Title j6 as enacted by the Maine Legislature in 1969 and as tended, entitled, "tLnicipal Public Employees Lahr Relations Law", THIS AUREEREUT is made end entered into by and between the city of Ba gar, Maine and the Truck Drivers, Qepffeurs, Warehousemen and Helpers kcal Union X340 representing the Bangor Police Officers. Section 2. In order to establish mutual tights, preserve proper employee morale, to assents effective municipal operations and to promote the public health, safety and welfare of the citizens, the city of Bangor. Maine, through its City Council end the Truck Drivers, Chauffeurs, Warehousemen and Halpern Local Union #340 hereinafter Unci t8muelves in mutual agreement as follows: AM= 1. RECOGNITION Section 1. The City recognizes the Union as the sole and exclusive bargaining agent for all Police Officers (Class 433) of the scalar Police Department. Section 2. Membership in the kcal gains is rot wmplulsory. Officers have the right to join, rot join, maintain, or drop their rmabershlp in the kcal Radon, as they see fit. Neither party shall exert any pressure on, or discriminate against, mry officer as regards suds matters.. Section 3. The City agrees Out to interfere with the rights of officers to become members of the Union, and there shall be aro discrimination, interference, restraint, Or ercion by the city or by any City representative against any officer because of Union membarship or because of any officers activity in an official capacity on behalf of the Union consistent with this contract. Section 3. The union shall share equally with the city the responsibility for applying this prwision of the Agreement. AMCLE 3. SWSOPITY Section 1. Seniority shall be determined by the length of full time service fr® the officer's last date of permanent Use within the bargaining unit. A seniority list shell be established by the City listing all office" covered by this Agreement, with the employee with the greatest seniority listed first. The seniority list shell be brought up to date on January lab of every year and immediately posted thereafter on bulletin boards for a period of rot lees than thirty (30) days, and a copy of same shall be sent to the Union and to the steward. Any objection to the seniority list, as posted, moat be reported to the Chief of the Police Department within ten (lo) days from "a data pasted or it shall stand as accepted. Section 3. The individuals covered by this Agreement am. police officers (Class 433). The City agrees rot to assign persons from outside of the bargaining urdt to perform police officers work when any officer is available, except as par past practice. ARTICLE 5. WORK NEE The present work week and rotation system shall continue in effect through this Agreement. The City agmes to consider any proposal sutaitted by the USon for an alternate work week and rotation system provided that such proposal allows the City to schedule the officers on a forty (40) hour work week. AR1LE6 OVERf1NE Section 1. All officers covered by this Agreement stroll receive one and one. half11 1172r—ms their regular hourly rate of prey for all hours worked in exceed of eight (8) hours in one shift, or in excess of forty (40) hours in a payroll week. Section 2. The nre9ular hourly rate" shall be determined by dividing forty (40) into the total of the officers, individual Daae weekly salary. section 3. For the purpose of this Article. "hours worked" shall include those holm spent by the officers on regular duty, annul leave days and holiday pay if the officer works on the holiday. ARTI= V PRIVATE SeRVI�S Section 1. ARTD= SO CfofN1NG section 1. The city agrees that all officers covered by this Agreement shall be Provided, at M cost to all uniforms', and other equipment which it deems necessary for the regular performance of the officers duties. Cleaning of undforms shall be paid by the City when an officer is exposed to umsual arcumstances which cause him to inner sure than normal cleaning expenses. Section 2. 'Plain Clothes" officers shall receive from the City an allowance of Two Hundred Fifty Dollars (5250.00) per year to purchase end maintain their clothing used in lire of duty. ARTICLE 11 VACATION . Section 1. Officers who have been on the City's payroll for Moa or wore years shall be entitled to two (2) weeks vacation with pay each year. Officers with eleven (11) years of service shall, be entitled to three (3) weeks vacation with pay each year. -Section 2. One week of vacation pay shall be the officer's tegalar weekly salary as drown on EMUt ^A". -S%tlon'3. Me vacation schedule shall be rental on December 1 of each year and remain Posted for thirty (30) days to allow the officers to make their vacation selection by se:doiity. Me selection shall be made in two steps. STEP 1: All officers shall make a selection of not mre than two weeks. =P 2: After Step 1 is completed.these officers who Lave additional vacation wanks to their credit shall select their vacation periods from the weeks remaining open on the schedule. Section 4. Annualleave days shall be granted upon request if the necessary per- model are available at the time of request. Section S. In lieu of Nem Year's Day: Washington's Birthday, Patroit•s Day, Labor Day: and Veteran's Day, officers shall be entitled to a vacation of five (5) days in addition to tlgir',regular vacation. Am= 13 =M LEAVE