REMOTE MEETING VIA ZOOM Board Members Present:Ken Huhn, Chair Reese Perkins, Vice Chair Michael Bazinet Ted Brush Don Meagher City Staff Present: Melissa Bickford, Development Asst. City Solicitor John Theriault, City Engineer Chair Huhn called the meeting to order at 7:00 P.M. __________________________________________________________________________ LAND DEVELOPMENT CODE AND MAP AMENDMENT PUBLIC HEARINGS 1. Zone Change - 300 Bomarc Road - Map-Lot - R38-003 - from Rural Residence & Agricultural District (RR&A) to Urban Industry District (UID) -Bomarc, Inc., applicant- To amend the Land Development Code by changing a parcel land located at 300 Bomarc Road, Map-Lot R38-003, from Rural Residence & Agricultural (RR&A) to Urban Industry District (UID). Said parcel of land contains 36.2 acres. Bomarc, Inc., applicant. Fred Marshall, PE with Plymouth Engineering presented the item on behalf of owners Rich& Dick Trott. Former missile complex, then an industrial park for a number of years Zone line for Urban Industry District is approximately 175’ off back lot line Future development could use entire parcel with zone change Planning Board discussed the following: Is there any reason to keep this as RR&A? Per Planning Officer Krieg, staff couldn’t locate the council action that created that ring of RR&A, likely due to change of land ownership over time, possible clerical error. She had no concern to bring back to UID. City of Bangor Planning Board Meeting Minutes of April 20, 2021 Vice Chair Perkins moved to recommend to the City Council that theamendment tothe Land Development Code by changing a parcel of land located at 300 Bomarc Road, Map-Lot R38- 003, from Rural Residence & Agricultural (RR&A) to Urban Industry District (UID) ought to pass. Said parcel of land contains 36.2 acres. Bomarc, Inc., applicant. Seconded by Member Meagher. Roll call vote: Meagher, yes; Brush, yes; Bazinet, yes; Perkins, yes; Huhn, yes. Motion carries. 2. Zone Change - 490 Broadway - Map-Lot 037-084 - from Urban Residence District One (URD-1) to Urban Service District (USD) - Capital City Holdings, LLC applicant.- To amend the Land Development Code by changing a parcel of land located at 490 Broadway, Map-Lot 037-084, from Urban Residence District One (URD- 1) to Urban Service District (URD). Said parcel of land contains 0.61 acres, and 0.20 acres will be rezoned from Urban Residence District One (URD-1) to Urban Service District (USD). Other 0.41 acres of land to remain as Urban Service District (USD). Capital City Holdings, LLC (Edward Goff), applicant. Edward Goff, applicant presented the item. Split lot, not sure why it was ever split Wishes for entire lot to become USD to put in business o Front half of lot zoned appropriately for needs (USD) Right turn in, right turn out Owns two other car washes, “Fast Eddies” with locations in Augusta and Brunswick Donates back to the community Partnered with local family to run car wash Improvement to area and aesthetics No questions from the board at this time. Staff indicated the following in part and substance: Split zone lot Difficulties with Broadway traffic High crash area Comprehensive Plan showed as a split zone lot –at that time, concern was not having commercial uses not blending back into residential neighborhoods The City Engineer Theriault advised the following: Difficult site – Broadway Corridor Study of 2015 recommended right turn in, right turn out of facility, restricting access as well as Center Street and Broadway changes Both Earle Avenue and Center Street (on Broadway) are high crash locations DOT provided preliminary design funds of $100,000 to expand on recommendations Preliminaryplans already developed Innovative design will be needed to make it work, as the lot isn’t big, queue cannot impact adjacent streets The Applicant Goff provided the following: There would be no “cut through” access to Earle Avenue and other streets located behind the property as a “short cut” Gates could also be put up for emergency access Entrance to facility would be an entrance only from Broadway Page 2 | 5 City of Bangor Planning Board Meeting Minutes of April 20, 2021 The Planning Board discussed in further detail how “car wash” is defined in the code, not specifically a permitted or conditional use. The item would fall under D2a, Retail Auto Service, which could include sales, installation of parts and/or accessories, car wash, rust proofing, etc. Further discussion ensued regarding change of ownership in the future with adifferent direction for the property, as well as considering implications of all conditional uses that could happen. Chair Huhn reviewed letters received from Sara Byrne, as well as the Carr Family regarding access, traffic, property design and the project itself. Citizen Shane Leonard inquired about where the exit would be on the property (exit would be out the back of the property onto Earle Avenue then Broadway). Leonard indicated that there were considerabletraffic and accident issues. There was general concern due to traffic patterns, speeders, high volume of traffic in/out of the Little City Area. Applicant Goff indicated that they would do “right in and right out”, trying to be a good neighbor. Possible fencing towards the back would be helpful for the noise, light, etc. Citizen Taylor lives in the immediate area. Taylor reports less overall traffic since redemption