City Solicitor Chair Huhn called the meeting to order at 7:00 P.M. LAND DEVELOPMENT PERMIT APPLICATIONS: 1. Land Development Permit Application for Minor Subdivision Modification – Rolling Meadow Estates Subdivision – Map-Lots R70-014, R70-034, R70-043, R70-057, R70-058, and R71-052, in a Low Density Residential (LDR) District- Applicant; RSQ, LLC. Agent; Kiser & Kiser c/o Jim Kiser, P.E.- Land Development Permit Application and Minor Subdivision Modification for the following parcels of land located in Rolling Meadow Estates Subdivision; Map-Lots R70-014, R70-034, R70-043, R70-057, R70-058, and R71-052, in a Low Density Residential (LDR) District. Amendment proposes to split one lot, transfer open space to an abutting lot, add land from abutter to open space, and amend drainage easement location. Applicant; RSQ, LLC. Agent; Kiser & Kiser c/o Jim Kiser, PE. Jim Kiser, P.E., and Tricia Quirk, applicant, in attendance. Mr. Kiser presented the following: Creating one additional lot in development, 13-B, by splitting lot 13-A Creating open space to transfer to property abutter by detention basin Cleaning up paperwork on the plan- when the storm drain was installed, it was installed in a different location than what’s shown by the easement on the plan. Is proposing to move the indicated easement location to the other side of the lot (where the drainage is actually located), releasing the approved easement, and putting the easement in correct location on the plan. With approval, the easement will go to Infrastructure Committee to be presented by the City Engineer Addressed property abutter concern- the deed indicated the easement location correctly but the plan did not (cleaning it up) 73 HARLOW STREET, BANGOR, ME 04401 TELEPHONE: (207) 992-4280 FAX: (207) 945-4447 WWW.BANGORMAINE.GOV City of Bangor Planning Division Planning Board Meeting Minutes –October 19, 2021 Unidentified property owner of where the new easement location would be (43 Virginia Lane) stepped up to the podium. Mrs. Quirk showed property owner the difference between the plan and the easement, and where it was to be approved. Property owner and Mrs. Quirk discussed the drainage and easement, Mrs. Quirk stating that the map was incorrectly drawn and that the drainage easement was on the opposite side. Applicant and agent advised that there is no work proposed on the property, but if something was to happen, they would need to gain access to fix the issue. Confirmed that they’re not looking to do anything except change the drainage easement location on the map. Property owner indicated that not all her questions were answered and that she might have to obtain an attorney. Planning Officer Krieg suggested to the Board that any motion to approve contain a condition that the easement gets accepted by the City, if necessary, because the deed already has easement on it, it just wasn’t included in subdivision plan. Planning Officer Krieg noted that the City Engineer indicated he would probably bring this easement to City Council just to confirm it. Vice Chair Perkins moved to approve the Land Development Permit Application for Minor Subdivision Modification for the following parcels of land located in Rolling Meadow Estates Subdivision; Map-Lots R70-014, R70-034, R70-043, R70-057, R70-058, and R71-052, in a Low Density Residential (LDR) District, proposal to split one lot, transfer open space to abutter, add land from abutter to open space and amend drainage easement location, with the addition that the easement be confirmed to transfer to the City through this process. Motion seconded by Member Meagher. Amy Faircloth presented to the podium. Lives at 35 Virginia Lane, next door to property owner from previous discussion. Wanted confirmation that the plan is being amended, not the actual drainage easement. Faircloth stated that she understands that the easement is already located between their homes; just wants confirmation that this motion to approve won’t change anything and that it’s just amending the plan to show where the drainage easement actually is. Kiser indicated that the drainage easement is being amended on the plan. Doesn’t think that any characterization was made that any verbiage or intent or anything else related to the easement was being changed, simply the location of easement on the plan. Vice Chair Perkins amended motion to include wording to amend drainage easement as shown on blueprints currently to an actual existing location. Amended motion seconded by Member Meagher. All members in favor. Motion carries. 2. Site Development Plan – 1 Railroad Street – Map-Lot 043-040-C – Waterfront Development District (WDD) – Applicant; Waterfront Concerts, Agent; Ervin Architecture c/o Robert Ervin, AIA - Land Development Permit Application for Site Development Plan for additional sheet piles to be added to support rear of venue at property located at 1 Railroad Street, Map-Lot 043-040-C, in the Waterfront Development District. Applicant; Waterfront Concerts, Agent; Ervin Architecture c/o Robert Ervin, AIA. Robert Ervin, representing the applicant, presented the following: Page 2 | 4 City of Bangor Planning Division Planning Board Meeting Minutes –October 19, 2021 Primary purpose is to amend earlier submission regarding north west corner. The rear of the venue towards Main Street was originally going to be a concrete retaining wall – economic forces and speed of construction pushed them toward sheet piles, which are more economically effective and readily acquirable. This is similar to the corner that permitted, approved, and built on the other side of venue by the river (also made out of sheet piles). The proposed plan would mirror this on the side heading towards Main Street. In between this corner and Main Street would be the lawn entry into the venue, coming up an ADA ramp, which would allow fans to access bathrooms to the left, or go straight and enter the venue. A lot of this was already permitted, except that the plan is deviating from previously approved materials Bathrooms have already been permitted; is part of new lease agreement with City of Bangor and Waterfront Concerts o Footprint is not changing, adheres to the lease boundary – not deviating in that respect – only deviating from material sensibility on the corner Vice Chair Perkins inquired about longevity of sheet pile wall compared to concrete wall. Ervin indicated that concrete has potential to cause cracking and deconstruction of the wall over time. Sheet pile is fairly rigid, using a non-weathering steel. Sheet pile would last longer. Concrete would stand the test of time, but concrete degrades and cracks. Approximately 2” deviation over time. Ervin would bet on the sheet pile for longevity vs. concrete. No other questions. Member Shaw moved to approve the Land Development Permit Application for Site Development Plan for additional sheet piles to be added to support rear of venue at property located at 1 Railroad Street, Map-Lot 043- 040-C, in the Waterfront Development District. Applicant; Waterfront Concerts, Agent; Ervin Architecture c/o Robert Ervin, AIA. Motion seconded by Chair Huhn. All members in agreement. OTHER BUSINESS 3. Comprehensive Plan Updates No updates at this time. Member Krieg advised members to complete the walk audit and get it turned in! Discussed walk audit and how to obtain the audit sheets, both online and in person. Member Krieg stated that staff will review the results once turned in and see if there were any areas that weren’t covered by the audit. 4. Meeting Minutes – September 21, 2021 and October 5, 2021 Meeting Minutes for Review Meeting minutes of September 21, 2021 were moved for approval by Member Meagher, pending no changes, seconded by Member Shaw. All members in favor.