Section 1. Sick leave shall be accrued at the, rata of fifteen (15) days Par year, accumulative to one hundred and t my (120) days. Section 2. Sick leave shall be charged at the rate of not sure than five (5) sick leave days for each week of leave. Section 3. The Qdef of Police may require as a condition precedent to the payment of sick leave a certificate of a qualified physician certifying as to the conditions of the officer or matter of Iia family. In ted event of the death of the officer's spouse, child, Mather, father, brother, sister, mther-imlaw or father-in-law, grandfather or graldcMld, step -mother, stepfather or step -children, 'Ne officer shall ne entitled to up to three (3) days leave for the purpose of attendance at the funeral and assisting in the necessary fosily strange ants, such leave shall be with pay and without any deduction fres sick leave. Section 2. An amount of time deteednad by the Chief, but in no case to exceed one(1) day will be allowed for attendance at funerals of the following sedatives of the officer not provided for under Section 1 abovey aunt, uncle, niece, nephew, brothar=in-law, sister- in-law, or any other relative cut nosed in tills auction, when such other relative is living In the used housebold as the officer. Police Officers who are injured or receive a disability suffered in the performance of their duty shall receive a fall weekly salary each week during which the said injury qualified for workmen's compensation coverage, or until they are placed on disability retirement. Workman's compensation coverage or insurance benefits to cover the City's loss All be turned over to the City. Section 2. Any time loss because of injuries received in the line of duty and covered. by workman's compensation shall not be charged to sick leave. Section 3. The City may require that the officers covered by this Agreement have a medical examination. Such examination shall he acbeduled at regular intervals for all officers and shell not exceed one medical examination per year, unless the officer has suffered injury or illcesa Mich eight affect his ability to, perform his work. If the medical exaAmer or physician selected by the City renters an opinion that the officer is physically disqualified to perform the work of police officer the officer may be re-examined by a physician oY his choice. Section 6. In the event of disagreement between the doctor selected by the City and the doctor selected by the officer, the City and the Union shall together select a third doctor to re-examine the officer. The third doctor's opinion shall be final. Section 7. The mss of an examinations, except for the cost of the exmmination pery forced by the employee selected medical examiner, shall be paid for by the City. Section 8. Medicall examinations shall be scheduled during the officer's working hours, as much a possible. If such examinations; are scheduled outside of the officer's scheduled working Were, the officer shall receive the (2) hours pay at the applicable hourly rate for each examination required by the City. -ARPIcig 16. MEDICAL AND LUX INSURANCE Section 1. All medical and life insurance shall remain in force. Section 2. The City agrees to pry full cost of the BSD 8450 fanny subscription of Us present Use Cross -Blue Shield and Major Medical Plan and also ary increased cost that may be forthcoming during the life of this contract. ARTICLE 17, LAYOFF In the event of a layoff of personnel in the bergafndng unit, permanent officers shall be laid off In inverse order of length o1 service in their classification. The laid off off Accra with the greatest length of service shell be rehired first, providing, however, that he is qualified to fill the vacant position: No new officer shell be hired until all laid - 7 off officers have been given an opportunity to return to work: provided,, however: that they are qualified to fill the vacant position. ARTICLE 18. PWIRATION PERIOD Section 1. All appointments shall in the first instance he made for a pmbaticnary period of twelve morths: and all appointees heretofore or hereafter retained in service after the completion of each probation shall be deemed permanent officers subject to confirmation by the City Council. Probationary officers shall be subject to the provision oP this Agreement, homever, the City shall have the right to terminate without compliance with the terms of this Agreement, the employment oP anyy such new officer within twelve (12) months from the commencement of the probation period. Section 2. Emergency appointments shall be made in accordance with Chapter II, Article 31, Section 2, of the Laws and Ordinances of the City of Bangor. ARTICLE 19. INDOmNIFICATION AND LEGIS 501yICES Section 1. The City agrees to provide amd pay, for a policy of insurance indemnifying and saving harmless the police officers from civil liability for accidental injury to third parties of their property while in the performance of pollee duties and for legal services in defending each claims. Section 2. The City agrees to indemnify ap police officer for legal fees incurred by bimin de ne of a criminal prosecution arising from emduct of the officer whilele in the performance of his official duties: subject to the fol3xwing: A. Such indemnification shall be made only in the event the officer is charged and/ or convicted of a misdeceancr