PREPMBLE Section 1. Pursuant to the provisions of Chapter 9 (a), Revised Statutes of Elaine, Title2r"enaated by the Macre Legislature in 1969 and as amended, entitled, ^Municipal Public Employees Labor Relations Lou'. THIS A REEMV is made and entered into by end between the City of Bangor, Maine and the 'Teamsters Local Union #48 representing the Bangor Police Officers. Section 2. In order to establish mutual rights, preserve proper employee morale, to oromote effective municipal operations end to promote the public health, safety and welfare of the citizens, the City of Bangor, Maine, through its City Council and the Teamsters Local Union #48 hereinafter bind themselves in mutual agreement as follows: ARTICLE 1. RECCONTTION .Section 1. The City recognizes the Union as the able and exclusive bargaining agent for all Police Officers (Class 433) of the Bangor Police Denertment. - Section 2. Membership in the Local Union isnot compulsory. Officers have the right to ,join not Join, maintain, or drop their membershin in the Local Union, as they e fit. Neither party shall exert, any pressure on, or discriminate against, any officer as regards such matters. Section 3. The City agrees to deduct from the pay of all officers covered by this Agreement the dues of the Local Union and agrees to remit to the Local Union all such deductions color to the end of the mean for which such deductions are made. Signed authorisations from the officers shall be furnished to the City by the Union. Section 4. The Union shall indemnify and save the City harmless against all claims and suite which may arise by reason of any action taken in moving deductions of said dues and rxmittin,3 the Same t0 the Union pursuant to this Article. ARTICLE 2. DISCRI14lRAT10N PROLLEM-D BY EFfHER PAM Section 1. The City and the Union agree not to discriminate ar;ainst may individual with respect to his hiring, compensation, terms or conditions of employment because of. such individual's race, color, religion, sax, age according to anplicable laws act national origin, nor will they limit, see gate or classify individuals in any way to deprive any individual of employment o. poitw,ities-because of his race, color, religion, or national origin. Section 2. The City agrees net to interfere with the rights of officers to become members of the Union, and there shall be no discrlminstion, interference, rest'rafnt, or coercion by the City or by any City representative against any officer because of Union membership or because of any officers activity in an official capacity on behalf of the Union consistent with this contract. Section '�. The Orion shall share equally with the City the responsibility for avplying this. provision of the Ayx®ent. Afnalz 3. SENMRTCY Section 1. Seniority Shall be determined by the lenCth of full time service from the officer's last date of pernanent hire within the bargaining unit. A seniority list shall be established by the City noting all officers covered by this Agreement, with the employee with the greatest seniority listed first. The seniority list shall be brought up to date an January 1st of every year and Lnnediately posted thereafter on bulletin boards for a period of not less than thirty (30) days, and a Cony of same shall be seen to the Union and to the Steward. Any objection to the seniority list, as posted, =at be in reported to the Chief of the Police Department vith(10) days Prom the date posted or it shall sterol as accepted. Section 2. Seniority shall be the sole factor in all matters affecting reduction in work force, recall and vacation, and shell be a factor in consideration of matters affecting transfers and work shifts. - Section 3. All permanent Sob openings and/or vacancies shall be posted by the City for bid by the police officers as soon as such opening ardor vacancy bernmes available. This provision shall also apply to temporary job openings that are likely to last 30 or mora calendar days. Section 4. Whenever there is an opportunity for police officers to attend any school sponsored by the Police Department, option of such school shall be posted at the earliest possible date. ARMCLE 4. DUTIES Section 1. The duties of the Police Officers shall he those duties thatcom under the jurisdiction of the Chief a4 Police including the enforcement of City ordinances, state and federal statutes, the patrolling of the City streets for crime prevention and traffic control and the preservation of life and property. Section 2. Police officers shall not, as a part of a tour of duty, perforn services for any private interest, except as directed by the officer in charge and in keeping with departmental rules and regulations. Section 3. The employees covered by this Agreement are police officers (Class 433). The City agrees not to assign persona from outside of the bargaining mut to oerfara Wiles officers work when any officer is available, except as per past practice of second Sgt. replacing the Police Officer. ARTICLE 5• MORN WEEK The City agrees to consider any proposal submitted by the Union for an alternate work week and rotation system provided that such proposal allows the City to schedule the officers on a forty (40) hour work week. The work week will .consist of forty (40) hours. Days off will be consecutive. ARTICLE 6. OVERTIME _ Section 1. All officers covered by this Agreement, except Detectives,. shall receive am and o e half (1') times their regular hourly rate of pay, for all hours racked in excess