Item No. 3 024
Date: November 26, 2012
Item/Subject: ORDINANCE, Amending Chapter 165, Land Development Code, of the Code
of the City of Bangor, By Allowing Vehicle and Equipment Sales and Service in
the Industry and Service District (ISD)
Responsible Department: Planning
Commentary:
This Ordinance will amend Chapter 165 of the Land Development Code to allow vehicle
equipment sales and service in the Industry and Service District. Heavy vehicle, equipment,
mobile homes, and machinery sales and service is currently not permitted in the City's Industry
and Service zoning districts. This has created issues particularly in commercial enterprise that
services heavy and commercial equipment and sales. In the past the City has approved contract
zoning amendments to remedy the situation. In a recent application, a business with a
grandfathered use has expressed an interest in rebuilding or expanding one of their current
structures, which would not be allowed under the current zoning rules.
Upon review, and given the number of previous requests, Staff recommends that vehicle,
equipment, mobile home, and machinery sales and service should be considered as a permitted
use in the Industry and Service District. In addition, this ordinance amendment also removes a
clause dealing with accessory uses, as another accessory use clause in the same section makes
the first clause unnecessary.
This item will be referred to the Planning Board for consideration at its December 4, 2012.
