ORDERED,
THAT the City Manager be and hereby is authorized to sign
the attached Memorandum of Understanding covering the recon-
struction and widening of Union Street between Westland Avenue
and Griffin Road as part of the Federal Urban Program, and be
it further
OR11FRED I
THAT the City's share of the project be allocated from a
future Bond Issue.
STATEMENT OF FACT:
The total estimated cost of this project is $113841000.,
of which twenty percent, or $276,800.1 is to be paid by the
City of Bangor. The project is not scheduled to be advertised
for bids until the summer of 1984.

FEOERAL AID PROJECT: M-1550(1) LOCATION: Route 222, 0.90 mile
PROGRAM ITEM: 60.00 'SCOPE OF WOW: Reconstruction incl. widening
Whereas the subject project has been included in the Capital Improvement Pro-
gram, contingent on local cost sharing, it is necessary for the city of Bangor,
hereinafter referred to as the wunicipality, and the Paine department of
Transportation, hereinafter referred to as the Department, to agree to a project
coordination and reimbursement procedure.
The Municipality must indicate their concurrence in these commitments, as out-
lined, by signing theoriginal of the Memorandum in the spaces provided and return
it to the Chief Engineer, Maine Department of Transportation, Augusta, Maine
00333. This signed document must be received prior to the beginning or continua-
tion of preliminary engineering activities.
Oefinitions '
1. Programmed Cost
The programmed cost of a project is the estimated cost as
shown in the Oepartment's Capital Improvement Program. The
programmed cost of this project is $1,380,000. This amount
Is for planning purposes only, since it is based Won
preliminary information. The Project development process
will refire this figure using more detailed information and
will provide the "total estimated cost" to be used as a basis
for the 'Wnicipml 51hare." -
2. Total Estimated Cost
The total estimated cost of a project is the estimated cost
at the completion of the project deralWwnt process, includ-
ing the cost of engineering, right-of-way, construction, and
other items considered necessary to satisfactorily complete
the project. This amount will be the basis for determining
the 'Nonicipal Share" of project cost. -

Municipal Snare
Me Municipal Snare represents the portion of the total
estimated cost of a project to he made available by the
Municipality. The Municipal Share of the subject project is
20% of the total estimated cost.

1. Prior to the beginning or continuation of the project devel-
opment process, the. Municipality will forward a signed copy
of this Memorandum acknowledging that the level of the Muni-
cipal financial obligation toward this project indicated
above is acceptable.
2. At the completion of project design and right-of-way
appraisal the Department will notify the Municipality of the
"total estimated cost' of the project which is to be the
basis of the payment expected from the Municipality. This
notification will be in the form of a City/State Agreement
(see paragraph C.3 below.) Tle project will not he adver-
tised for bids until the Municipal share of the cost of the
project has been received by the State. Our current schedule
calls for advertisirg this project in the Summer, Deo.
3. 1pen receipt of the Municipality's share of the funds, the
project will be advertised for bids antl subsequently the
construction contract will be awarded. Should the total
estimated cost of the project as a result of contract award
be different than the "total estimated cost," which deter -
mired the 'Municipal Shane," then the Municipality will he
responsible only for their pro -rata share of the lessor
amount.

The total financial obligation of the Municipality towarc
this pmjat will be completed with the action required by
Paragraph 3. above, unless significant changes in the scope
of the. construction initiated by the Municipality, or the
Department and agreed to by both parties and the Federal
Highway Adainistratim result in an increase in the "total
estimated cost." In which case, the Municipality is expected
to pay their pro -rata portion of the increased cost.
Project Development
1. The Oepartment, during the project public participation process,
will arrange for a meeting with the officials of the Municipal-
ity, if desired by the Municipality, to review the project
limits, scope of work, etc., based an the best information avail-
able at that time. '
2. Additional reviews may be requested by either the Municipality or
the DaPartment at any point in the Project development process.
3. P City/ tate agreement will be Prepared by the State formalizing
the fencing and will outline the work to be done by the State and
that which is to be performed by the Welcipolity.
0. The Municipality and the Department retain the right to terminate
the project at any time Prior to the actual acquisition of right-
of-way. Projects carnet be temdnated by the Municipality subse-
quent to right-of-way acquisition without concurrence by the
Department.
a. Projects terminated by the Municipality
The MmICiPaIHy shall he responsible for the entire
nor -federal sham of the total expenditures incurred
against the project at the time of termination.

b. Projects terminated by the Department
The _Department shell be responsible for the entire
non-federal share of the total expenditures incurred
against the project at the time of termination.
c. Projects terminated by Mutual Agreement
The Municipality and the Department will share propor-
tioretely, as with total project funding, in the reepone-
ibility for the non-federal share of the total expendi-
tures incurred against the project at the time of
termination.
