In 2012 the City acquired a deed for a condominium unit in the former Freese's Department Store; from Realty Resources Inc. The City has worked extensively over the past year to identify potential costs and uses for the building. However, given the amount of renovation work needed to make the space usable and the lack of available funding, staff has determined that the best alternative is to issue a request for proposal for the buildings re—use: Attached is a draft Request for Proposals document for the Council's review. If approved, the process would be as follows. November 28, 2012 — Issue RFP December 11, 2012, at 10:00 am — Site Visit for interested parties. January 30, 2013, at 2:00 pm — Responses due to City. Order, Authorizing Issuance of Request for Proposals for Property at 96 Main Street WHEREAS, the City of Bangor owns a condominium unit at 96 Main Street in the former Freese's Department Store building; and WHEREAS, the City of Bangor supports new investment and the creation of additional development in its downtown area; and WHEREAS, the City of Bangor wishes to seek individuals, developers, and groups interested in purchasing the property from the City for the purpose of redevelopment; BE IT ORDERED BY THE CITY COUNCIL OF THE CITY OF BANGOR THAT The City Manager is hereby authorized to issue the Request for Proposals drafted by staff to solicit interest in the property located at 96 Main Street. Upon completion of the RFP process, staff recommendation will be brought to the City Council Business and Economic Development Committee and the City Council for consideration. IN CITY COUNCIL November 26, 2012 Passed 4CITYIWR�K 13 031 REQUEST FOR PROPOSALS For DEVELOPMENT OF SPACE IN THE FORMER FREESE'S DEPARTMENT STORE BUILDING 96 MAIN STREET BANGOR, MAINE Issued by: The City of Bangor Department of Community and Economic Development 73 Harlow Street Bangor, Maine 04401 November 28, 2012 "13 03 1 REQUEST FOR PROPOSALS FOR LEASE OR PURCHASE OF SPACE IN THE FORMER FREESE'S DEPARTMENT STORE BUILDING Request for Proposals The City of Bangor Department of Community and Economic Development seeks a developer for the bottom three floors of the building, a condominium which is part of the larger 3 -condo building. Approximately 6,000 square feet of space is available on the first floor street level, 4,200 square feet on the second floor level and 5,000 square feet on the third floor level, for a total of approximately 15,200 square feet. The building is within 300 feet of the City's 504 space parking garage where the first two hours of parking are free. The City seeks submittals that propose the purchase of this space from the City, not proposals for lease of the space from the City. The City expects to receive compensation for the property and will not be providing capital. IL Background The City of Bangor reacquired this condominium unit in 2012. The space is part of what was formerly Freese's Department Store at 74-96 Main Street in downtown Bangor. The rear one third of the building facing Pickering Square (approximately 48,000 square feet) has been developed by Realty Resources into 34 apartments of elderly housing rented to persons meeting the U.S. Department of Housing and Urban Development definition of low and moderate income persons. The top three floors of the Main Street side of the building, encompassing some 45,000 square feet of building space, has been developed by Realty Resources into 39 apartments of elderly housing with assisted living services provided. The bottom three floors of the Main Street side are occupied by the Maine Discovery Museum and this condo available for development. The condominium unit available for development is not in white box condition. Preliminary information gathered by the City indicates the space has good structural condition, but needs significant improvements to be usable. A walk through of the space will be conducted on Tuesday, December 11, 2012 at 10:00 am at the property. Gather at the glass atrium entrance at the corner of Water Street and Main Street. III. Permitted Uses Permitted uses in the Downtown Development District include: business office, professional office, motel, hotel or inn; schools conducted for profit; group day care or nursery school; day care center, educational or cultural uses such as museums, libraries, theaters, sports arenas and convention centers, community service organizations, private membership, social and fraternal clubs; governmental offices; enclosed recreation center; retail or service business; and residential uses. IV. Proposals Proposals from interested enterprises should address the following: 13 031 1. Proposed use of space. 2. Nature of building requirements needed and renovations planned. 3. Investment the enterprise will make in the building. 4. Approximate date by which the space desired would be renovated and available for use. 5. Public benefit of the proposed use, including impact of the activity on Downtown Bangor in particular. 6. Economic impact of the enterprise's presence. 7. Net new jobs created by the redevelopment. 8. Parking requirements and other needs such as transit, security, etc. 9. Hours of operation. 10. Viability of business plan and sustainability of the operation. 11. Track record of the principals involved, including background on individuals/corporate entities involved and their project history. 12. Compatibility of new activity with existing activity. V. Review of Proposals All proposals submitted will be reviewed by staff of the City of Bangor and staff recommendation will be presented to the Business and Economic Development Committee of the City Council. VI. Submission Requirements This section of the Request for Proposal details the format for information to be submitted with the proposal. Proposals should be submitted on 8 % by 11 inch paper for ease in photocopying. The envelope containing the proposal shall be sealed and plainly marked 'Proposal for Use of Space in the Former Freese's Building" and shall bear the name and address of the entity submitting the proposal. If forwarded by mail, the sealed envelope containing the proposal shall be enclosed in another envelope addressed as specified. Timely delivery is the sole responsibility of the entity submitting the proposal. All brochures, presentations and items submitted in support of proposals to the City will become the property of the City. All proposals received by that City will be opened and made available to the general public. A. Cover/Title Page A cover/title page shall indicate the proposal is being submitted as a Proposal for Use of Space in the Former Freese's Building. The firm/organization submitting the proposal shall be identified including mailing address, telephone number, email address, website, and contact person. B. Table of Contents A table of contents shall be presented along with the proposal. All pages shall be sequentially numbered. 13. 0.91 C. Modification or Withdrawal of Proposals Proposals may be modified or withdrawn in person or by written notice that is received at any time prior to the closing date and time specified. Proposals may be withdrawn in person only by an authorized representative of the entity submitting the proposal. VII. Selection Process A. Evaluation Criteria All proposals will be evaluated to assure they meet all proposal requirements and are fully responsive to this Request for Proposals. Proposals meeting all the project requirements will then be evaluated based on the criteria contained in either Section IV or V above, with particular emphasis on job creation, taxable investment, and developer capacity. B. Selection Process Proposals submitted and determined to be responsive will be evaluated by City staff. The staff recommendation will then be taken to the City's Business and Economic Development Committee. A final agreement for the purchase will then be developed and must be approved by the Bangor City Council. C. Disclaimer The City of Bangor will not be responsible for any costs incurred by other entities in the preparation of a response to this Request for Proposals. The City furthermore reserves the right to select the proposal or proposals deemed most advantageous and, thus, reserve the right to reject any or all proposals received.
