certain requirements for Community Development Discretionary Block Grant Funds.

RESOLVED. WHEREAS, the City of Burger wishes to make an application for a
Discretionary Grant and receive Federal funds under Title I of the Housing and
Community Development net of 1974; and,
WHEREAS, Section ICA of the Housing and Community Development
Act of 1974 and Section 570.303(e) of pert 570 of Title 24 of the Code of Federal
Regulations requires that certain Certifications and assurances be given by the
City of Bangor;
NOW, TRENEFORE, BE IT RESOLVED, by the City Council of the City of
Bangor that the City of Banger assures and certifies that:
1. The City of Bangor poeaeeses legal authority to apply for the grant, and
to execute the proposed program; that it hes complied with the regulations, policies,
and gui'delinee of the requirements of W Circular No. A-95 as modified by 24 CFR
Part 570.400(d) and that the required procedures have been followed and n0 comments
or recommendations have been received; and that it will comply with the regulations,
policies, guidelines and requirements of Federal Mensgement Circulars 74-4 and 74-7,
as they relate to the application for acceptance of, and use of Federal funds under
Title I of the Housing and Community Development Act of 1974 (hereinafter referred
to as "this program').
2. It will comply with:
(a) Title VI of the Civil Rights Act of 1964 (P.L. 88-352), and in bon-
formanee with all requirements imposed by or pursuant to the Regulations
of the Department of Housing and Urban Development (24 CFA Part 1) issued
pursuant to that Section, and in accordance with that Section, no person
in the United States shall, on the ground of re , color, or national
origin, be excluded from participation in, be denied the benefits of, or
be otherwise subjected to discrimination under any program or activity
for which the City of Barger receives Federal financial assistance and
will i®etliately take any measures nseeeeary to effectuate this assurance.
If any real property or structure thereon is provided or improved with the
aid of Federal financial assistance extended to the City of Bangor, this
assurance shall obligate the City of Bangor, or in the case of say transfer
of such property, adv transferee, for the period during which the real
property or structure is used for a purpose for which the Federal financial
assistance is extended, or for another purpose involving the provisions of
similar services or benefits.
(b) Tit I Vill of tho Civil Rights Act of 1968, (P. L. 90-284) as imcndvd,
and will administer all progress and activities relating to housing and
comunity development in a scanner to affirmatively further fair housing i
the sale or rental of housing, the financing of housing, and the provision
of brokerage services within the City of Ranger's jurisdiction.
(c) Section 109 of the Housing and Community Development Act of 1074 and
in conformance with all requirements imposed by or pursuant to the Regulations
of the Department (24 CPR Pare 570.601) issued pursuant to that section: and
in accordance such that Section, no person in the United States shall on the
ground of race, color, national origin or sex, be excluded fine participation
n, be denied the benefits of, or be subjected to discrimination under, any
.program or activity funded in whole or in part with fonds provided under
Title I of the Housing and Community Development out of 1974.
(d) Executive Older 11063 on equalopportunity in housing and nondiscrimination
in the sale or rental of housing built with Federal angi8tance.
W Section 3 of the Rousing and Urban Development Act of 1968, as amended
requiring that t0 the greatest extent feasible opportunities for training
and employment be given lower income residents of the project area and
contracts for work in connection with the project be awarded to eligible
business concerns which are located inowned in substantial part by,
persona residing in the area of the project.
(f) Executive Order 11246, and inconformance with all requirement% imposed
by or Pursuant to the Regulations of the Department (24 CPR Part 130) issued
pursuant to that Section: and i cordance with that Section, no person
shall be discriminated against on the basis of race, color; religion, sex
or national origin in all phases of employment during the performance of
Federal or federally -assisted contracts, and that contractors and sub-
contractors will be required to take affirmative action to ensure fair treat -
sent in employment, upgrading, demotion, or transfer; recruitment o re-
cruitment advertising; layoff or termination, rates of pay or other forms
of compensation and selection for training and apprenticeship.
3. Prior to the submission of its application, the City of Bangor has:
(a) Provided citizens with adequate information concerning the amount of
funds available for proposed ecomonity development and Mousing activities,
the range of activities that may be undertaken, and other important program
requirements;
(b) Held two public hearings to obtain the views of citizens on community
development and housing needs; and
(c) Provided citizens an adequate opportunity to articulate needs, express
preferences about proposed activities, assist in the selection of priorities
and otherwise participate in the development of the application.
4. That City of .Bangor will
(a) Provide fair and reasonable relocation payments and assistance i
accordance with Sections 202, 203 and 206 of the Uniform Relocation
Assistance and Real Property Acquisition Policies Act of 1970 (P.L.
91-646) and applicable M regulations (24 CPR Part 42). to or for
families, individuals, partnerships, corporations or associations dis-
placed
-
placed a result of Pay, acquisition of real property for an activity
assisted under this program;
kb) Provide relocation assistance programa offering the services described
n Section 205 of the Act (P.L. 91-646) to such displaced families, indi-
viduals, partnerships, corporations or associations in the roamer provided
under applicable HUD regulations;
(c) Assure that, within a reasonable time prior to displacement, decent,
safe, and sanitary replacement dwellings will be available to such dis-
placed families and individuals in accordance with Section 205 (c)(3) of
P.L. 91-646; and that such housing will be available in the same range of
choices to all such displaced persons regardless of their race, color,
religion, national origin, sex or source of income;
(d) Inform affected persons of the benefits, policies, and procedures -.
provided for weer HUD regulations;wed
(e) Carry out the relocation process in such aas to provide dis-
placed persons with uniform And consistent servicesincluding any services
required to insure that the relocation process does not result in different
or separate treatment to such displaced persons on account of their race,
color, religion, national' origin, sex or source of imome.. _
5. The City of Bangor will:
(a) In acquiring real property inennection with the community develop -
ant block grant program, be guided to the greatest extent practicable
under State law, by the zeal property acquisition policies set out under
Section 301 of the uniform Relocation Assistance and Real Property Acqui-
sition Policies Act of 1990 (P.L. 91-646) end the provision of Section 302
thereof:
(b) Pay 0re
reimburse property owners for necessary expensea. as specified
to Section 303 and 304 of the Act; and
(c) inform affected persons of the benefits, policies, and procedures
provided for under HUD regulations (24 CPR Part 42).
6. It will give RUO and the Comptroller General through any authorized repre-
sentative access to and the right t0 examine all records, books, papers, or
documents related t0 any grants made under this program.
7. It will comply with the provisions of the Hateh Act which limit the
political activity of employees.
B. It will comply with the previsions of: P ecutive Order 11296, relating
to evaluation of flood hazards.
9. Me Community Development Program has been developed so as to give maximum
feasible priority W activities which will benefit lore- or moderate -income
families and aid in the prevention and elimination of slums and blight. where
all or part of the community develolment program activities are designed to
meet other comzunity development needs having a particular urgency, such needs
e specifically described in the application under the Cemmncdty lavelOPment
plan Spry.
10. It will establish safeguards to prohibit emPloyeea from using POaitioes for
a purpose that is or gives the appearance of being activated by a desire for
private gain for themselves or others, particularly these with whom they have
family, business, or other ties.
11. It will comply with all requirments imposed by HW concerning special
requirements of law, program requirements, and other admiazetrative require-
ments approved in accordance with Federal Management Circular 74-7.
12. It will administer and enforce the labor standards requirements set forth
in 24 CDR Part 570.605 and HUD regulations issued W Implement such requirements.
