Summary This Ordinance will amend the Contract Zone requirements recently added to the property addressed at 183 Harlow Street (Schoolhouse) for Community Housing of Maine (CHOM). The lot was added to the Downtown Development District with a contract zone to accommodate an affordable housing renovation of the building. One of the requirements was the placement of 32 onsite parking spaces for tenant use. Additionally, a condition was placed that the parking space/unit ratio will be .5 or better with both onsite and off -site spaces. This ratio requirement is planned to be maintained; however, CHOM is requesting a reduction to 27 onsite spaces. This request is due to rising construction costs for the retaining wall that would be necessary to construct 5 of the previously required onsite spaces. WHEREAS, at present, there is a proposal to renovate the existing Schoolhouse Building at 183 Harlow Street, WHEREAS, the applicant previously applied for a contract zone change for the property; WHEREAS, the applicant was awarded a contract zone change that contained a number of provisions, including that the property owner maintain 32 onsite parking spaces and a .5 ratio of parking spaces to dwelling unit; WHEREAS, there were unanticipated costs associated with constructing a retaining wall that would be necessary to create and maintain 32 onsite parking spaces; WHEREAS, the .5 ratio of parking spaces to dwelling units will be maintained; WHEREAS, the applicant will continue to lease off site spaces from the city, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BANGOR AS FOLLOWS, THAT Chapter 165 of the Code of the City of Bangor District Map is amended as follows: The contract zone agreement for property addressed at 183 Harlow Street (Assessors Map 41, lot 96) zoned Downtown Development District is hereby amended to remove prior conditions and replace them with the following conditions: A. Schoolhouse Apartments, its owner, or operator shall maintain a minimum of twenty-seven onsite parking spaces and a parking space/unit ratio of .5 or better with on -site and offsite spaces. B. Schoolhouse Apartments, its owner, or operator will continue the terms of the leased off -site parking from the site of Bangor. This lease is valid through 2039; at such time, Schoolhouse Apartments must agree to continue the lease with the City of Bangor or make other arrangements to maintain the agreed upon parking space to tenant unit ratio. The Planning Board considered this item in a noticed public hearing on May 18, 2021. The meeting was conducted using the city's Zoom account. The applicant, Bree LaCasse of Community Housing of Maine (CHOM), reviewed the application. She is seeking a change to the contract zone requirements previously stating that 32 spaces needed to be provided on site. Due to unforeseen circumstances of the property, they can only provide 27 spaces. Assistant City Solicitor Saucier confirmed the contract will continue to state 27 spaces and a .5 parking ratio to be held. The Board passed a motion, by roll call, made by Member Perkins and Seconded by Member Shaw, to recommend to the City Council that the said zoning district change ought to pass.
