One at the corner of Broadway and Burleigh Road One 100 feet east of the intersection of Broadway and ala gave notes by reusing the some to be published in the BANCa9 Batty Ngwe, newspaper printed in aid city, for me week prior to the7th_e£..Nay.._. 1973_. _copy of said order arta notices, so passed and published, is hereto counsel anduude part of this report And Mat the said City Engineer and at the time and place of meeting specified in the notices and primordial to lay out said Burleigh Road widening follows: Beginning at the intersection of the northerly right-of-way line of Burleigh Road and the easterly right-of-way line of Broadway; thence in a northerly direction along the easterly line of Broadway for a distance of 9.00 feet; thence deflecting 1351 to the east for a distance of 12.73 feet to a point on the northerly right-cf- way line of Burleigh Road; thence inawesterly direction along the northerly line of Burleigh Road for adistance of 9.00 feet to the point of beginning. The above described parcel, containing 40.37 square feet, is to be acquired for right-of-way purposes, and i part of land owned by James A. and Beatrice B. Elliott, as acquired by a deed dated April 9, 1957, and recorded in Penobscot Registry of Deeds, Volume 1573, Page 336. The southeasterly intersection of Burleigh Road and Broadway is also widened by the following acquisition: beginning at the intersection of the southerly right-of-way line of Burleigh Road and the easterly right-of-way line of Broadway; thence inasoutherly direction along the easterly line of Broadway fox adistance of 4.00 feet; thence deflecting 1351 to the northeast for a distance of 5.66 feet to a point on the southerly right-of-way line of Burleigh Road; thence in a westerly direction along the southerly line of Burleigh Road for a distance of 4.00 feet to the point of beginning. The above described parcel, containing 7.98 square feet is part of property owned by Ruth Kaufman, acquired by a deed dated October 2, 1970 and recorded in Penobscot Registry of Deeds, Volume 2197, Page 686. In addition to the land acquisitions described above, temporary grading easements and drainage easements are to be established a shown on aplan prepared by the City of Bangor Engineering Department entitled "Broadway -Burleigh Road Intersection Reconstruction and Broadway Storm Sewer, Right -of -Way and Easement Plan" dated October 1973, Plan No. C -48A, Sheet 1 of 1, which is on file in the office of the City Engineer, said easements generally described as follows: Drainage Easements: On land owned by Ruth Kaufman as described above, the right to install and maintain ditches at the northwesterly corner of said property, and to install and maintain a storm water culvert inlet leading from the northwesterly corner of said property. On land owned by James A. and Beatrice B. Elliott as described above, the right to install and maintain a storm water culvert across the westerly edge of said property for a distance of approx- imately 75 feet; also the right to improve and maintain the existing ditch located on the northerly edge of said property, and to install and maintain a culvert inlet leading from the northwesterly corner of said property. Page 2 Temporary Grading Easements: On the property owned by Ruth Kaufman as described above, the right to regrade the side slopes onto the norlherly and easterly edge of said property within the limits shown on the above described sight -of -way plan. On land owned by James A. and Beatrice B. Elliott, the right to regrade the westerly and southerly edge of said property within the limits shown on the above described sight -of -way plan. On land owned by Judson M. Grant, Jr., acquired by a deed dated August 2, 1973 and recorded in Penobscot Registry of Deeds, Volume 2390, Page 277, the right to regrade the southerly edge of said property within the limits of work shown on the above described right-of-way plan. No person or persons appeared at the time and place set for the hearing. However, in a previous conversation on Thursday, October 25th with Dr. James Elliott and his attorney, Paul F. Eendzian, the proposed land acquisition and easements were dis- cussed as they relate to Dr. Elliott's property. They were in- formed that the City hoped to have the storm sewer installed this fall, so as to allieviate the flooding condition which normally curs during the winter and spring rains. They were also told that it was doubtful that any of the proposed r onstruction of the Burleigh Road Intersection would be a complished this year, but would be undertaken next spring when weather conditions permit. They were advised that the existing driveways on Burleigh Road and Broadway would be regraded to meet the new street grades, and would r a bituminous concrete surface to the limits of the regrading. Dr. Elliott pointed out that the right-of-way plan did not show an existing driveway located on the Broadway side of his property, and this driveway was subsequently added to the right- of-way plan. Dr. Elliott also expressed concern about a fist- ing overflow pipe from his well which presently dischargesinto the existing roadway ditch. He was advised that the line could be connected ected into the storm sewer. With regard to possible backup from the storm sewer, the City Engineer indicated that this would be unlikely, but that Dr. Elliott could install a check valve in his line to prevent such backup. No damages are recommended for the acquisition of the temporary grading easements or the storm sewer a ents. However, pay- ment in the amount of $25.00 to Dr. Elliott is recommended for Page 3 the land acquisition on the southwest corner of his land, and damages in the amount of $10.00 are recommended to be paid to Ruth Kaufman for the land acquisition at the northwest corner of her land. it i ended that the land acquisition and the temporary gradinge and drainage easements be established as described above.
