WOMMUS. by virtue of Council Resolve No. 217 AD, the City Council authorized the release of the Capehart 53wA6ay Treatment Plant to the United States of Antics; and NNeNEAS, it has Saxons necessary to retain certain portions of the sal property connected with said Plant for purposes of future operation of the City's sewer by'stea, NOW, TRENEPOBE. By the. City Council of the City of Bangor RESOLVED, That Council Resolve No. 217 AD is hereby revoked; and RESOLVED. That the City of Bangor no longer has my use for certain real property, formerly known as the Dow Air Force Base L_Sgmg!�;•Treatment Plant, formerly owned by the United States of America and conveyed to the City by deed dated December 10, 1968 recorded in Volume 2147, Page 861, Penobscot Registry of Deeds, said conveyance being subject to certain covenants, conditions, reservations and restrictions requiring that "for a period of thirty years from the date of this dead the above described property herein conveyed shall be utili- aed continuously in the le and for the educational Purposes set forth in the approved program and plan contained in the application of the City of Bangor dated June 20, 1968, and an aamberat thereto,, dated June 28, 1968, and for no other purpose"; and RESOLVED, That the City of Bangor no longer has any use for all of said real property for said purposes; and RESOLVED, net the City of Bangor is willing and wishes to return a portion of said real property to the Federal Government; and RESOLVED, That JOM Flyon, City Manager, is hereby apthorized and directed, on behalf of the City of Bangor, to execute a dead and all other necessary docummte for purposes of convryfng said real property back to the United States of America; provided, however, that the City shall retain title to the easements described in Exhibit A attached hereto. EASEMENT "A" A 20 foot wide easement to permit the future maintenance of a 14 inch sanitary sewer, the centerline of which is described as follows: Beginning at a point on the westerly line of the former Sewage Treatment Plant site, said point being 306.60 feet south from the southerly eight -of -way line of Pushaw Baed,as ured along said westerly line of said Sewage Treatment Plant site; thence deflecting 91' 00' in an easterly direction from the southerly course of said line for a distance of 152 feet to a paint; thence defWting 580 301 southeast for a distance of 185 feet to a Point; thence us- flecting 50' 30' southwest for a distance of 141 feet to the southerly line of said Treatment Plant Bite, intersecting said line at a point located 208 feet east tram the southwesterly corner of said site. EASEMENT "E" Bb91nning at a point on the southerly right -o£ -way line of Pushaw, Road, said point being 65.17 feet wast from the second angle point in said right-of-way line measured west from KaMuakeag Stream, and said point being at the north- easterly c0 Of the present access to the Sewage Treatment Plant site; thence - in outherly direction along thea easterly line of s6LJ access right-of-way projected far a distance of 296.92 feet to a paint; thencedefyecting 89' 00' to the west for a distance of 76.01 feet t0 the westerly line of the Sewage Treatment Plant site; thence deflecting 91' 00' to the north along said westerly line for a distance of 203 feet to a point; thence continoina along said property line in an easterly direction for a distance of 10 feet, and thence north for a distance of 83.60 feet to the southerly right -Of -way line of Pushaw Road; thence in an easterly direction along said southerly right-of-way line for a distance of 66.96 feet to the point of beginning. And that the said City Engineer met at %a time and place of meeting specified in the notices and precool to ley mn said sewer Easements, as follows: A 20 foot wide right-of-way extending in a generally south- erly direction from an existing sanitary sewer manhole located at the intersection of Blue Hill West and Dirigo Drive, said line deflecting approximately 32" southwest from a southeasterly extension of the southwesterly right-of-way line of Dirigo Drive, and proceeding for a distance of 300 feet; thence deflecting 22" 36' to the southwest for a distance of 500 feet; thence deflecting 47" to the southeast for a distance of 56852 feet to a point; thence deflecting 82" 09' 40" to the west for a distance of 549.48 feet to a point in the center of the travel way of Ohio Street. The location of the sewer is more specifically shown on Plans entitled "Blue Hill West Sanitary Sewer Extension to Ohio Street", Plan No. S-741, Sheets 1 and 2 of 29 dated August 29, 19771 which are n file in the office of the City Engineer. The purpose of the Easement is to grant unto the City of Bangor, its successors and assigns forever, the full right and privilege to install and maintain an underground 8 inch sanitary sewer line and appurtenant structures within the limits described above, across the following properties: Name and Address Land Investment, Inc. Area involved:- .14 acres Recommended damages: $75.00 There appeared at the time`and place set for the meeting Mr. Milton Duncan, Mrs. Walter Nachum and the Rev. Stephen Brown, representing the Church of God. Those present were advised of the purpose of the meeting: To establish Ease- ments to permit the installation and future maintenance of the sewer. Asked about the schedule for construction, the City Engineer advised those present that we hoped to commence as soon as possible, starting at Blue Rill West, and complete -3 - the installation at least to Station 13 + 6S, at the Rainbow Trailer Park; the remaining portion extending to Ohio Street may be delayed until next spring or early summer if weather conditions become prohibitive. Mr. Duncan inquired as to when he might connect into the sewer, and when the payment of assess- ments would be required. He was advised that the assessments are due prior to sewer entry, but that a formal report on the actual costs would probably act be submitted to the City Council until next summer. The Rev. Brown questioned the assessment of the back land, which he indicated would probably never be developedq he was advised by the City Engineer that the land would become more valuable with the availability of sewat,+, so that residential development would probably become a reality; the assessment would be deferred for at least five years, with the possibility that deferment might be made until the property was developed. This will be determined in the future report to the City Council on the final coat of the sewer installation. Those present were also advised that the actual work area to initially install the sewer would probably be approximately 50 feet in width. They were advised that all areae disturbed by the construction would be restored, and that a future permanent Easement of 20 feet in width would be adequate for maintenance purposes. This would permit the use of the surface of the land for parking, gardens, lawn areas, drives, etc., but would not permit the construction of buildings within the Easement area. Each of those present was advised of the amount of damages recommended for the sewer Easements, and the method of computing the damages was explained. All of those present spoke in favor of the proposed sewer installation. It is recommended that the Easements be established as noted above, and that the recommended damages be paid.
