PLANNING DIVISION PLANNING BOARD MEETING MINUTES TUESDAY, FEBRUARY 16, 2021, 7:00 P.M. Anne Krieg, Planning OfFicer Joshua Saucier, Asst. City Solicitor Chair Huhn called meeting to order at 7:00 P.M. MEETING MANAGEMENT LAND DEVELOPMENT CODE AND MAP AMENDMENT 1. Zone Chanqe — 85 Fern Street— Map-Lot 054-129 — Urban Residence District-1 (URD-1) to Urban Residence District-2 (URD-2) — Sean Hutchinson o/b/o Rock Maple Holdinqs LLC - To amend the Land Development Code by changing a parcel of land, located at 85 Fern Street, (Map-Lot 054-129) Urban Residence District-1 (URD-1) to Urban Residence District-2 (URD- 2). Said parcel of land contains 0.29 acres. Sean Hutchinson o/b/o Rock Maple Holdings LLC, applicant. Sean Hutchinson presented the application. Members posed the following questions and discussion: • When was this converted to a duplex? o Owner was not certain, residence designed in the 1900's as a single-family residence. • Many properties in the city are zoned URD-1, but are multi-family residences. Planning Officer Krieg reported the following: • Non-conforming protection research was completed — will be able to restore 2"d dwelling in structure if City Council passes the zoning request No proponents nor opponents spoke on the application. Member Brush moved to recommend amending the Land Development Code by changing a parcel of land located at 85 Fern Street (Map-Lot 054-129) Urban Residence District-1 (URD-1) to Urban Residence District-2 (URD-2), said parcel of land containing .29 acres. Roll call vote: Bazinet, yes; Perkins, yes; Meagher, yes; Hogan, yes; Brush, yes; Huhn, yes. Motion moves to City Council. 2. Stormwater Manaqement and Erosion Control Requirements by Stormwater Technician Rich M ay Item has been tabled to Planning Board meeting of March 2, 2021. OTHER BUSINESS 3. 2020 Banqor Planninq Board Annual Report Planning Officer Krieg presented the 2020 Planning Board Annual Report. 4. Discussion on Short Term Rentals, Shared Housinq and Bed & Breakfasts Effort to create policy as recommended from the 2019 Affordable Housing Work Group. There is evidence suggesting that housing units are taken away from year-round people for property owners to do short term rentals. There also may be a housing stock supply concern. The use is not currently allowed in the City Code. • Considerations noted included: o Pros: ■ Viable option for traveling public ■ Business travel to include (but not limit to) nurse, sales people, construction workers ■ Great income stream for property owners • Rent a single room • Rent the whole house • Historical properties o Cons: ■ Potential neighborhood erosion ■ Housing stock decrease ■ Increase values The end result might be a combination of regulation. StafF recommending that there be a registration and inspection process considered to address public safety/life safety concerns. This would include a contact name to reach out to with any problems. Questions for policy discussion include: ■ Should it be allowed in certain districts? ■ Do you feel that it would negatively impact one district over another? ■ "Surgical Zoning" overlay over a particular neighborhood. ■ Allowing in single-family home, or owner-occupied buildings The ripple effect with bed and breakfasts, boarding houses was also discussed Planning Board Members and Staff discussed the following: • There are already homeowners doing this - Technically right now it is not allowed. Page 2 � 3 City of Sangor Planning Division Planning Soard minutes 2.16.21 meeting • How is this being enforced currently? • All three (short term rentals, bed and breakfasts and boarding homes) provide a diversity of opportunities, and appeal to different demographics • Health and safety accomplished with regulations • A clearer list of pros and cons needs to be created. • Neighborhood erosion • Parking concerns o Adequate parking is needed o Serious problems in the winter • Burden to Code Enforcement- Is the city prepared to manage this? • Tax implications? • Help to improve historic properties • Caps at the number of allowed short term rentals—concern that the permit becomes a commodity • Allow it everywhere or decide to allow in certain places — or circumstances o Owner occupied —that is, you own property, and you live there 6 months +1 day— allow short-term rental, or room rental no matter the district. o Restrict to single family or 2-units. • In larger cities, people are buying apartment buildings and turning them into short term rentals. All units are then removed from housing stock options for residents of that city. • Staff level outreach to be performed with people that utilize short term rentals, neighborhoods and general public for feedback about how they feel regarding these uses • Exterior upkeep—there are differences between owner occupied and non-owner occupied in terms of exterior upkeep and maintenance • Not allowed in Bangor, but there is a proliferation of them o How to control if they're proliferated in the absence of regulation? Dustin Roeder spoke regarding parking concerns as well as owner occupied properties. Provided example of shoveling — property owners maintain sidewalks in front of their homes, while non- owners do not. 4. Meetinq Minutes — February 2, 2021 meeting minutes were approved with a motion by Member Meagher, seconded by Member Hogan. Roll call vote: Bazinet, yes; Perkins, yes; Meagher, yes; Hogan, yes; Brush, yes; Huhn, yes. Meeting was adjourned at 7:47 P.M.