of eiglk. (8) hours in one ahift, or in excess of forty (40) hours in a payroll week. Section 2. The "regular hourly rate" shall be determined by dividing forty (4o) into the total of the officers individual base weekly salary. Section 3. For the purpose of this Article, "hours worked" shall include those hours spent by the officers on regular duty, annual have days act holiday pkv if the officer works on the holiday. - Section 4. Hours paid for funeral leave, sickleave, off duty murt tied jury duty, private service duty and holiday pay if the officer does not work on the holiday shall not be added to the hours worked in a panscll week to produce overtime. ARTICLE 7. PRIVATE SERVICE$ Section 1. Officers who wank on any outside private uervice, including but net limited to dances, games, conventions and private functions shall be raid at, the rte of $40.00 for up to five (5) hours for each tmr, of duty. Hours in excess pf five (5) hours In any one private extra shall be paid at the rate of $e.14 Per hour effective October 12, 1978 and $e.55 per hour effective January 1, 1979. Payment to be made by the City. Section 2 Private service assignments oerfornedon the holidays specified in this section shall he paid for at double the rates specified in Section 1. 1. New Year's Day 2. Thanksgiving Tay - 3. Christmas Day 3 Section 3. The eight (8) hour period immediately preceding or immediately following New Year's Day, Thanksgiving Des and Christmas Day shall be considered holidays for the purpose of pay caaprtatien under this Section. ARTICLE B. COURT TIME Section 1. Ary officer covered by this Agreement who is required to attend Coast outside of his regular work shift shall receive a minimum of cefour (4) hours of pay for such attendance. No court time shall be allowed to any, such officer who has been notified that his presence is not needed$ prior to the end of his shift on the day preceding a scheduled Court attendance. Lf he is required to stay in attendance at such Court for mom that four (4) hours$ in any one day$ be shall be paid for the actual hours spent that day. Provided$ however$ that any and all fees$ compensation or allowances$ to which any officer i would be entitled to for such Court time provided for by statute o Court order,or be turned over and paid to the City, and not retained by the officer. Section 2. Officers shall be paid at the rate of $5.00 per hour for off duty Court time. ARTICLE 9. PER4DNAL EFFECTS ALWWOCE The budget of the Police Department each year shall have anaount to be known as the Personal Effects Account. Each member of the Bargaining Unit shall he reimbursed for the replacement cost of personal effects that shall be damaged$ destroyed$ or lost in the performance of duty, moviding each damages, destruction$ or loss acyl satisfactory evidence thereof is reported within seventy—two (72) hours of actual knowledge thereof: ARTICLE 10. CL( THING Section 1. The City agrees that all officers covered by this Agreement shall be provided, at no cost to the officers, all uniforms, and other equipment which it deems necessary for the regular performance of the officers duties. Clearing of uniforms shall be paid by the City when an officer is exposed to unusual circumstances which cause him to incur mom than normal cleaning expenses. Section 2. 'Plain Clothes" officers shall receive from the City an allowance of Two Hundred Fifty Dollars ($250.00) nor year to purchase and maintain their clothing used in line o4 duty. . - ARTICLE 11.. VACATION Section d. Officers who have been on the City's payroll for one or mom years hall be entitled to two (2) weeksvacation with p4yeach year. Officers with eleven (11) years of servieeshall be entitled to those (9J weeks vacation with pay each year. 4 Section 2. One creek of vacation pay shall be the officers regular weekly salary as shown in Article 33. Section 3. The vacation schedule shall be Posted on December 1 of each year and remain posted for thirty (30) days to allow the officers to make their vacation selection by seniority. The selection shall be made in two steps. SEEP 1: All officers shall make a selection of not more than two weeks. STEP 2: After Step 1 is completed, those officers who have additional vacation weeks to their credit shall select their vacation periods from the weeks remaining, open on the schedule. STEP 3: Appeal Leave most be taken in weekly incroments with the exception of five (5) days. Sectrio�n� 4.� Annual leave days shell be granted upon reap st if the necessary per+ alable at the time of reauest, luted to five (5) days per year with the approval of the Captain. Section 5. An officer who retires or recigns or is discharged for cause prior to taking his vacation shall be entitled to accumulated earned vacation pay in ratio to Us length of service. Section 6. No officer covered by this Avreeuent may accumulate more than thirty (30) days of vacation. ADTICLD 12. HOLIDAYS Section 1. The following holidays shall be paid holidays for all police officers: 1. Labor Day Section 2. Holiday pay shall be eight (8) hours at the Police officer4s current hourly rate in accordance with Article. 