HomeMy WebLinkAbout2021-04-12 21-147 Order 04/12/202121-147 04/12/2021 21-147 Legal Order 035-008 Title, Order Authorizing the City Manager to Execute a Developement Agreement with William Matthew Hinton and a Quitclaim Deed for Real Estate Located at 69 Walter Street. This order would authorize the City Manager to execute a development agreement with William Matthew Hinton for 69 Walter Street. It will also authorize the City Manager to execute a deed with reverter provisions as part of the agreement. Currently, the City of Bangor has an ownership interest in 69 Walter Street by way of matured liens assessed against Karen Lee Stewart. Karen Lee Stewart would like to sell the property to William Matthew Hinton and would like the City to release its ownership interest as part of the closing. However, there are code concerns on the property, including a failing foundation. As part of the closing, the buyer is willing to enter into a development agreement with the City that would require said buyer to rehabilitate the property. Additionally, the development agreement will include the requirements that the buyer obtain a building permit on or before June 1, 2021, that the buyer finish the rehabilitation and obtain a certificate of occupancy within one year of obtaining the building permit, and that taxes or a payment in lieu of taxes always be paid upon the property. The agreement shall be in a final form as approved by the City Solicitor's Office. Recommend for passage Consent 04/12/202121-147 CITY OF BANGOR ORDER 04/12/2021 21-147 Nichols Authorizing the City Manager to Execute a Developement Agreement with William Matthew Hinton and a Quitclaim Deed for Real Estate Located at 69 Walter Street. Be it Ordered by the City Council of the City of Bangor that, WHEREAS, the City has an interest in the property located at 69 Walter Street (Map and Lot 035-008) due to a matured tax lien recorded in the Penobscot Registry of Deeds in Book 14872, Page 121; and WHEREAS, there are building code violations on the property, including a failing foundation; and WHEREAS, the prior owner wishes to sell any interest in the property that said prior owner has to William Matthew Hinton; and WHEREAS, the City is willing to release its ownership interest in the property as part of that sale provided that William Matthew Hinton agrees enters into a development agreement to rehabilitate the property and provided that the deed and development agreement contain adequate enforcement provisions; BE IT ORDERED THAT BY THE CITY COUNCIL OF THE CITY OF BANGOR THAT, The City Manager is hereby authorized, on behalf of the City of Bangor, to execute a development agreement with William Matthew Hinton for the rehabilitation of 69 Walter Street. Said development agreement shall contain conditions that full payment of all amounts due to the City be received, William Matthew Hinton obtain a building permit by June 1, 2021, that the rehabilitation be completed within one year of obtaining the building permit, and that taxes or a payment in lieu of taxes always be paid upon the property. The Development Agreement shall also contain a reverter provision for the enforcement of the development conditions. The City Manager is further authorized to execute a Municipal Quitclaim Deed for the property releasing the City's interest to William Matthew Hinton. Said Deed shall contain a reverter provision as discussed above. The agreement and deed shall be in a final form as approved by the City Solicitor's Office.