center closed, decrease in accidents on Broadway. Additionally, people continue to run stop sign at corner of Warwick and Earle. The roads are narrow in winter and spring, can’t get two vehicles down the street – concerned about increased traffic issues. Also concerned about the amount of noise generated from a car wash. Citizen David Moyse has lived in Pleasant View Avenue about 30 years. Traffic much better since redemption center closed, used to have taxi drivers going 60 MPH down the street. This is a big issue during the wintertime. Moyse suggested making it so drivers cannot physically turn right on to Earle Avenue. Citizen Dominick Rizzo lives on Leighton Street. Reiterated similar comments heard previously. Concerned with site development plan with noise quality and light issues. Rizzo discussed zoning of URD-1, and feels that the land is there to protect the residential neighborhood, and that there should be separation from residential. Member Meagher moved to recommend to the City Council that theamendment to the Land Development Code by changing a parcel of land located at 490 Broadway, Map-Lot 037-084, from Urban Residence District One (URD-1) to Urban Service District (URD)ought to pass.Said parcel of land contains 0.61 acres, and 0.20 acres will be rezoned from Urban Residence District One (URD-1) to Urban Service District (USD). Vice Chair Perkins requested clarification regarding the .20 acres that might previously have been used as a buffer, and that there was no documentation found. Planning Officer Krieg confirmed that was the case, and that it could be surmised that the purpose was to provide a buffer. Unsure what was in place in 2010/2012 that caused the City to keep it the same zoning, but it’s how it’s shown on the Comprehensive Plan. Applicant Goff indicated that he had a survey map from 1982, and that map showed the same zoning as today. Page 3 | 5 City of Bangor Planning Board Meeting Minutes of April 20, 2021 Additional comment was received from citizen Ragner Jaeger felt that those .20 acres could be used for our benefit, however we seemed fit. Suggestion made for green space, to reduce noise levels for residents. City Engineer Theriault advised that doing the right in and right out would alleviatea lot of traffic concerns. This site would remain right in and right out regardless of what business went in there. If the business can accept the limitations of access, that’s not a bad thing. Roll call vote: Perkins, yes; Bazinet, yes; Brush, no, Meagher, yes; Huhn, no (believes that the strip was meant to be a buffer for the neighborhood regardless of what business goes in there, neighborhood still needs a buffer). Motion carries. LAND DEVELOPMENT PERMITS 3. Site Development Plan Approval -1017 Union Street - Map-Lot R24- 017 -Shopping & Personal Services (S&PS) District -CC andDC Enterprises, LLC - Land Development Permit approval to confirm as-built plan for the golf driving and practice range at property located at 1017 Union Street, Map-Lot R24-017, in a Shopping & Personal Services (S&PS) District. Applicant is CC and DC Enterprises, LLC. Previous approval was received in 2005, however, site improvements were made without additional approval. Michael Clendenning, applicant, presented the as-built plan and the following information: Building was originally at the end of the walkway Storage building moved to the other end of the parking lot Fence put up to hold mowing equipment Believed the as-built had been filed in 2009 Currently without Certificate of Occupancy for what they have Planning Board discussed the following: Changes from approved plan to the as-built? Building moved –was originally at the end of the walkway Storage building moved to other end of the parking lot Fence put up Not a huge deviation from the as-built, but planning board needs to technically confirm what was built, so applicant can move forward with the next phase No further questions or comments from staff. Member Perkins moves recommendation for approval for Land Development Permit for Site Development Plan confirming the as-built plan for the golf driving and practice range at property located at 1017 Union Street, Map-Lot R24-017, in a Shopping & Personal Services (S&PS) District. Applicant is CC and DC Enterprises, LLC. Seconded by Member Meagher. Roll call vote: Perkins, yes; Bazinet, yes; Brush, yes; Meagher, yes; Huhn, yes. Motion carries. Edit to recently changed text for Shopping & Personal Service Addition of two roads on the recently change text amendment for Shopping & Personal Service District. Presented to B&ED Committee this evening, addition of internal roadways of Bangor Mall Boulevard, and Longview Drive. No action needed from the Planning Board, but if any concerns, please let Planning Officer Krieg know. b. Comprehensive Plan Planning Officer Krieg reviewed the comprehensive plan process. RFP to be issued for Consultant Planners for data collection and public outreach for this process. Biggest challenge will be public outreach due to COVID-19. Planning Board members discussed the connection behind the Comprehensive Plan, zoning and the Land Development Code 5.Meeting Minutes - Motion made to table the meeting minutes of April 6, 2021 until the meeting of May 4, 2021 by Member Bazinet, seconded by Member Brush. 6.Adjournment - Meeting adjourned at 8:22 p.m. Respectfully submitted, Melissa L.