33. Section 3. In lieu of New Year's Day, Masbington's Birthday, PatrolVs Day, Labor Day, and Veteran's Day, officers shall be entitled to a vacation of five (5) days in addition to their regular vacation. - - ARTIC E 13. SICK LBAVN Section 1. Sick leave shall be accrued at the rate of fifteen (15) days peryear, accumulative to one hundred and twenty (120) days. Section 2. Sick leave shall he charged at the rate of not more than five (5) sick leave da: for each week of leave. Section 3. The Chief of Police may require as a condition precedent to the pagmcmt of .sick leave a certificate of a qualified nhysician certifying as to the conditions of the officer or member of his family. Certificate must he presented within W hands after the officer returns to work. Section 4. The City will not be responsible for the medical expense unless the officer is directed to be examined by a physician named by the City. Section 5. Any officer who willfully violates or misuses this sick leave policy r rho misrepresents any statement or condition order the sick leave policy may be subject to disciplinary action. Section b. Sick leave may he used for attendants upon members of the family limited to the ,aye and children of the officer and limited to twelve (12) days per calendar year. This provision is intended to cover only those emergency situations where the nature of the illness or family conditions are such that the officer himself be available to care for his family, limited to (1) me day per incident, unless critical. Section 7. Officers must notify the Chief of Police, his Assistant, or the 0 in charge of the shift, as early as possible, but in any case no has than one (1) how prior to starting time, in order to dram sick leave benefits, unless a shorter time is approved by the Chief. .Section 8. Paying the term of this. Agreement, when an officer retires from active - rvice with the City, and is immediately eligible for retirement benefits pyrmem to the Maine State Retirement System as it applies to the City, the officer shallreceive an aimourt ecual to his salary at the time a his retirement for one-third (1/3) the number of days of accumulated unused sick leave to a maximum of forty (40) days. Section q. Upon deatb of an officer covered by this agreement all accrued sick leave .+ill be paid to his estate. Section 30. Sick leave 411 net be paid when a police officer is capable of and found other work in the Department. ARTICU 14. Section 1. In the event of the death of the officer's spouse, child, mother, father, brother, sister, mother-in-law or fatber-in-law, grandmother, grand£atber or grandchild, stepmother, eteo-father or step -children, the officer shall be entitled to up to three (3) days leave for the purpose of attendance at the funeral and assisting in the necessary family arrangements. Such leave shall be with pay andwithout any deduction from sick leave. Section 2.. me amount of time determined by the Chief, but in no case to exceed ane (1) day will be allowed for attendance at funerals of the following relatives of the officer net provided for under Section 1 above; aunt, uncle, Uses, nephew, brother-in-law, sister - in law, or any other relative not named in this section, when such other relative is living in the =ame household as the officer. Said time off shall be with pay and Atbout deduction from sick leave. ARTICLE 15. MILITARY LEAVE Military leave shall be granted to members of the Department for annual military training. Personnel on annual military training shall to paid the difference between their military pay and what their City Pay would have been. Military nay shall include .the individual's pay plus .subsistence and quarters. The individual shall submit itemized listings of the above which shall be sigad by his -Commending Officer or Personnel Officer. Mblitary pay shall be limited to two work weeks .sr calendar year. ARTICLE ib. WMPEI5 E INJURIES Section 1. Police Officers who ere injured or receive a disability suffered in the Performance of their duty shall receive a 1411 weekly salary each week aurin,- which the said injury cualJfied for workman's compensation c venaye, or until they are nlaced on disability retirement. :loNman's comcensation coverage or insurance benefits to cover the City's loss will be turned ever to the City. Section 2. any time loss because of injuriesreceived in the line of duty and covered by workmen's compensation shall not be chanted tsick leave. Section 3. An officer will return to work or lase his city pry check upon written permission from the Doctor that he is capable of performing his regular duties or other work within the Deparomen . Section 4. Sick and vacation benefits will accrue for a period of only 12 consecutive months while on workmants compensation unless a longer period is proposed by the City, Manager. ARTICLE 17. IMIOn EXAMINATIONS Section 1. The City may require that the officers covered by this AI?'eement have a medical examination. Such examination shall be scheduled at regular intervals for all - officers and shall not exceed one medical examination par year, unless the officer has suffered injury or illness which might affect his ability to nerpo m his work. Section 2. TM City shall have the right to select its own medical examiner o physician and shall be responsible for making the appointments with the medical examiner. Section 3. If the medical examiner or physician selected by the City renders an opinion that the officer is physically disqualified to n. rfonn the work of police officer the officer may be re-examined by a physician of his Choice. Section 4: In the event of dissereement between the doctor selected by the City and the doctor selected by the officer, the City and the I on shall together .select a third doctor to re-examine the officer. The