under the following statutory provisfonr (( )) 17 M,R,S,A, '201 (b) 17 M,R,S,A, 1 3852-3854 B. The City's liability for indemMfication of attorney's fees shall be limited in accordance with the than @availing Schedule of Minimmm Bar Fees for the Main State Bar Association if such schedule is in existence. C. In the event or any disagreement screaming the fee charged for shah legal services, the liability of the City shall be limited by the finding of an arbitration committee oI three members of the local bar, one selected by the City, one by the officer's attorney, and third selected by the two so selected. It being understood that the intent be net to limit the attorney's fee but only to limit the City's liability therefor. ARTICLE M. GRIEVANCE FROCE M Section 1. A grievance, for the purposes of this Article, shall be define as any, controversy, complaint, misunderstanding or dispute arising between an officer or officers and the City, or between the Union and the City as to the meaning or application of the specific terns of this collective bargaining agreement. Section 2. E ry reasonable effort shall be made by the parties involved to arrive at a foie and equitable resolution of every grievance without resorting to the grievance procedure hereinafter set forth. If this is found to be impossible, the matter may be submitted to the grievance procedure in accordance with the terms of this Article. Section 3. If the grievance has not been adjusted informally as above suggested it may be submitted to the following procedures: A. The steward, with or without the officer, or the officer alone, shall take up the grievance or dispute with the Chief of Police within tan (10) days after the date of the grievance or of the officer's knowledge of its appearmbhe. The Chief of Police shall attempt to adjust the matter.and shall render his decision to the steward in writing within ten (l0) calendar days. B. If said grievance has net been settled, it shall be presented in writing to the City Manager Albin ten (10) calendar days after the Chief of Police's decision is rendered. The City Manager shall render his decision to the Steward and the Union business agent in writing within ten (10) calendar days after presentment to hum. C. If the grievance is still unsettled, the City Manager may be requested by written notice within ten (10) calendardays of such decision, to bring the matter before the City Council, or a committee thereof. - D. If the grievance is still unsettled either party to this Agreement may within ten (10) calender days, by written notice to each other, submit said grievance to the Maine Board of Arbitration in accordance with Section 970 of the Maine Public D plcyees Labor Relation Law. (a) The decision oI the arbitrator shall be binding as to the gl ¢vane submitted. (b) The general expense of the arbitrator shall be shared equally by the Union and the City. (c) Grievances initiated by the City shall be processed in the same member, but may be started by Step B. AMMCLE 21. DISCIPLMN IEARINCl3 Section 1. Any disciplinary action by the Chief of Police, or the Acting Chief, against any member of the Bangor Police Department covered by this Agreement, upon aq charge of violation of Department rules, inefficiency, incompetence, misconduct, negligence, inuubor- dination, disloyalty, or other charge, shall be taken only after due notice and bears g, except in cases where the nature of the alleged violation warrants immediate emergency suspension. In such cafes, the officer may be suspended with the understanding that if Mis later found irmocent of the allegations he will be paid for all time during which he was suspended. _ Section 2. The member so charged shall have the right to be accompanied by legal counsel at the hearing a cell as by a full timerepresentative of the Local Union. The officer so charged shall have the right to confer with his counsel at aro time during the hearing and shall have the right to have itis counsel speak on his behalf. ° ct .�¢ _ igra_3.. Any officer who feels he hes been aggrieved in any.disciplinary action may apps ting to the Civil Service Commission for a hearing on such grievance within ten (10) days a the 'receipt of the written notice, or may use the grievance pro cedure cantained in this Agreement, but the officer may not use the grievance procedure, and have access to the Civil Service Commission for his appeal. Se�at' ((_. Any disciplinary action resulting in loss of time and or money will be admi Act by the Chief of Police. Any written reprimand which is to became part of the permanent service record of the employee will be issued only by the Chief of Police. ARTICLE 22 STRIKES & LOCKOUTS PMHIEITID Section 1. For the duration a this Agreement, the Union, its officers, representatives, stewards and members shall not, directly or indirectly, authorize, instigate, cause and encourage, ratify, support or suggest or condone, nor shall any employee, directly or in- directly take part in env strike slowdmm, or stoppage of work, boycott, picketing, o other interruption of work, or take aro action or inastion which would involve suspension, or interference with the normal work of any City Department, mass resignation or absenteeism. Section 2. Failure orrefusal an the part of auy officer or agent to comply with any provision of this Article 22 shall