Meeting Minutes
BED Members Present:Schaefer, Tremble.
Non-BED Members:Sprague.

City Staff Present: Bolduc, Conlow, Emery, Gambrel, King, Nicklas
Acting Committee Chair Spraguecalled the meeting to order at 5:17P.M.
1.Proposed Changes to CO 15-035; Outdoor Seating on Sidewalks and Public
Property
Director Emery provided introduction.
Lisa Leonard (Evenroods), Jimmy Puiia (Waverly), and John Dobbs (Paddy Murphy’s),all
against proposed changes.
Sprague –more money for penalty, less for fee up front.Sprague & Tremble –want them
to be able to leave fences up, put away table and chairs.Staff will amend the proposal to
reflect a $500/year-roundfee for those with alcohol service and 13+ seats, 12 seats and
under will be $250. The fencesmay remain year round, but chairs and tables must be put
away when not in use and the area must be well kept.$50feefor those without alcohol.

Violation of the terms will result first in a warning, and a$100 fee for 2violation. Keep
fencing black until DBP canweigh in on the idea of allowing colors. Staff will rework the
policy and bring it back to Council for approval.
2.ORDINANCE, Amending Chapter 165, Land Development Code, to Allow Indoor
Firearms Ranges in the City of Bangor
Asst. City Solicitor Nicklas provided introduction. Firearms Discharge Committee only
looks at discharge zones and ordinance.
Kevin Schmersal spoke to the item: “this is the most egregious bunch of bull that I’ve seen
in my life… that you’re going to dictate to me how many people I can have on my property
at any one time, and how long I can shoot at any one time. The hours that I can shoot
between -I’ve never seen anything so ridiculous and egregious, and imposing, and
overstepping by its very nature that I’ve seen with this. You ought to be ashamed of
yourselves for even entertaining anything like this. This is my property. I bought and I paid
for this property. I can shoot on this property. You have no right to tell me how many
people I can have at my home, blood related, not blood related. Where is this coming
from? What kind of insanity initiates this kind of foolishness? Anyone, you want to tell me?
This is pushing something through that you want, it’s not based on realityor individual
rights.”
Schmersal is opposed to any limits on who can shoot, and for how long. 3 people is not
okay. Wants to have 20 people. He uses his range 15-22 days a year, seasonally. Another
resident of the area spoke and encouraged the Councilors not to forget about the
agricultural uses –he has many agricultural animals on his property and they are very
bothered by the frequent gunfire activity.
Mr. Robbins approached and asked the Councilors to consider the RR&A zone is still
home to many agricultural uses, as it is supposed to be. He keeps many grazing animals
on his land and they are very disturbed by the gunfire. He would like the Council to
consider other opinions on this matter.
No action on this item, staff will continue working on language.

Tremble.

Councilor Tremblemoved out of Executive Session at 6:21 P.M., seconded by Schaefer.
Councilor Tremble moved approval of staff recommendation,seconded by Councilor
Schaefer. Vote unless doubted, no doubt.
Councilor Schaefermoved into Executive Session at 6:22P.M., seconded by Councilor
Tremble.