third doctor's opinion shall he final. Section 5. The coat of all exmnintions, except for the mat of the examination per- formed by the employee selected. medical examiner, shall be paid for by the City. Section 6. Medical examinations shall he scheduled during the officer's working hours, as a,� s possible. If such examinations are scheduled outside of the officer's scheduled working hours, the officer shall receive two (2) hours pay at the applicable hourly rate for each examination required by the City. 7 ARTICLE 18. MEDICAL AND LIFE INSURANCE Faction 1. All medical and life insurance shall remain in force. Section 2. The City agrees to pay full cost of the BSD $450 family subscrintion of the present Blue Cross -Blue Shield end Major Medical Plan and also any increased cost that may be forthcoming during the life oY this contract. ARTICLE 19. LAYOFF In the event of a layoff of personnel in the bergainin.¢ vast, neramment officers shall be Isla off in inverse order of length of service in their classification. The laid off officers with the greatest length oY service shell be rehired first. No new officer shall be hired until all laid -off officers have been given an opportunity to return to work. ARTICLE 20. PROBATION PERIOD _ Section 1. All appointments shall in the first instance he made for a probationary rind oT�ve months{ and all appointees heretofore or hereafter retained in service after the completion of soon probation shall be deemed permanent officers. Probationary officers shall be subject to the provisions of this Agreement, however, the City .shall have the right to terminate without compliance with the terms of this Agreement, the employment of any such new officer within trelve (12) months from the com ancement of the probation period. ARTICLE 21. IND0INIFSCATEDN ANO L AL SERVICES Refer to City Ordinance Chapter I, Article 71 Section 1 tbra 1.4 ARTICLE 22. Section 1. A gnd.avance, for the purposes of this Article, shall be defined as any oatruversy, complaint, misunderstanding or dispute arising between an officer or officers and the City, or between. the Union and the City as to the meaning or application of the specific terms a this collective bargaining agreement. Section 2. Etery reasonable effort shall be made by the parties involved to arrive ate 79r a equitable resolution of every grievance without resorting to the grieoance procedure hereinafter set forth. If this is found to be impossible, the matter may be submitted to the grievance procedureinaccordance with the terms of this Article. 8 Section 3. If the grievance has not been adjusted informally as above suggested it may be submitted to the following procedures: A. The steward, with or without the officer, shall take up the grievance or dispute with the Chief at Police within ten (10) days after the date of the grievance or of the officer's knowledge of its appearance. The Chief of Police shall att mr�. to adjust the matter and shall render his decision to the steward in writing within ten (30) calendar days. B. If said grievance has not been settled, it shall be presented in oriting, to the City Manager within ten (10) calendar days after the Chief of Police's decision is rendered. The City Manager and/or the Personnel Director shall render his decision to the Steward and the Union businessent in writing. within ten (10) calendar days after nreserdment to him. The Manager anzar the Personnel Director shall meet with the Union business agent in an effort to resolve the grievance. C. If the grievance is still unsettled, the City Manager and/or Personnel Director may be reouested by written notice within ten (10) calendar days of such decision, to bring the matter before the City Council, or a committee thereof. D. If the grievance is still unsettled either party to this Agreement may within ten (10) calendar days, by written notice to each other, submit said grievance to the Maine Board of Arbitration in accordance with Section 990 of the Maine Public Employees Labor Relation Law. (a) The decision of the arbitrator shall be binding as to the grievance submitted. (b) The general expense of the arbitrator shall be shared (c) Ganally by the Union and the City. rievances initiated by the City shall be processed in the same masher, but may be started by Stap B. Section L. Time limits specified may be extended by mutual agreement. ARTICLE 23. DISCIPLINARY iMgRINGS Section 1. Any disciplinary action by the Chief of Police, or the Acti% Chief, against any member of the Bangor Police Department covered by this Agreement, open any charge of violation of Department rules, inefficiency, incomeetence, m Cn cduct, negligence, insubordination, disloyalty, or other charge, shall be takenonly after due notice and hearing., except in cases where the nature of the alleged. violation warrants; immediate emergency suspension. In such cases the officer x111 nat be suspended for re than (1) one day. Tice officer may be suspended with the understanding that if he is later found innocent of the allegations he '311 be paid for all time during which he has susnended. Section J. The member so charged shall have the right to be accompanied by legal counsel at the hearing as well as by a full time representative of the Local Union. The officer so charged shall have the right to confer with his couneel at any time during the hearing and shall have the right to have his counsel speak on his behalf. Section 3. Any officer who feels he has been aggrieved in any disciplinary action may a real in writing to the Civil Service Commission for a hearing on such grievance within (10) days of the receipt of the written notice, ormay use the grievance prooedure- ontained in this A^ emend, but the officer may not use the grievance procedure, and have acce.a to the Civil Service Commission for his appeal.. Section 4. Any disciplinary action resulting in loss of time and or money Ali be administered only by the Chief of Police. Any written rerimand which is to beOm part of the nermarent servicerecord of the employee will be issued only by the Chief Police or the Assistant Chief. ARTICLE. 