Summary This Ordinance will amend Chapter 260 to allow murals and artistic signs, by exempting them from sign code requirements. This Ordinance was created to allow murals and artistic signs when (1) the mural or artistic sign is public art subject to the City's Public Arts and Monuments Policy, (2) it has received approval under Chapter 95 of this Code and the most recent Public Art and Monuments policy, (3) it will not create an unsafe condition or hazard for drivers and pedestrians, and (4) a building permit has been issued, if required. WHEREAS, at present, murals and artistic signs are considered signs by definition, WHEREAS, there is interest to allow for murals and artistic signs in the city; BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BANGOR AS FOLLOWS, THAT Chapter 260 of the Code of the City of Bangor is amended as follows: § 260-1 Definitions. For the purposes of interpreting this chapter, the following terms, phrases, words and their derivatives shall have the meanings given herein: MURALS AND ARTISTIC SIGNS Hand -painted, hand -tiled, diaitally-printed, or other created imaaes (which may contain letterina), on or affixed to the exterior wall of a buildina, but which do not contain any advertisina coov, symbols, letterina/font, locos or other such recoanized brandina related to products or services provided on or in the premises or on or in an adjacent or nearby premises. § 260-4 Requirements applying to all signs. The following regulations shall apply to signs in all districts: B. Maintenance. (2) Painted Wwall signs,, painted murals, and painted artistic signs must be re -painted at least every five years. § 260-5 Signs exempt from Permit. Permits are not required for the following signs: 21- 11/22/2021 K. Murals and artistic signs, as defined in this chapter, that meet the reauirements of Section 260- 6L. § 260-6 General standards and limitations. L. Murals and artistic signs are exempt from the restrictions of this chapter, including the calculations for allowed signage, provided that: Li) the mural or artistic sign is public art subject to the City's Public Arts and Monuments Policy; the mural or artistic sign receives approval under Chapter 95 of this Code and the most recently adopted Public Arts and Monuments Policy; (3) the mural will not create an unsafe condition or hazard for drivers and pedestrians; and (4) the appropriate building permit has been issued, if required.