be cause for whatever disciplinary action, including suspension or discharge, deemed necessary by the City. In consideration of nc-strike pledge by the Union end employees the City shall not lockout officers for the duration of this Agreement. Neither the violation of any provision of this Agreement nor the Commission of any act constituting an unfair labor practice or otherwise made unlawful by any federal, state or local law shall excuse officers, the Union or the City from their obligations under the provisions of this Artiele 22. Alleged violation of ary provisian of this Article 22 is appealable immediately by either party, to the Superior Court, within and for the County of Penobscot and State of Madams for the purpose of securing specific performance of the provisions of this Article 22. ARTICLE 23. Y'% a,h�i- Section 1. The City recognizes the right of the Union to designate a steward and an alternate who moat be members of this bargaining unit. The steward ars alternate steward of the Union, shall be allowed time off with pay for official Union business with represerd.a- tives of management upon appointment, if there is sufficient manpower available to cases no interference with departmental operations. Stewards of the Union shall be allowed time off Mth pay during their regular work or shift hours to investigate greivances or to attend grievance hearings, Mut ' ,no case shall such time exceed a total of two (2) hours For week for not more than two (2) representatives. H] Section 2. No time off or leave of absence shall be permitted under this Article 23 unless the Chief or his designee determines thew is sufficient manpower available for normal departmental operations. Section 3. It is understood ami agreed that all officers have productive work to perform and will not leave their jobs during working hours to attend Union matters, except as provided above. ARTICLE 2I., BULLETIN BOARDS The City shall penult the reasonable use of bulletin boards by the Orion for the posting of noticed relating to Union business. ARTICLR 25. AETIRQAFNT All officers who are members of Maine State, Retirement System shall be entitled to retire after having completed twenty (p) years of service as a Police Officer with the Bangor Police Department. Retirement benefits shall be. granted and computed in accordance with Chapter II, Article 1p, Section 13 through 15 of the Laws and Ordinances of the City oI Bengor, as emended by City Ordinance or State Statute. .ARTICLE 26. WORK RULES Section 1. when existing work rules are changed or new rules are proposed` they WE be posted prominently on all bulletin boards for a period of ten (10/ corn sorption work days before becoming effective. Objections to aro proposed mark rules shall be made in writing to the department head who shall have the responsibility for reviewing such objections and making final determination. Appeals from his decision can be made in accordance with normal grievance procedures. Section 2. (INFORMING OFFICERS) The City farther agrees to furnish each officer subjec�to i�Us contract with a copy of all how mark rules thirty (30) tlays after they become effective; new officers .shall be provided with a copy of the rules at the time of hire. Section 3., (ENFORCING) Officers shall comply Ain all existing rules that are not in conflict with the terms of this Agreement. Section 4. An unresolved complaint involving discrimination in the application of new or existing rules shall be resolved through the grievance procedure. Ail!= 27. RESIDENCY Section 1. All new employees in the bargaining unit shall prior to the expiration of their probationary period, establish their domicile within the boundaries of the City of Bangor. Aq such employee who has not established a domicile as hereinabove stated ahall be subject to dismissal. Section 2. The foregoing restriction as to residency shall not apply to those members of this bargaining snit who prior to January 1, 1977, reside outside of the city limits, it being the intent of the parties hereto that those employees shall not be compelled to change their residency as a condition of their continued employment with the Police Department. Section 3. It is further understood that and employee who is presently living within the ten mile radius currently provided for under the City ordinance, may be allowed in the future to change his residency as long as he remains inside of the ten mile radius as defined in the City ordinance. Section 4. The City further agrees that it will give consideration and may make an exception to the above rules for any employee who would suffer hardship as a result of compliance with this Article. ARTICLE M. WAGIMT RIGHTS Except as explicitly limited by specific provision of this Agreement, the City shall contimne to have the exclusive right to take and action it deems appropriate in the operation of the Police Department and direction of the work force in accordance with its Judgment. Such rights shall include, but shall not be limited to, the operation of the police force, direction of the working forces, the right to hire, to suspend or to dis— charge for just cause, to change assignments, to promote, to reduce or expand the working forces, to transfer, to maintain discipline, to establish work schedules, and to introduce new or improved methods or facilities. ABTSCLE 29.