24, STRIKES e34D IgOM"S PROHIBITED Section 1. For the duration of this A;peement, the Union shall not eng=uge in a work stonpage,, a slowdown, or a strike. Section 2. In consideration of no strike pledge by the Union, the City shall not lookout emnloyees for the duration of this Agreemerd. ARTICLE 25. VW ARM Section 1. The City recognizes the right of the Inion to designate a steward and an alternate who must be members of this bargaining unit. The steward and alternate steward of the Union, shall be allowed time off with pay for official Union business with representa— tives of manegemert upon appointment, if there is sufficient manpower available to cause no interference with departmental operations. .Stewards of the Union shall be allowed time off with per during their regular work or shift hours to investigate grievances or to attend grievance hearings, but in no case shall such time exceed a total of two (2)_ hours per week for not more than two (2) representatives. Section 2.No time off or leave of absence shall be permitted under this Article 25 unless the Chief or his designee determines there is sufficient manpower available for normal departmental operations. ARTICLE 26. BULUTIN BOARDS The City shall permit the reasonable use of bulletin boards by the Union for the poetinf, of entices relating to Union business. 16 ARTICLE 77, 41di,9DZImol All officers who are members of Maine hate Retirement 3yatem ,shall be entitled to retire after having eoapleted twenty (20) yearn, of service asa Police Officer :ith the Bangor Police Department. Retirement benefits shall be granted and computed in accordance with Chapter II, Article 14, Section 13 through it of the Lawa and Ordinances of the City oe Bangor, as amended by City Ordinance or State Statute. lRfICLE M. WORK RULES Section 1. when existing work rules are changed or new rules ars l be pproposed they shalosted prominently on all bulletin boards for a period of ten (10) am— secutive work days before becoming effective. Objections to any proposed work rules shall be made in writing to the department head who shell have the responsibility for reviewing such objections and making final determination. Appeals from his decision can be made in accordance with normal grievance procedures. Section 2., (IM)RMING OFFICERS) The City further agrees to famish each officer subject to this contract with a copy of all new work rules thirty (30) days after they become effective; new officers shall -be_provided with a copy of the rules at the time oP hire. Section 3.1. (ENFORCING) Officers shall comply with all existing rules that are not in conflict with the terms of this Agreement. Section 4. An unresolved complaint involving discrimination in the application of new or existing rules shall be resolved through the grievance procedure. ARTICLE 29. RESIMOT Section 1. All new employees in the bargaining unit shell prier to the e>piratiheir probationary period, establish their domicile within the boundaries of the City of Burger. Any such employee who has not established a domicile as hereinabove stated shall be subject to dismissal. Section 2. The foregoing restriction as to residency shall not apply to those members of this bargaining unit who prior to January 1, 1971, reside outside of the City limits, it being the intent of the parties hereto that those employees shall not be compelled to change their residency as a condition of their continued employment with the Police Department. Section 3. It is further understood tact any employee. who is presently living within the ten mile radius currexkly provi0d for under the City ordinance, may be allowed in the future to change his residency as long as he remains inside o4 the ten mile radius as defined in the City ordinance. ARTICLE 30. NAVA MWT RIGHTS. Except as explicitly limited by specific provision of this Agreement. the City shall continue to have the exclusive right to take a" action it deems appropriate in the operation of the Police Departmend, and direction of the work force in accordance with its Judgment. Such rights shall include, but shall not be limited to, the operation of the police force, direction of the working forces, the right to hire, to suspend or to dis. charge for just cause, to change assignments, to promote, to reduce or expand the working" forces, to transfer, to maintain discipline, to establish work schedules, and to introduce nee. r imnroved methods or facilities. ARTICLE 31. SAVINGS CLAUSE If any, provision of this Agreement shall be contrary to any len, such invalidity shall not effect the validity of the remaining provisions. Any provision subject to this article shall be renegotiated by both parties. ARTICLE 32. LIE DMUTUR TEST The City shall net require, suggnat or request that a Police Officer take a nolygraph or any other form of lie detector test.
