Chair Huhn called the meeting to order at 7:00 P.M.
LAND DEVELOPMENT PERMIT APPLICATIONS:
1. Land Development Permit Application for Site Development Plan – Map-Lot R39-002 – Sun Birch Hill
Estates – High Density Residential (HDR) District – Applicant; Sun Birch Hill, Agent: ArtifexAE –
Land Development Permit application for Site Development Plan for new playground, approximately
100’x100’, 20’x22’ covered slab, and 36’x50’ basketball court with paved walkway, approx. 3,980 s.f. new
impervious surface. Applicant; Sun Birch Hill, Agent: AritfexAE.
Member Brush indicated he lives in Birch Hill, doesn’t have interest in project, just within proximity.
Other Member didn’t feel that it was a conflict of interest.
Rashelly Lizotte, Civil Engineer with Artifex AE, representing the applicant, provided the following in part
and in substance:
SLODA Permit, transfer of application to new ownership, park sold to Sun Communities
Permitted recreation already approved, will be in that permitted location
Impervious area will be set aside to offset from other areas for future expansion designated for open
space
3,980 s.f. new impervious surface, which is pretty minor for a parcel this large
Vice Chair Perkins inquired about lighting on the project. Lighting existing, per applicant, wasn’t informed
of any modifications. Don’t want people there after dark, suspect that they won’t want it lit. Karen Patterson,
Sun Communities, not intention to light that area. Lighting around that area, but no intention to light this area
at this time.

Member Kenney moves approval of Land Development Permit application for Site Development Plan for
new playground, approximately 100’x100’, 20’x22’ covered slab, and 36’x50’ basketball court with paved
walkway, approx. 3,980 s.f. new impervious surface. Applicant; Sun Birch Hill, Agent: AritfexAE, seconded
by Member Bazinet. All in favor. Motion carries.
2. Land Development Permit Application for Site Development Plan – Map-Lot R31-023 – Broadway –
Shopping & Personal Services (S&PS) District – Applicant; ME CDG 004, LLC, Agent: Biodiversity
Research Institute, Inc.- Land Development Permit application for Site Development Plan for solar
generation facility with a total footprint of 9.9 acres at property located on Broadway, Map-Lot R31-023, in
a Shopping & Personal Services (S&PS) District. Applicant; ME CGD 004 LLC, Agent: Biodiversity
Research Institute, Inc.
Dale Knapp and Chris Byers with Biodiversity Research Institute, representing the applicant, provided the
following in part and in substance:
Low impact project, constructed by putting steel piles into the ground (Driven, or screwed into ground),
no excavation needed, steel racking on top, panels mounted on top, wiring underground except where
it connects into the grid
Project to service Maine businesses and residents, not to be shipped out of state
Plugged into distributed generation lines on Broadway, locally distributed to grid
o Can subscribe as a neighbor in the vicinity
NEC coded fence will surround property, 7’, agricultural style, wooden posts
Small difference is in how panels are mounted to racking, and how racking does (or doesn’t) move –
some projects have fixed panels – these will be fixed, unmoving – fixed tilt oriented to the south
Member Bazinet inquired about the decommissioning cost estimate. Knapp and Byers indicated that the
cost estimate is based on numbers from
Question asked about decommissioning cost estimate. Explained that based on numbers from NYSERDA
(New York State Energy Research and Development Authority), a New York based think-tank that pulls
together numbers. Based on the depth of decommissioning in Maine, it impacts the cost estimate. LD802,
new Maine law, exceeds 3 acres, must submit plan to DEP for approval. Not allowed to take salvage value
out of decommissioning costs. Maine numbers are higher, as they can take salvage value as a credit.
Brush inquired about lease agreement with Grant Realty Corporation and if lease requires a
decommissioning requirement. It is by law required now, per Knapp & Byers. LD802, any project over 3
acres and starts after 10.21.2021, is bound to provide a decommissioning plan and surety prior to
construction. We have this, and it’s by law. Per City Solicitor, ordinance requires decommissioning plan
and surety. Engineer approves estimated amounts, and legal approves surety bond.

Vice Chair Perkins inquired about the confirmation of contract with Versant Power. Knapp/Byer indicated
that they have gotten in the queue to inter-connect. Unsure if they’ve executed their contract, but we needed
verification from the City that this is okay to move forward. Before they can move forward, they wanted to
be sure that permitting was a go. Knapp/Byer indicated that there was a series of processes and phases
through this process. Planning Officer Krieg advised that the communication emails were received.
Confirmation of Utility Connections handled at Code Enforcement prior to Certificate of Occupancy being
issued, per Assistant City Solicitor Saucier.
No staff comments.
Driveway permit to be issued, can be done when they’re ready.

028, 001-007, R25-031,and R25-032 – Applicant; City of Bangor Community and Economic
Development - Land Development Permit Application for Minor Subdivision Modification for the following
parcels of land located in Maine Business Enterprise Park (Maine Avenue, Venture Way, Corporate Drive);
Map-Lots R25-020, R25-027, R25-028, to modify overall subdivision boundaries, and reallocation of open
space to Map-Lots 001-007, R25-031, R25-032, and R25-020. Parcels are located in Airport Development
District (ADD), Technology & Service (T&S) District, and Industry & Service (I&S) District. Applicant; City
of Bangor Community and Economic Development.
John Theriault, City Engineer, presented the following in part and in substance:
Project is a minor subdivision modification for Maine Business Enterprise Park
Site is permitted through DOT & DEP
Minor modifications – there was an older plan which was filed with the Registry of Deeds, wanted to
update when Bangor Water District expressed interest in a parcel for a pump station
There were some things off the previous plan, changed the outside boundary, and reallocated open
space
No staff comments.
Vice Chair Perkins moves approval of Land Development Permit Application for Minor Subdivision
Modification for the following parcels of land located in Maine Business Enterprise Park (Maine Avenue,
Venture Way, Corporate Drive); Map-Lots R25-020, R25-027, R25-028, to modify overall subdivision
boundaries, and reallocation of open space to Map-Lots 001-007, R25-031, R25-032, and R25-020. Parcels
are located in Airport Development District (ADD), Technology & Service (T&S) District, and Industry &

OTHER BUSINESS
4. Comprehensive Plan Updates
BerryDunn recommended with FHI, subconsultant, for the Comprehensive Plan, in negotiations
with contract now
City Staff was present during voting hours at the Cross Insurance Center to engage with citizens
about the Comprehensive Plan, and Economic Development Strategy Project, great interaction
with City residents
Outreach – go anywhere people are, connect during this process – process is as important as
the plan itself, and getting feedback from citizens is an important element of the plan – thinking
about a lecture series, Burlington VT is doing great things, maybe incorporating things from the
conference that they learned – feedback from public about their project, or other projects – what
could work, what might work, what won’t work
5. Meeting Minutes – October 19, 2021 Meeting Minutes for Review approved with
Member Shaw moves approval, seconded. All in favor. Motion carries.
