed and Installed
underground in each mobile home lot in accordance with all applicable
codes and regulations. Installation of the system shall be subject
to inspection and approval of the gaming and Code Enforcement Officer.
Sec. 6 Service Buildings. The following requirements shall apply to any service
buildings located iu a mobile ficme park, including management offices, repair
shops, storage buildings, laundry buildings and sanitary facilities.
6.1 Buildings shall meet all requirements of the Building Code of the
City of Bangor.
6.2 All r containing sanitary facilities shall haveand resistant
walls extending to the underside of the roof deck between ms Is and
female sanitary facilities. Walls and partitions around lavatories
and other plumbing fixtures shall ber onstructed of dense, n neban
sarbt,
waterproof material or covered with apermanent-type moisture
resistant material.
6.3 Plumbing in any service building shall meet all requirements of the
State Plumbing Code.

ARTICLE ] - MISCELLANEOUS REQ01REMENTS
Sec. 1 Responsibilities of the Licensee
1.1 The licensee shall operate the park in compliance with this
Ordina and shall provide adequate supervis on to maintain
the park, its facilities and equipment in good repair and in
clean and sanitary condition.
1.2 The licensee shall notify park os cupants of all applicable
provisions of this Ordinance andinform them of their duties and
responsibilities thereunder.
t.3 A mobile home shall not be occupied for dwelling purposes unless
t is properly placed on a mobile here stand and connected to
water, sewerage, and electrical utilities. The licenseeshall
responsible esponsible for the proper placement of each mobile bore stand
and for the properrnstallation of all utility connections. The
licensee shall also be responsible for the disconnect£ on of all
utilities prior to the departure of a mobile home.
1.4 The licensee shall maintain a register containing the names
of all
park occupants. Such register will be available to any civil
authority inspecting the park.
1.5 The licensec ertificate shall be conspicuously usly posted in the office
of or on thepremises of the mobile homepark at all times.
1.6 The licensee shall be responsible for notifying the Assessor of the
arrival orimpending departure of any mobile base or change of
ownership that occurs within the park.
Sec. 2 Occupancy Permit for Mobile Homes Within a Mobile Home Park
2.1 No mobile home ,ball be erected, used or occupied until a certificate
of occupancy shall have been Issued by the Zoning and CodEnforcement
Officer upon application in writing.
2.2 The certificate of occupancy shall certify that the mobile home meets
the standards set for individual mobile homes and that all required
improvements with respectto the location of such mobile home in a
mobile here park have been completed. Required improvements with
respect to the location of a mobile home shall include a water supply
system, a sewage disposal system, a power supply system, a mobile home
stand, a way, a parking a Leets, street lights and walks
and shall meet r
the standards set forth and incorporated in this
Ordinance.
2.1 'The application for acertificate

applicant and directedto the Zoning and Code Enforcement Officer,
shall be submitted in such form as the Zoning and Code Enforcement
Officer shall prescribe and shall be accompanied by a fee of $

2.5 Issuance of the certificate shall constitute a permit for the
erection and occupancy of such mobile b me

ARTICLE B - ENFORCEMENT, APPEAL, PENALTY, SEPARABILITY
Sec, i Enforcement.
1.1 Inspeerctions. The Zoning and Code Enforcement Officer and Health r
Offictheir duly authorized representatives,are hereby
authorized and directed to make inspections to determine the conditions
of a mobile home park located within the City of Bangor in order that
be may perform his duty of safeguarding the health and safety of
occupants of mobile bone parks and of the general public. Said officers,
or their duly authorized representatives, $bail have the power to enter
at reasonable times upon any private or public property for the purpose
of inspecting or investigating conditions relating to the enforcement
of this Ordinance
1.2 violationProcedure. If, after any inspection, the Zoning and Code
Enforcement Officer or the health Officer has knowledge or has reason
to believe that a violation of any provision of this Ordinance or any
provision incorporated herein exists, the said Officer shall is
written order requiring a showing of compliancewithin 30 days of
a
issuance. Such order shall contain a description of the violation
or aspected violation and shall be directed to aid served on the
alleged offender and the own of the mobile home park. Service
shall be by mapersonal.

municipal officers for the purpose of taking court action.
1.3 Violations. Any condition existing In iolation of any provision of
This -Ordinance or of any provision incorporated herein is a nuisance.
Sec. 2 Appeal.
2 1 Any person aggrieved by an order or decision of any officer or board
under this Ordinance may file a written request for a hearing before
the murltipal officers within 30 days after issuance
of such order o
decision. The municipal officers shall publish notice of a public hearing
n this request to be held not less than ] days after publication.
Publication shall be by printing in a newspaper of general circulation
n the municipality and by personal service o
r by mail a the person
requesting the bearing. At such hearing the municipal officers shall
determine whether the order or decision appealed from smsaccordance
with the gravies Are of this Ordinance and the provisions incorporated
therein. The municipal officers shall i written findings of fact,
conclusions of law, and its order t carry the findings and

These findings, nclus and order shall be filed with
the municipal clerk and served by themunicipal officersupon all
parties appearing o represented at the hearing. Failure to issue such
written findings, conclusions and order within 30 days of the appeal
shall constitute a denial.
2.2 An appeal may be taken to Superior Court within 30 days of the order
of the municipal officers.
Sec. J Penalty. any pers on found in violation of any provision of this Ordinance
or any provision incorporated herein shell be fined not more then $100
plus oats. Each that a violation continues shall be deemed a separate
offense.
Sec. 4 Separability. If any section, subsection, a nclause, phrase o
portion of this Ordinance fa for any reason held i valid o unconstitutional
by any court of competent Jurisdiction asuch portion shell hedeemed e
separate, distinct and independent provision and such holding shall not
affect the validity of the remaining portions hereof.
